    COMMISSION OPINION of 27 March 1974 addressed to the United Kingdom Government regarding the draft decree laying down measures for the implementation of Council Regulation (EEC) No 2829/72 of 28 December 1972 on the Community quota for the carriage of goods by road between Member States (74/205/EEC)

    1. By letter of 31 January 1974 the Office of the United Kingdom Permanent Representative to the European Communities forwarded to the Commission a draft decree laying down measures for the implementation of Council Regulation (EEC) No 2829/72 (1) of 28 December 1972 on the Community quota for the carriage of goods by road between Member States.

    This communication represents consultation as defined in Article 7 (1) of Council Regulation (EEC) No 2829/72 which lays down that the Member States shall, after consulting the Commission, adopt the laws, regulations or administrative provisions which are necessary for the implementation of this Regulation and which relate in particular to the organization of, procedure for and the means of carrying out inspection measures as well as to the penalties for infringements.

    2. The Commission notes that the measures envisaged comply in spirit and general content with the requirements of Council Regulation (EEC) No 2829/72. Further, the Commission notes, that the provisions concerning penalties for infringements are based on the Commission Recommendation of 7 June 1969 (2), which aims at achieving as far as possible harmonization of the measures to be adopted by the Member States in this field.
