DECISION OF THE EEA JOINT COMMITTEE

No 215/2014

of 24 October 2014

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2015/1439]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) No 202/2014 of 3 March 2014 amending Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food (1) is to be incorporated into the EEA Agreement.

(2)

Commission Regulation (EU) No 212/2014 of 6 March 2014 amending Regulation (EC) No 1881/2006 as regards maximum levels of the contaminant citrinin in food supplements based on rice fermented with red yeast Monascus purpureus (2) is to be incorporated into the EEA Agreement.

(3)

Commission Regulation (EU) No 246/2014 of 13 March 2014 amending Annex I to Regulation (EC) No 1334/2008 of the European Parliament and of the Council as regards removal from the Union list of certain flavouring substances (3) is to be incorporated into the EEA Agreement.

(4)

Commission Regulation (EU) No 298/2014 of 21 March 2014 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council and the Annex to Commission Regulation (EU) No 231/2012 as regards Magnesium dihydrogen diphosphate for use as raising agent and acidity regulator (4) is to be incorporated into the EEA Agreement.

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

(1)

the following indent is added in point 54zzzz (Commission Regulation (EC) No 1881/2006):

‘—

32014 R 0212: Commission Regulation (EU) No 212/2014 of 6 March 2014 (OJ L 67, 7.3.2014, p. 3).’;

(2)

the following indent is added in points 54zzzzr (Regulation (EC) No 1333/2008 of the European Parliament and of the Council) and 69 (Commission Regulation (EU) No 231/2012):

‘—

32014 R 0298: Commission Regulation (EU) No 298/2014 of 21 March 2014 (OJ L 89, 25.3.2014, p. 36).’;

(3)

the following indent is added in point 54zzzzs (Regulation (EC) No 1334/2008 of the European Parliament and of the Council):

‘—

32014 R 0246: Commission Regulation (EU) No 246/2014 of 13 March 2014 (OJ L 74, 14.3.2014, p. 58).’;

(4)

the following indent is added in point 55 (Commission Regulation (EU) No 10/2011):

‘—

32014 R 0202: Commission Regulation (EU) No 202/2014 of 3 March 2014 (OJ L 62, 4.3.2014, p. 13).’.

Article 2

The texts of Regulations (EU) No 202/2014, (EU) No 212/2014, (EU) No 246/2014 and (EU) No 298/2014 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 1 November 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
