DECISION OF THE EEA JOINT COMMITTEE No 136/2024

of 12 June 2024

amending Annex XIII (Transport) to the EEA Agreement [2024/2453]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 supplementing Regulation (EU) 2019/1239 of the European Parliament and of the Council as regards the establishment of the European Maritime Single Window environment data set and amending its Annex (1) is to be incorporated into the EEA Agreement.

(2)

Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

1.

The following is added in point 56la (Regulation (EU) 2019/1239 of the European Parliament and of the Council):

‘, as amended by:

—

32023 R 0205: Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 (OJ L 33, 3.2.2023, p. 24).’

The following point is inserted after point 56la (Regulation (EU) 2019/1239 of the European Parliament and of the Council):

‘56laa.

32023 R 0205: Commission Delegated Regulation (EU) 2023/205 of 7 November 2022 supplementing Regulation (EU) 2019/1239 of the European Parliament and of the Council as regards the establishment of the European Maritime Single Window environment data set and amending its Annex (OJ L 33, 3.2.2023, p. 24).

The text of the Regulation shall, for the purpose of this Agreement, be read with the following adaptations:

(a)

As regards the EFTA States, the column with the heading “UCC Annex B” in Section 2 of Annex II shall be optional.

(b)

In Section 2 of Annex II, information in a data element regarding UCC code list and the GEONOM code list shall not apply to the EFTA States.’

Article 2

The text of Delegated Regulation (EU) 2023/205 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 June 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 157/2022 of 29 April 2022 (2), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
