DECISION OF THE EEA JOINT COMMITTEE

No 94/2004

of 9 July 2004

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 69/2004 of 8 June 2004 (1).

(2)

Commission Decision 2003/378/EC of 23 May 2003 amending Decision 2002/300/EC establishing the list of approved zones with regard to Bonamia ostreae and/or Marteilia refringens (2) is to be incorporated into the Agreement.

(3)

Commission Decision 2003/390/EC of 23 May 2003 establishing special conditions for placing on the market of aquaculture animals species considered not susceptible to certain diseases and the products thereof (3) is to be incorporated into the Agreement.

(4)

Commission Decision 2003/458/EC of 12 June 2003 amending Annexes I and II to Decision 2002/308/EC establishing lists of approved zones and approved farms with regard to one or more of the fish diseases viral haemorrhagic septicaemia (VHS) and infectious haematopoietic necrosis (IHN) (4) is to be incorporated into the Agreement.

Commission Decision 2003/466/EC of 13 June 2003 establishing criteria for zoning and official surveillance following suspicion or confirmation of the presence of infectious salmon anaemia (ISA) (5) is to be incorporated into the Agreement.

(6)

Commission Decision 2003/634/EC of 28 August 2003 approving programmes for the purpose of obtaining the status of approved zones and of approved farms in non-approved zones with regard to viral haemorrhagic septicaemia (VHS) and infectious haematopoietic necrosis (IHN) in fish (6) is to be incorporated into the Agreement.

Commission Decision 2003/729/EC of 6 October 2003 amending Decision 2002/300/EC establishing the list of approved zones with regard to Bonamia ostreae and/or Marteilia refringens (7) is to be incorporated into the Agreement.

(8)

Decision 2003/390/EC repeals Commission Decisions 93/22/EEC (8) and 93/55/EEC (9), which are incorporated into the Agreement and which are consequently to be deleted from the Agreement.

(9)

Decision 2003/634/EC repeals Commission Decision 2002/304/EC (10), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(10)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2003/378/EC, 2003/390/EC, 2003/458/EC, 2003/466/EC, 2003/634/EC and 2003/729/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 10 July 2004, provided that all the notifications under Article 103 (1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

ANNEX

to Decision of the EEA Joint Committee No 94/2004

Chapter I of Annex I to the Agreement shall be amended as specified below:

1.

The following point shall be inserted after point 28 (Commission Decision 2003/422/EC) in Part 3.2:

32003 D 0466: Commission Decision 2003/466/EC of 13 June 2003 establishing criteria for zoning and official surveillance following suspicion or confirmation of the presence of infectious salmon anaemia (ISA) (OJ L 156, 25.6.2003, p. 61).

This act applies also to Iceland.’

2.

The following shall be added in point 65 (Commission Decision 2002/300/EC) in Part 4.2:

‘, as amended by:

32003 D 0378: Commission Decision 2003/378/EC of 23 May 2003 (OL L 130, 27.5.2003, p. 27).

32003 D 0729: Commission Decision 2003/729/EC of 6 October 2003 (OJ L 262, 14.10.2003, p. 37).’

3.

The following indent shall be added in point 66 (Commission Decision 2002/308/EC) in Part 4.2:

32003 D 0458: Commission Decision 2003/458/EC of 12 June 2003 (OJ L 154, 21.6.2003, p. 93).’

4.

The following points shall be inserted after point 71 (Commission Decision 2003/644/EC) in Part 4.2:

32003 D 0390: Commission Decision 2003/390/EC of 23 May 2003 establishing special conditions for placing on the market of aquaculture animals species considered not susceptible to certain diseases and the products thereof (OJ L 135, 3.6.2003, p. 19).

This act applies also to Iceland.

5.

The text of points 8 (Commission Decision 93/22/EEC) and 15 (Commission Decision 93/55/EEC) in Part 4.2 shall be deleted.

6.

Under the heading ‘ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT’, the following point shall be inserted after point 54 (Commission Decision 2002/907/EC) in Part 4.2:

32003 D 0634: Commission Decision 2003/634/EC of 28 August 2003 approving programmes for the purpose of obtaining the status of approved zones and of approved farms in non-approved zones with regard to viral haemorrhagic septicaemia (VHS) and infectious haematopoietic necrosis (IHN) in fish (OJ L 220, 3.9.2003, p. 8).

This act applies also to Iceland.’

7.

Under the heading ‘ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT’, the text of point 52 (Commission Decision 2002/304/EC) in Part 4.2 shall be deleted.
