COUNCIL DECISION (CFSP) 2024/747

of 23 February 2024

amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 17 March 2014, the Council adopted Decision 2014/145/CFSP (1).

In its conclusions of 14 and 15 December 2023, the European Council reiterated its resolute condemnation of Russia’s war of aggression against Ukraine, which constitutes a manifest violation of the Charter of the United Nations, and reaffirmed the Union’s unwavering support for Ukraine’s independence, sovereignty and territorial integrity within its internationally recognised borders and its inherent right of self-defence against Russia’s aggression. The European Council also stated that Russia’s ability to wage its war of aggression must be further weakened, including by further strengthening sanctions.

In view of the gravity of the situation, it is appropriate to adopt further restrictive measures.

In particular, the Council considers that 106 persons and 88 entities responsible for actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine should be added to the list of persons, entities and bodies subject to restrictive measures set out in the Annex to Decision 2014/145/CFSP.

(5)

Decision 2014/145/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 2014/145/CFSP is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

Globus develops and produces: Oka and Oka-E-1 complexes, designed to prepare for combat use, and to monitor the technical condition of, airborne guided weapons; automated control and test stations (ACIS) for monitoring the technical condition of Buk-M1, Buk-M2 and Buk-M1-2 air defence systems, Kashmir, Shtil and Shtil-1 naval air defence systems; and ACIS monitoring the technical condition of the S-300V, S-300VM air defence systems and automated systems monitoring the technical condition of the 3M-24 products and their modifications of the Uran-E complex and other military products. Those products are used by Russia in the war against Ukraine.

Therefore, Evgeniy Baikin, in his capacity as the General Director of JSC Globus, is supporting actions and policies which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine. He is also supporting materially and benefitting from the Government of the Russian Federation, which is responsible for the annexation of Crimea and the destabilisation of Ukraine.

Igor Krylov is the General Director of JSC Region, which is a leading Russian developer and supplier of guided bombs for front-line aviation. Moreover, JSC Region is a subsidiary of JSC Tactical Missile Armament Corporation which significantly contributes to enhancing Russia’s military and defence capabilities.

The company has a track record of implementing orders for the Ministry of Defence of the Russian Federation.

Aleksandr Livshits is the General Director of the Federal State Enterprise Kazan State-Owned Gunpowder Plant (FKP KGKPZ), which produces a variety of pyroxylin powders and charges for almost all types of weapons. FKP KGKPZ manufactures 5.45-14.5 mm caliber cartridges for rifles (Kalashnikov assault rifles), grenade launcher charges, propellant charges for naval cannons (AK-100, AK-130 and AK-726) and land artillery of 76 mm to 152 mm caliber (mortars 2S9 and 2S12, howitzers D-20, D-30, ML-20, 2S1, 2S3 and 2S19). The plant produces 115 mm, 122 mm and, most importantly, 125 mm caliber tank ammunition, which is used in the T-64, T-72, T-80 and T-90 tanks of the Russian Armed Forces. FKP KGKPZ supplies ammunition to the Russian Armed Forces and their weapon systems used in the war in Ukraine.

Therefore, Aleksandr Livshits, as the General Director of FKP KGKPZ, is supporting actions which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine.

Various models of BMP-2 infantry fighting vehicles and T-72 main battle tanks are used by the Russian army in the war of aggression against Ukraine. Valentina Lavrik is the so-called “Minister of Education, Science and Youth of the Republic of Crimea” since December 2019. In this role, she ultimately oversees the implementation of the system of militarisation of education for Ukrainian children in illegally annexed Crimea, as well as the suppression of Ukrainian language and culture for such children.

During Russia’s war of aggression against Ukraine since 2022, she has been responsible for coordinating and overseeing the transfer of children from the illegally occupied regions of Donetsk, Luhansk, Kherson and Zaporozhzhia into camps in Crimea. Some of the children who went to those camps with their parents’ consent were not allowed to return to Ukraine due to their pro-Ukrainian views.
