COMMISSION OPINION

of 18 April 1990

concerning the facility for intermediate storage of spent fuel in Ahaus (Federal Republic of Germany)

The general data concerning the plan for the discharge of radioactive effluents from the facility for intermediate storage of spent fuel in Ahaus were provided by the German Government, in accordance with Article 37 of the Euratom Treaty, to the Commission by letter dated 18 October 1989, received 24 October 1989.

On the basis of the data thus obtained for this facility, which is located at some 14 km from the frontier with The Netherlands, and having consulted for group of experts, the Commission is of the opinion that the implementation of the plan is not liable, either in normal operation or in case of accident, to result in the radioactive contamination, significant from the point of view of health, of the water, soll or airspace of another Member State.

This opinion is addressed to the Federal Republic of Germany.
