DECISION OF THE EEA JOINT COMMITTEE

No 103/2013

of 14 June 2013

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) No 1064/2012 of 13 November 2012 amending Annex X to Regulation (EC) No 999/2001 of the European Parliament and of the Council as regards the list of rapid tests (1) is to be incorporated into the EEA Agreement.

(2)

Commission Regulation (EU) No 1190/2012 of 12 December 2012 concerning a Union target for the reduction of Salmonella Enteritidis and Salmonella Typhimurium in flocks of turkeys, as provided for in Regulation (EC) No 2160/2003 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Decision 2012/762/EU of 6 December 2012 amending Decision 2009/821/EC as regards the lists of border inspection posts and veterinary units in Traces (3) is to be incorporated into the EEA Agreement.

(4)

Commission Implementing Decision 2012/786/EU of 13 December 2012 amending Decision 2010/221/EU as regards national measures for preventing the introduction of certain aquatic animal diseases into parts of Ireland, Finland and the United Kingdom (4) is to be incorporated into the EEA Agreement.

(5)

Regulation (EU) No 1190/2012 repeals Commission Regulation (EC) No 584/2008 (5), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(6)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement shall be amended as follows:

(1)

the following indent is added in point 39 (Commission Decision 2009/821/EC) in Part 1.2:

‘—

32012 D 0762: Commission Implementing Decision 2012/762/EU of 6 December 2012 (OJ L 336, 8.12.2012, p. 94).’;

(2)

the following indent is added in point 94 (Commission Decision 2010/221/EU) in Part 4.2:

‘—

32012 D 0786: Commission Implementing Decision 2012/786/EU of 13 December 2012 (OJ L 347, 15.12.2012, p. 36).’;

(3)

the following indent is added in point 12 (Regulation (EC) No 999/2001 of the European Parliament and of the Council) in Part 7.1:

‘—

32012 R 1064: Commission Regulation (EU) No 1064/2012 of 13 November 2012 (OJ L 314, 14.11.2012, p. 13).’;

(4)

the text of point 51 (Commission Regulation (EC) No 584/2008) in Part 7.2 is replaced by the following:

32012 R 1190: Commission Regulation (EU) No 1190/2012 of 12 December 2012 concerning a Union target for the reduction of Salmonella Enteritidis and Salmonella Typhimurium in flocks of turkeys, as provided for in Regulation (EC) No 2160/2003 of the European Parliament and of the Council (OJ L 340, 13.12.2012, p. 29).’

Article 2

The texts of Regulations (EU) No 1064/2012 and (EU) No 1190/2012 and Implementing Decisions 2012/762/EU and 2012/786/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 15 June 2013, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
