Framework Agreement between the EU and its Member States, on the one part, and Korea, on the other part

Decision 2013/40/EU — signing, on behalf of the European Union, and provisional application of the Framework Agreement between the EU and the EU countries, on the one part, and South Korea, on the other part, and the Republic of Korea, on the other part

Decision 2014/278/EU — conclusion of the Framework Agreement between the EU and the EU countries, on the one part, and South Korea, on the other part, with the exception of matters related to readmission

Decision 2014/279/EU — conclusion of the Framework Agreement between the EU and the EU countries, on the one part, and South Korea, on the other part, as regards matters related to readmission

WHAT IS THE AIM OF THE AGREEMENT AND THE DECISIONS?

  • The agreement provides a basis for strengthened economic and political cooperation between EU and South Korea with a number of aims including:
    • agreeing a future vision to strengthen the partnership and joint projects to implement the vision;
    • fostering economic cooperation in areas of mutual interest;
    • raising the roles and profiles of both parties in the other’s region;
  • Decision 2013/40/EU marks the signing of the agreement, while the decisions 2014/278/EU and 2014/279/EU conclude the agreement on behalf of the EU.
  • Decision 2014/279/EU exclusively relates to readmission i.e. the obligations and procedures for the authorities of South Korea and of EU countries as to when and how to take back people who are irregularly residing in their respective countries.

KEY POINTS

Cooperation between the EU and South Korea are based on several principles including including attachment to:

Areas of cooperation

The parties also agree to develop cooperation and dialogue in all areas of mutual interest but without particular focus on specific areas:

  • 1.

    Political dialogue and cooperation on issues such as:

    • human rights;
    • non-proliferation of weapons of mass destruction;
    • counter-terrorism; and
    • participation in regional and international organisations.
  • 2.

    Economic development on issues such as:

    • trade and investment-related areas of mutual interest;
    • economic cooperation;
    • taxation;
    • customs;
    • information society;
    • transport; and
    • energy.
  • 3.

    Sustainable development on issues such as:

    • health;
    • employment and social affair;
    • environment and climate change; and
    • agriculture and fisheries.
  • 4.

    Culture and education on issues such as:

    • audiovisual media; and
    • information and communication.
  • 5.

    Justice, freedom and security on issues such as:

    • personal data protection;
    • legal cooperation;
    • organised crime and corruption;
    • money laundering and terrorist financing; and
    • combating illicit drugs.
  • 6.

    Other areas such as:

    • tourism;
    • civil society; and
    • public administration.

Supervision

The agreement establishes a Joint Committee comprising representatives of the members of the Council of the EU and of the European Commission along with representatives of South Korea. It is tasked with ensuring that the agreement functions effectively.

DATE OF ENTRY INTO FORCE

The agreement entered into force on 1 June 2014.
