DECISION OF THE EEA JOINT COMMITTEE

No 109/2006

of 22 September 2006

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 77/2006 of 7 July 2006 (1).

(2)

Commission Directive 2006/20/EC of 17 February 2006 amending, for the purposes of its adaptation to technical progress, Council Directive 70/221/EEC concerning fuel tanks and rear underrun protection of motor vehicles and their trailers (2) is to be incorporated into the Agreement.

(3)

Commission Directive 2006/28/EC of 6 March 2006 amending, for the purposes of their adaptation to technical progress, Council Directive 72/245/EEC of 20 June 1972 relating to the radio interference (electromagnetic compatibility) of vehicles and Council Directive 70/156/EEC on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (3) is to be incorporated into the Agreement.

(4)

Commission Directive 2006/27/EC of 3 March 2006 amending for the purposes of adapting to technical progress Council Directives 93/14/EEC on the braking of two- or three-wheel motor vehicles and 93/34/EEC on statutory markings for two- or three-wheel motor vehicles, Directives of the European Parliament and of the Council 95/1/EC on the maximum design speed, maximum torque and maximum net engine power of two- or three-wheel motor vehicles and 97/24/EC on certain components and characteristics of two- or three-wheel motor vehicles (4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows:

1.

The following indent shall be added in points 1 (Council Directive 70/156/EEC) and 11 (Council Directive 72/245/EEC):

‘—

32006 L 0028: Commission Directive 2006/28/EC of 6 March 2006 (OJ L 65, 7.3.2006, p. 27).’

2.

The following indent shall be added in point 4 (Council Directive 70/221/EEC):

‘—

32006 L 0020: Commission Directive 2006/20/EC of 17 February 2006 (OJ L 48, 18.2.2006, p. 16).’

3.

The following indent shall be added in points 45n (Council Directive 93/34/EEC), 45s (Directive 95/1/EC of the European Parliament and of the Council) and 45x (Directive 97/24/EC of the European Parliament and of the Council):

‘—

32006 L 0027: Commission Directive 2006/27/EC of 3 March 2006 (OJ L 66, 8.3.2006, p. 7).’

4.

The following shall be added in point 45h (Council Directive 93/14/EEC):

‘, as amended by:

32006 L 0027: Commission Directive 2006/27/EC of 3 March 2006 (OJ L 66, 8.3.2006, p. 7).’

Article 2

The texts of Directives 2006/20/EC, 2006/28/EC and 2006/27/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 23 September 2006, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
