The applicant claims that the Court should:

annul the decision of 14 February 2023 and the decision of 14 September 2023;

order the defendant to pay compensation of EUR 60 000 to the applicant;

order the defendant to pay the costs.

Pleas in law and main arguments

In support of the action brought against Decision 2023-03 of Eurojust of 14 February 2023 closing, without taking any action, the administrative inquiry and rejecting the applicant’s request for assistance, the applicant relies on three pleas in law.

1.

First plea in law, alleging, first, a conflict of interest on the part of the representative of Eurojust in the defence before the Court, and, secondly, infringement of the principle of objective impartiality;

2.

Second plea in law, alleging the existence of numerous procedural irregularities;

3.

Third plea in law, alleging manifest errors of assessment of the concept of harassment in the conclusion that each of the behaviours established by the administrative inquiry was appropriate, justified and legitimate.
