of 2 September 2011

partially suspending the application of the Cooperation Agreement between the European Economic Community and the Syrian Arab Republic

(2011/523/EU)



Article 1

Articles 12, 14 and 15 of the Cooperation Agreement between the European Economic Community and the Syrian Arab Republic are suspended in so far as the measures listed in the Annex to this Decision are concerned.

Article 2

This Decision shall be notified to the Syrian Arab Republic.

Article 3

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.




ANNEX

List of measures referred to in Article 1

(1) 

The importation of crude oil and petroleum products into the Union if they:

(a) 

originate in Syria; or

(b) 

have been exported from Syria;

(2) 

The purchase of crude oil or petroleum products which are located in or which originated in Syria;

(3) 

The transportation of crude oil or petroleum products if they originate in Syria, or are being exported from Syria to any other country;

(4) 

The provision, directly or indirectly, financing or financial assistance, including financial derivatives , as well as insurance and re-insurance, related to points (1), (2) and (3); and

(5) 

The participation, knowing and intentional, in activities whose object or effect is, directly or indirectly, to circumvent the prohibitions set out in point (1), (2), (3) or (4);

(6) 

The sale, supply, transfer or export, directly or indirectly, of gold, precious metals and diamonds, as listed below, whether or not originating in the Union, to the Government of Syria, its public bodies, corporations and agencies, the Central Bank of Syria, any person, entity or body acting on their behalf or at their direction, or any entity or body owned or controlled by them;

(7) 

The purchase, import or transport, directly or indirectly, of gold, precious metals and diamonds, as listed below, whether the item concerned originates in Syria or not, from the Government of Syria, its public bodies, corporations and agencies, the Central Bank of Syria and any person, entity or body acting on their behalf or at their direction, or any entity or body owned or controlled by them; and

(8) 

The provision, directly or indirectly, technical assistance or brokering services, financing or financial assistance, related to the goods referred to in points (6) and (7), to the Government of Syria, its public bodies, corporations and agencies, the Central Bank of Syria and any person, entity or body acting on their behalf or at their direction, or any entity or body owned or controlled by them.

The gold, precious metals and diamonds referred to in this Annex are:

Waste and scrap of precious metal or of metal clad with precious metal; other waste and scrap containing precious metal or precious-metal compounds, of a kind used principally for the recovery of precious metal.
