Decision of the EEA Joint Committee

No 165/2002

of 6 December 2002

amending Annex IX (Financial services) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex IX to the Agreement was amended by Decision of the EEA Joint Committee No 103/2002 of 12 July 2002(1).

(2) Directive 2002/12/EC of the European Parliament and of the Council of 5 March 2002 amending Council Directive 79/267/EEC as regards the solvency margin requirements for life assurance undertakings(2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex IX to the Agreement shall be amended as follows.

1. The following indent shall be added in point 11 (Council Directive 79/267/EEC):

"- 32002 L 0012: Directive 2002/12/EC of the European Parliament and of the Council of 5 March 2002 (OJ L 77, 20.3.2002, p. 11)."

2. The adaptations in point 11 (Council Directive 79/267/EEC) shall be amended as follows:

(a) the text of adaptation (a) and the first, second and sixth indent of adaptation (b) shall be deleted;

(b) the following adaptation shall be inserted after adaptation (f):

"(g) in Article 20a, the words 'European index of consumer prices comprising all Member States' shall be replaced with the words 'EEA index of consumer prices comprising all Contracting Parties'."

3. The text of adaptations (a) and (b) in point 12a (Council Directive 92/96/EEC) shall be deleted.

Article 2

The text of Directive 2002/12/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 7 December 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
