    Proposal for a Council Regulation amending Regulation (EEC) 1107/70 on the granting of aids for transport by rail, road and inland waterway (COM(95)0377 - C4-0390/95 - 95/0204(SYN))

    The proposal was approved with the following amendments:

    (Amendment 1)

    Recital 1a (new)

    Whereas the growing requirement for mobility is placing ever increasing demands and pressures on people and the environment; whereas to take account of the present highly uneven spread of costs and pressures between the different modes of transport, the possibility must be created of improving or increasing aid to environment-friendly forms of transport such as combined transport, railways and waterways;

    (Amendment 2)

    Whereas the current overall transport policy has not yet succeeded in creating the conditions for healthy competition between the various modes of transport, and whereas no financial equilibrium has yet been achieved within the railway companies,

    Whereas it is essential to provide for certain forms of aid relating to the operating costs of combined transport not only for third countries but also for Member States of the Union; whereas it is therefore necessary to develop a concept of aid to combined transport in favour of transit through the mountainous regions of Europe and to ensure that such a scheme will enter into force at the beginning of 1996;

    Whereas the new Member States deserve special attention as regards future aids for combined transport;

    Whereas Council Decision No. 75/327/EEC to which Article 4 of Regulation (EEC) 1107/70 refers was repealed by Council Directive No. 91/440/EEC of 29 July 1991 on the development of the Community's railways3 and that it is therefore advisable, accordingly, to delete Article 4,

    Whereas Council Decision No. 75/327/EEC to which Article 4 of Regulation (EEC) 1107/70 refers must be considered in connection with current political and economic realities; whereas combined transport and rail transport should not be put at a disadvantage;

    The European Parliament,

    - having regard to the Commission proposal to the Council, COM(95)0377 - 94/0204(SYN) ((OJ C 253, 29.9.1995, p. 22.)),

    - having been consulted by the Council pursuant to Articles 189c, 75(1) and 94 of the EC Treaty (C4-0390/95),

    - having regard to Rule 58 of its Rules of Procedure,

    - having regard to the report of the Committee on Transport and Tourism (A4- 0008/96),

    1. Approves the Commission proposal, subject to Parliament's amendments;

    2. Calls on the Commission to alter its proposal accordingly, pursuant to Article 189a(2) of the EC Treaty;

    3. Calls on the Council to incorporate Parliament's amendments in the common position that it adopts in accordance with Article 189c(a) of the EC Treaty;

    4. Calls for the conciliation procedure to be opened should the Council intend to depart from the text approved by Parliament;

    5. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

    6. Instructs its President to forward this opinion to the Council and Commission.
