    DECISION OF THE EEA JOINT COMMITTEE

    No 3/2011

    of 11 February 2011

    amending Annex XIV (Competition) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex XIV to the Agreement was amended by Decision of the EEA Joint Committee No 130/2010 of 10 December 2010 (1).

    (2)

    Commission Regulation (EU) No 1217/2010 of 14 December 2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to certain categories of research and development agreements (2) is to be incorporated into the Agreement.

    (3)

    Commission Regulation (EU) No 1218/2010 of 14 December 2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to certain categories of specialisation agreements (3) is to be incorporated into the Agreement.

    (4)

    Commission Regulations (EC) No 2658/2000 (4) and (EC) No 2659/2000 (5), which have been incorporated into the Agreement, expired on 31 December 2010 and are therefore to be repealed under the Agreement,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Annex XIV to the Agreement shall be amended as follows:

    1.

    the text of point 6 (Commission Regulation (EC) No 2658/2000) shall be replaced by the following:

    ‘ 32010 R 1218: Commission Regulation (EU) No 1218/2010 of 14 December 2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to certain categories of specialisation agreements (OJ L 335, 18.12.2010, p. 43).’;

    2.

    the text of point 7 (Commission Regulation (EC) No 2659/2000) shall be replaced by the following:

    ‘ 32010 R 1217: Commission Regulation (EU) No 1217/2010 of 14 December 2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to certain categories of research and development agreements (OJ L 335, 18.12.2010, p. 36).’.

    Article 2

    The texts of Regulations (EU) No 1217/2010 and (EU) No 1218/2010 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 12 February 2011, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1). It shall apply from 1 January 2011.

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
