Proposal for a Council Regulation (EC) adapting Regulation (EEC) No 404/93 as regards the volume of the annual quota for the import of bananas into the Community following the accession of Austria, Finland and Sweden

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 43 thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament,

Having regard to the opinion of the Economic and Social Committee,

Whereas Regulation (EEC) No 404/93 provides for the opening of an annual tariff quota for imports of third country bananas and non-traditional ACP bananas; whereas, following the accession of the Republic of Austria, the Kingdom of Sweden and the Republic of Finland to the European Union, account should be taken of the banana needs of these new Member States, which have been assessed as 353 000 tonnes on the basis of the net average quantities of bananas imported by those countries over the period 1991 to 1993, the last three years for which figures are available; whereas, therefore, a volume of the tariff quota provided for in Article 18 of Regulation (EEC) No 404/93 should be adjusted,

HAS ADOPTED THIS REGULATION:

Article 1

In the first subparagraph of Article 18 (1) of Regulation (EEC) No 404/93 '2 200 000 tonnes (net weight)` is hereby replaced by '2 553 000 tonnes (net weight)`.

Article 2

This Regulation shall apply from 1 January 1995.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
