COUNCIL JOINT ACTION 2009/834/CFSP

of 10 November 2009

amending Joint Action 2001/555/CFSP on the establishment of a European Union Satellite Centre

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 14 thereof,

Whereas:

(1)

On 20 July 2001 the Council adopted Joint Action 2001/555/CFSP on the establishment of a European Union Satellite Centre (1).

(2)

On 3 September 2009 the Political and Security Committee (PSC) agreed that all members of the North Atlantic Treaty Organisation should be entitled to be involved in the Centre’s activities and that products of the Centre resulting from requests by the Council could be distributed to third States by decision of the PSC.

(3)

Joint Action 2001/555/CFSP should be amended accordingly,

HAS ADOPTED THIS JOINT ACTION:

Article 1

Joint Action 2001/555/CFSP is hereby amended as follows:

1.

in Article 5, the following paragraph shall be added:

‘4.   The Political and Security Committee may direct the Secretary-General/High Representative to make available products of the Centre resulting from requests made in accordance with Article 2(1) to any designated third State on a case-by-case basis.’;

2.

Article 21 shall be replaced by the following:

‘Article 21

Association of third States

Notwithstanding Article 5, non-EU NATO members and other States which are candidates for accession to the EU shall be entitled to be involved in the Centre’s activities in accordance with the Provisions set out in the Annex.’.

Article 2

This Joint Action shall enter into force on the day of its adoption.

Article 3

This Joint Action shall be published in the Official Journal of the European Union.
