Notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of hand pallet trucks and their essential parts originating in the People's Republic of China
(2006/C 127/02)
The Commission has decided on its own initiative to initiate a partial interim review pursuant to Article 11(3) of Council Regulation (EC) No 384/96 on protection against dumped imports from countries not members of the European Community (‘the basic Regulation’) (1). The review is limited in scope to dumping aspects as far as one exporting producer, Ningbo Ruyi Joint Stock Co., Ltd, (‘the company’) is concerned.
1. Product
The product under review is hand pallet trucks and their essential parts, i.e. chassis and hydraulics, originating in the People's Republic of China (‘the product concerned’), currently classifiable within CN code ex 8427 90 00 and ex 8431 20 00. These CN codes are given only for information.
2. Existing measures
The measures currently in force are a definitive anti-dumping duty imposed by Council Regulation (EC) No 1174/2005 (2).
3. Grounds for the review
There is sufficient prima facie evidence available to the Commission that the circumstances on the basis of which the existing measures were established have changed and that these changes are of a lasting nature.
The information at the Commission's disposal indicates that market economy conditions prevail for the company as demonstrated by the fact that it fulfils the criteria of Article 2(7)(c) of the basic Regulation. Furthermore, a comparison of normal value based on the company's own costs/domestic prices and its export prices would lead to a reduction of dumping significantly below the level of the current measure. Therefore, the continued imposition of measures at the existing levels, which were based on the level of dumping previously established, is no longer necessary to offset dumping.
4. Procedure for the determination of dumping
Having determined, after consulting the Advisory Committee, that sufficient evidence exists to justify the initiation of a partial interim review, the Commission hereby initiates a review in accordance with Article 11(3) of the basic Regulation, with a view to determine whether the company operates under market economy conditions as defined in Article 2(7)(c) of the basic Regulation and, if so, to determine the company's individual margin of dumping based on their own costs/domestic prices, and should dumping be found, determine the level of the duty to which its imports of the product concerned into the Community should be subject.
The investigation will assess the need for the continuation, removal or amendment of the existing measures in respect of the company mentioned above.
(a) Questionnaires
In order to obtain the information it deems necessary for its investigation, the Commission will send questionnaires to the company and to the authorities of the exporting country concerned. This information and supporting evidence should reach the Commission within the time limit set in point 5(a)(i) of this notice.
(b) Collection of information and holding of hearings
All interested parties are hereby invited to make their views known, submit information other than questionnaire replies and to provide supporting evidence. This information and supporting evidence must reach the Commission within the time limit set in point 5(a)(i) of this notice.
Furthermore, the Commission may hear interested parties, provided that they make a request showing that there are particular reasons why they should be heard. This request must be made within the time limit set in point 5(a)(ii) of this notice.
(c) Market economy status
In the event that the company provides sufficient evidence showing that it operates under market economy conditions, i.e. that it meets the criteria laid down in Article 2(7)(c) of the basic Regulation, normal value will be determined in accordance with Article 2(7)(b) of the basic Regulation. For this purpose, a duly substantiated claim must be submitted within the specific time limit set in point 5(b) of this notice. The Commission will send a claim form to the company as well as to the authorities of the People's Republic of China.
5. Time limits
(a) General time limits
(i) For parties to make themselves known, to submit questionnaire replies and any other information
All interested parties, if their representations are to be taken into account during the investigation, must make themselves known by contacting the Commission, present their views and submit questionnaire replies or any other information within 40 days of the date of publication of this notice in the Official Journal of the European Union, unless otherwise specified. Attention is drawn to the fact that the exercise of most procedural rights set out in the basic Regulation depends on the party's making itself known within the aforementioned period.
(ii) Hearings
All interested parties may also apply to be heard by the Commission within the same 40-day time limit.
(b) Specific time limit for submission of claims for market economy status
The company's duly substantiated claim for market economy status, as mentioned in point 4(c) of this notice, must reach the Commission within 15 days of the date of publication of this notice in the Official Journal of the European Union.
6. Written submissions, questionnaire replies and correspondence
All submissions and requests made by interested parties must be made in writing (not in electronic format, unless otherwise specified) and must indicate the name, address, e-mail address, telephone and fax numbers of the interested party. All written submissions, including the information requested in this notice, questionnaire replies and correspondence provided by interested parties on a confidential basis shall be labelled as ‘Limited’ (3) and, in accordance with Article 19(2) of the basic Regulation, shall be accompanied by a non-confidential version, which will be labelled ‘FOR INSPECTION BY INTERESTED PARTIES’.

7. Non-cooperation
In cases in which any interested party refuses access to or does not provide the necessary information within the time limits, or significantly impedes the investigation, provisional or final findings, affirmative or negative, may be made, in accordance with Article 18 of the basic Regulation, on the basis of the facts available.
Where it is found that any interested party has supplied false or misleading information, the information shall be disregarded and use may be made of the facts available. If an interested party does not cooperate or cooperates only partially, and findings are therefore based on facts available in accordance with Article 18 of the basic Regulation, the result may be less favourable to that party than if it had cooperated.
8. Schedule of the investigation
The investigation will be concluded, according to Article 11(5) of the basic Regulation within 15 months of the date of the publication of this notice in the Official Journal of the European Union.

The Commission draws attention to the judgement delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94 — ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.
This judgement confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).
Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

Notice concerning the countervailing measures in force in respect of imports into the Community of certain cotton-type bed linen originating in India: modification of the name of a company subject to an individual countervailing duty rate

Imports of certain cotton-type bed linen originating in India are subject to a definitive countervailing duty, imposed by Council Regulation (EC) No 74/2004 (1).
Harimann International, a company located in India, whose exports to the Community of certain cotton-type bed linen are subject to a countervailing duty of 7,6 % imposed by Council Regulation (EC) No 2143/2004 (2), has informed the Commission that on 20 June 2005, as the result of a change in the company's legal form, it changed its name to Harimann International Private Limited.
The company has argued that the change of name does not affect the right of the company to benefit from the individual duty rate applied to the company under its previous name of Harimann International.
The Commission has examined the information submitted and has concluded that the change of name and legal form in no way affects the findings of Regulation (EC) No 2143/2004. Therefore, the reference to ‘Harimann International’ should be read as ‘Harimann International Private Limited’ in Article 1 of Regulation (EC) No 2143/2004.
The Taric additional code A498 previously attributed to Harimann International shall apply to Harimann International Private Limited.

Air traffic services on a route with limited traffic rights

The Civil Aviation Administration adopted the following decision on the basis of Section 61 of the Air Traffic Act of 3 March 1995 (281/1995) and with reference to Regulation (EC) No 847/2004 of the European Parliament and of the Council of 29 April 2004 on the negotiation and implementation of air service agreements between Member States and third countries.
1. Scope
This decision lays down more detailed provisions on the issue of permits to EC air carriers to operate a route subject to limited traffic rights (hereinafter: route with limited traffic rights). For the purposes of this decision, however, public service obligations imposed pursuant to Article 4 of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes will not be regarded as a limitation.
2. Traffic rights and air carriers' need to use them
2.1 |
Information on traffic rights and their use on routes between Finland and States which are not Members of the European Union and with which Finland has concluded air traffic agreements is available from the Civil Aviation Administration's aviation policy unit, and on the Administration's website (www.ilmailulaitos.fi). |
2.2 |
The aviation policy unit shall publish, on the Civil Aviation Administration's website, information on forthcoming air traffic negotiations between Finland and third countries. |
2.3 |
EC air carriers interested in operating air services on a route with limited traffic rights or on a route between Finland and a State which is not a Member of the European Union and with which Finland has not concluded an air traffic agreement may inform the aviation policy unit of their plans and requirements. Information received by the aviation policy unit will be taken into account when preparing Finland's negotiations on air traffic agreements. |
3. Applying for a permit
3.1 |
When an EC air carrier expresses interest in unused capacity on a route with limited traffic rights, the Civil Aviation Administration's aviation policy unit shall issue a notice inviting applications for a permit to use the route. The notice shall be sent electronically to all EC air carriers operating traffic services in, to and/or from Finland, or which have asked the aviation policy unit for information on unused capacity. The notice shall also be published on the Civil Aviation Administration's website. The notice shall specify the deadline for applying for a permit. |

Applications for a permit shall contain the following information as a minimum:

Applications for permits shall be written in Finnish or Swedish and submitted to the aviation policy unit by the specified deadline. |
4. Permits to use traffic rights
4.1 |
The Civil Aviation Administration's aviation policy unit shall grant a permit for a route with limited traffic rights to the applicant(s) considered to be the best after an overall assessment taking account of the need for passenger and/or freight services, the promotion of competition and the balanced development of Community air traffic. A permit to operate traffic services shall remain in force until further notice or for a period specified by the aviation policy unit. |
4.2 |
During the assessments resulting in the selection of air carriers, the aviation policy unit shall carry out a financial analysis of the various alternatives from the point of view of passenger and freight traffic. The analysis shall describe the market and competition situation on the route. |
4.3 |
When assessing the applications, the aviation policy unit may arrange a public hearing which all the applicants must be given an opportunity to attend. The aviation policy unit shall draw up minutes of the hearing for distribution to all the air carriers which applied for a permit for the route in question. Applicants may submit written comments on the minutes within a specified period. If a public hearing is arranged, the aviation policy unit may not reach a decision about granting permits before the deadline for the submission of comments has expired. |
4.4 |
Decisions concerning the granting of permits are published in accordance with Section 54 of the Administration Act (434/2003) and also published on the Civil Aviation Administration's website. |
4.5 |
Decisions taken by the Civil Aviation Administration's aviation policy unit concerning the granting of permits are administrative decisions, amendments to which may be proposed in accordance with Section 3(3) of the Civil Aviation Administration Act (1123/1990). |
5. Reassessment of permits to use traffic rights
5.1 |
The Civil Aviation Administration's aviation policy unit may reconsider a decision to grant a permit to use traffic rights. Permits must always be reassessed at the request of an EC air carrier operating traffic services in Finland, from Finland and/or to Finland. A reassessment may not be carried out within five years of a permit being granted or of a previous reassessment, however. |
5.2 |
The permit holder must be informed of any reassessment, notice of which must also be published on the Civil Aviation Administration's website. The notice shall specify a deadline by which EC air carriers interested in using the traffic rights covered by the permit must submit permit applications. |
5.3 |
When reassessing permits to use traffic rights, paragraphs 3.2, 3.3 and 4 shall be applied in such a way that existing permits are not affected if the traffic rights covered by the permit are being used effectively and in accordance with European Community competition law and the corresponding national legislation. |
5.4 |
Notwithstanding paragraph 5.1, a permit for a route with limited traffic rights which was granted before this decision entered into force and which applies to a route for which only one air carrier may be selected in accordance with the provisions of the air traffic agreement in question, may be reassessed three years after this decision enters into force. |
6. Cancellation and withdrawal of permits

A permit shall be cancelled if the permit holder informs the Civil Aviation Administration's aviation policy unit in writing that he no longer plans to use the traffic rights covered by the permit. |

4.1 Name: ‘Ekstra deviško oljčno olje Slovenske Istre’
4.2 Description: Olive oil with the designation of origin ‘Ekstra deviško oljčno olje Slovenske Istre’ (Extra virgin olive oil from Slovenian Istria) is produced from olive trees grown in the region of Slovenian Istria. Oil produced from one particular variety must contain at least 80 % of the declared variety. The permitted varieties are Istrska belica, Leccino, Buga, Črnica, Maurino, Frantoio and Pendolino.
Chemical composition:
The distinguishing features of ‘Ekstra deviško oljčno olje Slovenske Istre’ are its high oleic acid content (≥ 72), its low linoleic acid content (≤ 8,0) and a high antioxidant content. Its peroxide number, expressed in mmol O2/kg, is ≤ 7.
Organoleptic description:
The oil has a characteristic fruity aroma reminiscent of olives and other fruits. It must have no organoleptic defects and its overall organoleptic rating must be 6,5.
4.3 Geographical area: ‘Ekstra deviško oljčno olje Slovenske Istre’ is produced, processed and prepared for the market in the region of Slovenian Istria, the borders of which are demarcated as follows:
in the north by the border between Slovenia and Italy;
in the west by the sea;
in the south by the border between Slovenia and Croatia;
in the east by the edge of the Karst region.
4.4 Proof of origin: The area of production is defined at point 4.3. above. The manner in which the oil is produced must also meet criteria designed to guarantee the top quality and special characteristics of ‘Ekstra deviško oljčno olje Slovenske Istre’.
All producers must be registered within the demarcated region and enrolled in the list of producers. Processing must also take place at registered olive oil mills in the same region. During storage all containers must bear the words ‘geografsko poreklo’ (geographical origin) and have a serial number. All information on the series must also be shown on the label. Bottling is permitted only in registered plants in the demarcated region.
4.5 Method of production: The following conditions must be met:
the oils must be obtained from the fruit at a temperature of less than 27° C;
nothing may be added during processing, except water;
the olives must be processed within 48 hours of picking.
The main stages in the production of ‘Ekstra deviško oljčno olje Slovenske Istre’ are:
growing of olives (supervision of quantities and varieties);
picking of olives (by hand) at optimum ripeness;
storage of olives (for no more than 48 hours);
processing (at registered olive mills) with controls on hygiene, temperature and yield;
storage in properly labelled containers at an appropriate temperature (12 to 20° C);
sampling (quality control);
bottling and labelling in registered bottling plants;
storage of bottled oil.
4.6 Link: The special nature of ‘Ekstra deviško oljčno olje Slovenske Istre’ lies in the varieties selected, with the Istrska belica variety being particularly representative. At optimum ripeness, Istrska belica olives produce oil that is characteristically high in biophenols (natural antioxidants). Natural antioxidants are important, as they protect the oil from damage, keep it fresh for longer and give it greater stability.
Authenticity:
Slovenian Istria enjoys a very favourable geographical situation for olive-growing, as it is here that the Mediterranean — with its characteristic climate — reaches its most northerly point, making for an excellent relationship between yield and biophenol content. ‘Ekstra deviško oljčno olje Slovenske Istre’ therefore has a high content of antioxidants and biophenols and achieves top quality. Another contributing factor is the special nature of the soil: Slovenian Istria consists mainly of carbonate flysch covered by Eutric Cambisol soils (the degree of base saturation is over 50 %), the type in which olive trees thrive best.
History:
Olive-oil production in Slovenian Istria is a tradition stretching far back into the past. The Greek historian Pausanius (180-115 BC) mentions Istrian olive oil in his Description of Greece (10.32.19). References to oil production in the region are also preserved in many sources from 1201 to the 17th century and right up to the present day (see detailed list in the application). These show how the production of olive oil in Slovenian Istria has developed through the centuries. Traditional methods and knowledge acquired down the centuries still contribute today to the high quality of the region's olive oil.

4.8 Labelling: ‘Ekstra deviško oljčno olje Slovenske Istre’ is labelled in accordance with Commission Regulation No 1019/2002 on marketing standards for olive oil.
‘Ekstra deviško oljčno olje Slovenske Istre’ can be bottled only in Slovenian Istria. The designation ‘Ekstra deviško oljčno olje Slovenske Istre’ and the indication ‘prvo hladno prešanje’ [first cold pressing] or ‘hladno stiskanje’ [cold pressing] must be visible on the label.
To ensure traceability, the association will issue labels with serial numbers in accordance with the register of producers of olive oil of designated origin.

On 19 May 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Sonae Indústria — SGPS, SA (‘Sonae Indústria’, Portugal) belonging to the group Sonae, acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the business of Hornitex-Werke Beeskow GmbH, the assets of Hornitex-Werke Gebr. Cloos GmbH located in Duisburg and the assets of Hornitex-Werke Gebr. Künnemeyer GmbH located in Meinberg, all belonging to the Hornitex Group (‘Target’, Germany), by way of purchase of shares and assets. |
