DECISION OF THE EEA JOINT COMMITTEE

No 60/2010

of 11 June 2010

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 38/2010 of 30 April 2010 (1).

(2)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 42/2010 of 30 April 2010 (2).

(3)

Commission Regulation (EC) No 202/2008 of 4 March 2008 amending Regulation (EC) No 178/2002 of the European Parliament and of the Council as regards the number and names of the Scientific Panels of the European Food Safety Authority (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 669/2009 of 24 July 2009 implementing Regulation (EC) No 882/2004 of the European Parliament and of the Council as regards the increased level of official controls on imports of certain feed and food of non-animal origin and amending Decision 2006/504/EC (4) is to be incorporated into the Agreement.

Commission Decision 2008/47/EC of 20 December 2007 approving the pre-export checks carried out by the United States of America on peanuts and derived products thereof as regards the presence of aflatoxins (5) is to be incorporated into the Agreement.

(6)

Council Decision 2008/486/EC of 23 June 2008 appointing half of the members of the Management Board of the European Food Safety Authority (6) is to be incorporated into the Agreement.

(7)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Annex I to the Agreement shall be amended as follows:

1.

the following indent shall be added in point 13 (Regulation (EC) No 178/2002 of the European Parliament and of the Council) of Part 7.1 of Chapter I and in point 41 (Regulation (EC) No 178/2002 of the European Parliament and of the Council) of Chapter II:

‘—

32008 R 0202: Commission Regulation (EC) No 202/2008 of 4 March 2008 (OJ L 60, 5.3.2008, p. 17).’;

2.

the following point shall be inserted after point 49 (Commission Decision 2007/453/EC) of Part 7.2 of Chapter I:

‘50.

32008 D 0486: Council Decision 2008/486/EC of 23 June 2008 appointing half of the members of the Management Board of the European Food Safety Authority (OJ L 165, 26.6.2008, p. 8).’;

3.

the following points shall be inserted after point 45 (Council Decision 2006/478/EC of 19 June 2006) of Chapter II:

32008 D 0486: Council Decision 2008/486/EC of 23 June 2008 appointing half of the members of the Management Board of the European Food Safety Authority (OJ L 165, 26.6.2008, p. 8).

32009 R 0669: Commission Regulation (EC) No 669/2009 of 24 July 2009 implementing Regulation (EC) No 882/2004 of the European Parliament and of the Council as regards the increased level of official controls on imports of certain feed and food of non-animal origin and amending Decision 2006/504/EC (OJ L 194, 25.7.2009, p. 11).’.

Article 2

Chapter XII of Annex II to the Agreement shall be amended as follows:

1.

the following indent shall be added in point 54zzzc (Regulation (EC) No 178/2002 of the European Parliament and of the Council):

‘—

32008 R 0202: Commission Regulation (EC) No 202/2008 of 4 March 2008 (OJ L 60, 5.3.2008, p. 17).’;

2.

the following points shall be inserted after point 54zzzzl (Commission Regulation (EC) No 953/2009):

32008 D 0047: Commission Decision 2008/47/EC of 20 December 2007 approving the pre-export checks carried out by the United States of America on peanuts and derived products thereof as regards the presence of aflatoxins (OJ L 11, 15.1.2008, p. 12).

Article 3

The texts of Regulations (EC) No 202/2008 and (EC) No 669/2009 and Decisions 2008/47/EC and 2008/486/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 12 June 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
