KOMUNIKAZZJONI TAL-KUMMISSJONI LILL-KUNSILL U LILL-PARLAMENT EWROPEW

Ir-riżultat ta' l-eżami tal-proposti leġiżlattivi pendenti quddiem il-Leġiżlatur

Kif ħabbret fil-Komunikazzjoni tagħha tas-16 ta' Marzu 2005 dwar "Regolazzjoni aħjar għat-tkabbir ekonomiku u l-impjiegi fl-Unjoni Ewropea"[1], il-Kummissjoni ddeċidiet li tintroduċi bidla sinifikanti fil-mod kif tfittex li tiżgura li l-kwalità tal-leġiżlazzjoni Ewropea ġġib 'il quddiem il-miri ta' l-Assoċjazzjoni għat-Tkabbir Ekonomiku u l-Impjiegi.

Biex tittejjeb il-kompetittività Ewropea, jeħtieġ li l-ambjent regolatorju fl-Unjoni Ewropea jkun ta' l-ogħla standard possibbli. Biex din il-mira tintlaħaq, l- acquis communautaire , jiġifieri l-korp ta' liġijiet eżistenti, jeħtieġlu jiġi ssimplifikat fejn ikun hemm bżonn u aġġornat. Għadd ta' miżuri huma previsti għal dan il-għan, fosthom, b'mod partikolari, it-tnedija f'Ottubru ta' fażi ġdida tal-programm ta' Simplifikazzjoni.

Il-Kummissjoni ddeċidiet ukoll li r-regolazzjoni mtejba jeħtiġilha tkun integrata fid-disinn tal-politika, u li l-proposti leġiżlattivi ġodda mressqa mill-Kummissjoni jridu jfittxu li jippromwovu r-regolazzjoni aħjar u jikkontribwixxu għall-kompetittività. Dan jitwettaq fil-prattika partikolarment mir-rekwiżit li inizjattivi leġiżlattivi ġodda issa huma suġġetti għal evalwazzjoni ta' l-impatt, kif imħabbar fil-programm leġiżlattiv u ta' ħidma tal-Kummissjoni għall-2005, li għalih dan l-aħħar ġew adottati linji ta' gwida estensivi u dettaljati[2].

Rigward il-proposti mressqa mill-Kummissjoni fl-imgħoddi u li għadhom pendenti fil-proċess leġiżlattiv, il-Komunikazzjoni ta' Marzu stqarret ir-rieda tal-Kummissjoni li "teżamina l-proposti li għadhom pendenti quddiem il-Kunsill/Parlament rigward ir-rilevanza ġenerali tagħhom, l-impatt tagħhom fuq il-kompetittività u effetti oħra". Il-miri, il-proċess u r-riżultati ta' dan l-eżerċizzju ta' eżami, li qiegħed jitwettaq għall-ewwel darba, huma ppreżentati f'din il-Komunikazzjoni.

1. Il-miri ta' l-eżami tal-proposti pendenti

Il-mira ta' l-eżerċizzju ta' eżami kienet li l-Kummissjoni tiġi fil-qagħda li tkun tista' tiżgura li l-proposti leġiżlattivi pendenti kollha jkunu għal kollox konsistenti mal-prijoritajiet politiċi tagħha, u li tivverifika jekk, fid-dawl ta' ċirkustanzi mibdula, tkunx ġustifikata reviżjoni ta' l-istrateġija adottata fil-bidu.

Fejn intqies li reviżjoni kienet meħtieġa, l-eżerċizzju ta' eżami identifika wkoll il-miżuri li kienu l-aktar f'lokhom li jittieħdu, bħall-modifika, is-sostituzzjoni jew l-irtitrar ta' proposti pendenti u t-titjib ta' l-evalwazzjoni ta' l-impatti tagħhom.

Aktar speċifikament, l-eżerċizzju ta' eżami kellu l-għan li jittestja l-proposti pendenti minn tliet lati:

L-ewwelnett, il-proposti pendenti ġew eżaminati mil-lat tal-konsistenza tagħhom ma' l-għanijiet ta' Liżbona ta' l-UE, u partikolarment il-mira tal-promozzjoni tal-kompetittività. Il-kriterji li ntużaw fl-evalwazzjoni tal-proposti f'dan ir-rigward kienu dawk speċifikati fit-'test tal-kompetittività' li huwa parti mil-linji ta' gwida dwar l-evalwazzjonijiet ta' l-impatt[3], li ġew riveduti dan l-aħħar.

It-tieni, il-proposti pendenti ġew eżaminati rigward nuqqas possibbli ta' progress sostanzjali fil-proċess leġiżlattiv fuq medda sinifikanti ta' żmien. F'dawn il-każijiet, ġew investigati wkoll ir-raġunijiet għal dan il-pass kajman u l-possibilitajiet li din is-sitwazzjoni tingħeleb.

It-tielet, il-proposti pendenti ġew eżaminati biex jiġi ddeterminat jekk jissodisfawx ir-rekwiżiti kurrenti dwar regolazzjoni aħjar, partikolarment rigward l-evalwazzjonijiet xierqa ta' l-impatt tagħhom. Dan il-krietrju jaffettwa b'mod speċjali dawk il-proposti li ġew ippreżentati meta l-evalwazzjonijiet ta' l-impatt ma kenux rekwiżiti formali.

2. Il-proċess ta' l-eżerċizzju ta' eżami

Fit-tnedija ta' l-eżerċizzju ta' eżami f'April 2005, l-għadd totali ta' proposti pendenti kien 489[4]. L-ambitu ta' l-eżerċizzju definit fil-Komunikazzjoni ta' Marzu kien espliċitament limitat għal proposti pendenti li kienu jġibu data minn qabel l-1 ta' Jannar 2004. L-għadd ta' dawn il-proposti laħaq 183.

Dawn saritilhom evalwazzjoni attenta, li wasslet għall-identifikazzjoni ta' madwar 100 proposta li tassew jikkostitwixxu inizjattivi leġiżlattivi ġodda, u li ġew evalwati wkoll għal effetti negattivi possibbli fuq il-kompetittività u għal effetti ekonomiċi usa'. Il-bqija tal-proposti x'aktarx li jkollhom ftit li xejn impatt fuq il-kompetittività. Dawn għandhom x'jaqsmu ma' proposti li jirriżultaw minn obbligi internazzjonali jew li jikkostitwixxu adattamenti għall- acquis fid-dawl ta' avvanzi xjentifiċi u tekniċi. Xi wħud minn dawn il-proposti jikkontribwixxu direttament għar-"regolazzjoni aħjar", minħabba li jikkodifikaw jew jissimplifikaw l- acquis .

3. Ir-riżultati ta' l-eżerċizzju ta' eżami

Wara analiżi dettaljata tal-proposti pendenti kollha, il-Kummissjoni tipprevedi żewġ tipi wiesgħa ta' azzjoni.

(1) L-irtirar tal-proposti Il-Kummissjoni biħsiebha tirtira total ta' 68 proposta. Dawn il-proposti jitqiesu li mhumiex konsistenti ma' l-għanijiet ta' Liżbona jew mal-prinċipji tar-Regolazzjoni Aħjar, jew mhumiex qed jagħmlu biżżejjed progress fil-proċess leġiżlattiv, jew inkella ma għadhomx rilevanti[5] (pereżempju, l-għanijiet tagħhom diġà qed jintlaħqu b'mezzi oħra, jew inkella se jintlaħqu b'mezzi oħra). Uħud minn dawn il-proposti għandhom mnejn jiġu kkunsidrati mill-ġdid fid-dawl ta' aktar analiżi. F'ċerti każi, il-Kummissjoni biħsiebha tikkunsidra mill-ġdid il-ħtieġa għal intervent leġiżlattiv fid-dawl tar-riżultati ta' evalwazzjoni ta' l-impatt komprensiva.

(2) Iż-żamma ta' proposti fil-proċess leġiżlattiv, imma analiżi ekonomika biex titressaq għall-evalwazzjoni ta' l-awtorità leġiżlattiva[6]. Dan jirrigwarda 5 proposti li l-Kummissjoni hija konvinta mill-importanza kurrenti tagħhom, imma li preżentazzjoni aktar fil-fond ta' analiżi ta' l-impatt tagħhom x'aktarx li sservi biex tiffaċilita t-teħid ta' deċiżjonijiet mill-Awtorità Leġiżlattiva.

B'hekk, b'riżultat ta' l-eżami tal-Kummissjoni, total ta' 73 proposta pendenti se jkunu suġġetti għal xi forma ta' intervent. Dan ikopri proposti li ma jissodisfawx għal kollox ir-rekwiziti tal-kompetittività, dawk li jeħtieġu li titressaq aktar analiżi ekonomika għall-evalwazzjoni tal-Leġiżlatur, kif ukoll propopsti li mhumiex qed jagħmlu biżżejjed progress fil-proċess leġiżlattiv, jew li llum żmienhom għadda.

L-irtirar b'mod partikolari jirrappreżenta madwar 31%[7] tal-proposti kollha pendenti li ilhom minn qabel l-1 ta' Jannar 2004. L-interventi kollha, inklużi l-proposti li se ssirilhom aktar analiżi ekonomika, fil-fatt jirrappreżentaw 33%[8] ta'dawk il-proposti pendenti.

Barra minn hekk, għal talanqas 2 proposti, l-eżerċizzju ta' eżami ta riżultati li ma jaqgħux direttament fil-kategoriji msemmija hawn fuq. L-ewwelnett, rigward il-proposta għal Direttiva tal-Kunsill dwar ir-rekwiżiti minimi tas-saħħa u s-sikurezza rigward l-esponiment ta' ħaddiema għar-riskji minn aġenti fiżiċi - radjazzjonijiet ottiċi, 1992/0449/COD, li għaliha l-eżerċizzju ta' eżami wassal biex il-Kummissjoni tikkonkludi li l-aspetti li jitrattaw l-esponiment ta' ħaddiema għal radjazzjonijiet ottiċi naturali għandhom jitħassru, kif propost ukoll mill-Parlament Ewropew.

It-tieni, rigward il-proposta dwar il-Ħaddiema Temporanji (2002/0072/COD), il-Kummissjoni tirriserva l-pożizzjoni tagħha, sabiex tikkunsidra mill-ġdid il-proposta fid-dawl ta' diskussjonijiet fil-ġejjieni dwar proposti oħra.

L-Anness għal din il-Komunikazzjoni jagħti sunt ta' din il-qagħda kif ukoll dettalji dwar il-proposti kkonċernati.

Konklużjoni

L-eżerċizzju ta' eżami tal-proposti pendenti huwa l-ewwel eżami komprensiv li qatt wettqet il-Kummissjoni. Dan jagħti xhieda ta' l-impenn tal-Kummissjoni Ewropea favur l-Assoċjazzjoni għat-Tkabbir Ekonomiku u għall-Impjiegi, u favur l-iżgurar ta' l-implimentazzjoni prattika u rigoruża tal-prinċipji ta' Regolazzjoni Aħjar.

L-azzjonjiet li jirriżultaw mill-eżerċizzju ta' eżami, i.e. l-interventi previsti fuq il-proposti pendenti kif jidher fl-Anness, huma mfassla biex ikollhom effett pożittiv fuq l-ilħiq tal-Miri ta' Liżbona, permezz ta' l-appoġġ tal-kompetittività, għall-iżvilupp ta' ambjent leġiżlattiv aħjar u l-eliminazzjoni ta' proposti li jew ma għandhomx possibilità reali li jiġu adottati jew inkella li issa żmienhom għadda.

L-irtirar ta' proposti pendenti, f'xi każijiet, se jseħħ fil-qafas ta' reviżjoni kumplessiva ta' l-oqsma ta' politika jew bil-ħsieb li jitqiesu mill-ġdid proposti fid-dawl ta' elementi ġodda ta' politika u evalwazzjoni komprensiva ta' l-impatt. F'konformità mal-Ftehim ta' Qafas dwar ir-Relazzjonijiet bejn il-Parlament Ewropew u l-Kummissjoni (paragrafu 32), il-Kummissjoni b'dan qed tagħti notifika bil-quddiem lill-Parlament u lill-Kunsill qabel tirtira l-proposti tagħha.
