    Update of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (1)

    The publication of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (2) is based on information communicated by the Member States to the Commission in conformity with Article 39 of the Schengen Borders Code.

    In addition to publication in the Official Journal of the European Union, a regular update is available on the website of the Directorate-General for Migration and Home Affairs.

    LIST OF RESIDENCE PERMITS ISSUED BY MEMBER STATES

    BULGARIA

    Replacement of the list published in OJ C 77, 15.3.2014, p. 4 .

    I.   Residence permits for third-country nationals are issued in accordance with Council Regulation (EC) № 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals and Council Regulation (EC) № 380/2008 of 18 April 2008 amending Regulation (EC) № 1030/2002:

    1.

    Residence permit for a prolonged residence in the Republic of Bulgaria foreigner – type of permit ‘Prolonged residence’ issued by the authorities of the Ministry of Interior with a validity period of up to one year. The document is issued in accordance with the provisions of the Foreigners in the Republic of Bulgaria Act.

    2.

    Residence permit for a long-term resident-EU – type of permit ‘Long-term resident-EU’ issued by the authorities of the Ministry of Interior with a validity period of 5 years.

    3.

    Residence permit for a foreigner permanently residing in the Republic of Bulgaria – type of permit ‘Residence permit’, issued by the authorities of the Ministry of Interior for a period depending on the validity of the national identity document with which the person has entered the Republic of Bulgaria, but for no more than 5 years.

    4.

    Residence permit type ‘EU Blue Card’ – issued by the authorities of the Ministry of Interior with a period of validity of up to 5 years according to the requirements of Regulation (EC) No 1030/2002, as the field ‘permit type’ is replaced by ‘EU Blue Card’ and in the field ‘note’ is noted the relevant remark in accordance with the provisions of the Foreigners in the Republic of Bulgaria Act, where applicable. The document is issued on the basis of the Foreigners in the Republic of Bulgaria Act.

    5.

    Residence permit type ‘EU Blue Card’ – issued by the authorities of the Ministry of Interior with a period of validity of up to 5 years according to the requirements of Regulation (EC) No 1030/2002, as the field ‘permit type’ is replaced by ‘EU Blue Card’ and in the field ‘note’ is noted: ‘International protection granted by the Republic of Bulgaria on….(date)’. The document is issued on the basis of the Foreigners in the Republic of Bulgaria Act.

    6.

    Single residence and work permit – type of permit ‘Single permit’ issued by the authorities of the Ministry of Interior with a validity period of up to three years in accordance with the requirements of Regulation (EC) No 1030/2002, the field ‘type of permit’ is replaced by ‘single permit’ and in the field ‘note’ the condition for access to the labor market is indicated. The document is issued on the basis of the Foreigners in the Republic of Bulgaria Act.

    7.

    Seasonal worker permit – type of permit ‘Seasonal worker’ issued by the authorities of the Ministry of Interior in accordance with the requirements of Regulation (EC) No 1030/2002, as in the field ‘type of permit’ shall be marked ‘seasonal worker’ and in the field ‘note’ the condition for access to the labor market is indicated. The document is issued on the basis of the Foreigners in the Republic of Bulgaria Act.

    8.

    Permit for a person moved in intra-corporate transfer – issued by the authorities of the Ministry of Interior in accordance with the requirements of Regulation (EC) No 1030/2002, as in the field ‘type of permit’ is marked ‘ICT - intra-corporate transfer’ and in the field ‘note’ the condition for access to the labor market is indicated. The document is issued on the basis of the Foreigners in the Republic of Bulgaria Act.

    9.

    Residence permit for a long-term resident type of permit ‘Prolonged residence’ with the indication ‘beneficiary according to Article 3(2) of Directive 2004/38/EC’ – issued by the authorities of the Ministry of Interior with a validity period of up to 5 years.

    10.

    Residence permit of a permanent resident type ‘Residence permit’ with the indication ‘beneficiary pursuant to Article 3(2) of Directive 2004/38/EC’ – issued by the authorities of the Ministry of Interior with a validity period of up to 10 years.

    11.

    Mobility permit for intra-corporate transfer – issued by the authorities of the Ministry of Interior in accordance with the requirements of Regulation (EC) No 1030/2002, as in the field ‘permit type’ is marked ‘mobile ICT – mobility at ICT’ and in the field ‘note’ the condition for access to the labor market is indicated

    12.

    Prolonged residence permit of a foreigner type of permit ‘Prolonged residence’ marked ‘researcher’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    13.

    Residence permit for a foreigner who is long-term resident in the EU – issued by the authorities of the Ministry of Interior with a validity period of 5 years; in the residence permit of a foreigner who has long-term resident in the EU who has resided as an EU Blue Card holder, in the field ‘note’ is marked ‘former EU Blue Card holder’.

    14.

    The residence permit of a long-term resident in the EU foreigner on the grounds of granted international protection by the Republic of Bulgaria in the field ‘note’ shall be noted: ‘International protection granted by the Republic of Bulgaria on ..... (date)’

    15.

    Residence permit for a prolonged term residence of a national of United Kingdom of Great Britain and Northern Ireland or of a member of his family as required by Regulation (EC) № 1030/2002, with the entry in the field ‘type of permit’ – ‘Art. 50 TEU’ and in the field ‘note’ is marked ‘Art. 18 (4) of the Agreement’ – issued by authorities of the Ministry of Interior with a validity period up to 5 years.

    16.

    Permanent residence permit of a national of the United Kingdom of Great Britain and Northern Ireland or of a member of his family, as required by Regulation (EC) No 1030/2002, with the entry in the field ‘Type of permit’ with the entry ‘Art. 50 TEU Residence permit’ and in the field ‘Note’ is marked ‘Art. 18 (4) of the Agreement’ – issued by the bodies of the Ministry of Interior with a period of validity of 10 years.

    17.

    Residence permit for a prolonged term resident family member of a Bulgarian citizen with the indication of ‘family member of a Bulgarian citizen’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year; The document is issued to persons who have obtained the right of continuous residence on the grounds of art. 24, para. 1, item 18 of the Foreigners in the Republic of Bulgaria Act.

    18.

    Residence permit for a prolonged term resident in the Republic of Bulgaria foreigner marked ‘unaccompanied child foreigner’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    19.

    Residence permit for a permanent resident family member of a Bulgarian citizen with the indication of ‘family member of a Bulgarian citizen’ – issued by the authorities of the Ministry of Interior for a period depending on the validity of the national identity document with which the person has entered the Republic of Bulgaria, but for no more than 5 years; The document is issued to persons who have received the right of permanent residence on the grounds of art. 25, para. 1, item 11 of the Foreigners in the Republic of Bulgaria Act.

    20.

    Prolonged term residence permit of a foreigner marked ‘researcher – mobility’ – issued by the authorities by the Ministry of Interior with a validity period of up to two years.

    21.

    Prolonged term residence permit of a foreigner marked ‘student’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    22.

    Prolonged term residence permit of a foreigner marked ‘pupil’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    23.

    Prolonged term residence permit of a foreigner marked ‘trainee’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    24.

    Prolonged term residence permit of a foreigner marked ‘volunteer’ – issued by the authorities of the Ministry of Interior with a validity period of up to one year.

    25.

    Residence card, as in the field ‘note’ is marked „family member of a EU Art. 10 Dir. 2004/38/ЕC – issued by authorities of the Ministry of Interior with a validity period of up to 5 years.

    26.

    Residence card, as in the field ‘note’ is marked „family member of a EU Art. 20 Dir. 2004/38/ЕC – issued by authorities of the Ministry of Interior with a validity period of up to 10 years.

    27.

    Residence permit of a prolonged term resident family member of an EU citizen who has not exercised his right to free movement – issued according to Regulation (EC) No 1030/2002 with a validity period of up to 5 years, as in the field ‘note’ is marked ‘family member Directive 2004/38/EC’.

    28.

    Residence permit of a permanent resident family member of an EU citizen who has not exercised his right to free movement – issued according to Regulation (EC) No 1030/2002 with a validity period of up to 10 years, as in the field ‘note’ is marked ‘family member Directive 2004/38/EC’.

    29.

    Diplomatic card – issued to a diplomatic employee in a diplomatic or consular representation or in an international organization accredited in the Republic of Bulgaria with a period of validity depending on the period of accreditation.

    30.

    Consular card - issued to a consular employee in a diplomatic or consular representation or in an international organization, accredited in the Republic of Bulgaria with a period of validity depending on the period of accreditation.

    31.

    Card of administrative and technical staff - issued to an administrative and technical employee in a diplomatic or consular representation or in an international organization accredited in the Republic of Bulgaria with a period of validity depending on the period of accreditation.

    32.

    Card of service staff - issued to an employee of the servicing staff in a diplomatic or consular representation or in an international organization, accredited in the Republic of Bulgaria with a period of validity depending on the period of accreditation.

    II.   All other documents issued to third-country nationals having equivalent value to a residence permit:

    Temporary Protection Registration Card of Foreigner with Temporary Protection: (Регистрационна карта на чужденец с предоставена временна закрила).

    Temporary Protection Registration Card of Foreigner with Temporary Protection is issued to beneficiaries of temporary protection based on the legislative framework concerning the compliance with the Temporary Protection Directive and the Council implementing Decision 2022/382 of 4 March 2022. It is issued to the following categories: a) Displaced Ukrainian nationals b) stateless persons or nationals of another third-country, other than Ukraine, who left Ukraine resulting the war. On the basis of Μinisterial Decision no. 144/10 March 2022 on providing temporary protection for displaced persons from Ukraine, extended with the following Ministerial Decisions: no. 180 of 2022, no. 240 of 2022, no. 95 of 2023, no. 642 of 2024, the validity of Temporary Protection Registration Card of Foreigner with Temporary Protection is prolonged until 4 March 2025.
