DECISION OF THE EEA JOINT COMMITTEE

No 152/2007

of 7 December 2007

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 138/2007 of 26 October 2007 (1).

(2)

Commission Regulation (EC) No 538/2007 of 15 May 2007 concerning the authorisation of a new use of Enterococcus faecium DSM 7134 (Bonvital) as a feed additive (2) is to be incorporated into the Agreement.

(3)

Commission Regulation (EC) No 634/2007 of 7 June 2007 concerning the authorisation of selenomethionine produced by Saccharomyces cerevisiae NCYC R397 as a feed additive (3) is to be incorporated into the Agreement.

(4)

Decision No 623/2007/EC of the European Parliament and of the Council of 23 May 2007 amending Directive 2002/2/EC amending Council Directive 79/373/EEC on the circulation of compound feedingstuffs (4) is to be incorporated into the Agreement.

(5)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter II of Annex I to the Agreement shall be amended as follows:

1)

the following points shall be inserted after point 1zzzr (Commission Regulation (EC) No 537/2007):

‘1zzzs.

 32007 R 0538: Commission Regulation (EC) No 538/2007 of 15 May 2007 concerning the authorisation of a new use of Enterococcus faecium DSM 7134 (Bonvital) as a feed additive (OJ L 128, 16.5.2007, p. 16).

1zzzt.

 32007 R 0634: Commission Regulation (EC) No 634/2007 of 7 June 2007 concerning the authorisation of selenomethionine produced by Saccharomyces cerevisiae NCYC R397 as a feed additive (OJ L 146, 8.6.2007, p. 14).’;

2)

the following shall be added in the 16th indent (Directive 2002/2/EC of the European Parliament and of the Council) of point 5 (Council Directive 79/373/EEC):

‘, as amended by:

—

 32007 D 0623: Decision No 623/2007/EC of the European Parliament and of the Council of 23 May 2007 (OJ L 154, 14.6.2007, p. 23).’

Article 2

The texts of Regulations (EC) No 538/2007 and (EC) No 634/2007, and Decision No 623/2007/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
