KOMMISSIONENS FÖRORDNING (EG) nr 1054/95 av den 11 maj 1995 om ändring av förordning (EEG) nr 2783/87 om särskilda tillämpningsföreskrifter för systemet med exportbidrag för spannmål som exporteras i form av pastaprodukter som hänförs till KN-nummer 1902 11 00 och 1902 19 i Kombinerade nomenklaturen

EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DENNA FÖRORDNING

med beaktande av Fördraget om upprättandet av Europeiska gemenskapen,

med beaktande av rådets förordning (EG) nr 3448/93 (1) av den 6 december 1993 om systemet för handeln med vissa varor som framställs genom bearbetning av jordbruksprodukter, särskilt artikel 8.3 i denna, och

med beaktande av följande:

Bestämmelser bör antas som föreskriver att pastaprodukter som hänför sig till KN-nummer 1902 11 00 och 1902 19 och som exporteras till USA skall åtföljas antingen av ett intyg som anger att de exporteras efter aktiv förädling, eller ett intyg som anger om de skall omfattas eller inte omfattas av den bidragssats som vid export till USA är tillämplig för de spannmålsproduker som använts för pastaproduktens framställning.

Det är lämpligt att uppdatera benämningen på den enhet vid kommissionen dit medlemsstaterna skall överlämna statistik information rörande kvantiteter av pastaprodukter.

De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från Förvaltningskommittén för övergripande frågor rörande handeln med förädlade jordbruksprodukter som inte omfattas av bilaga II.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

Artikel 1

Kommissionens förordning (EEG) nr 2723/87 (2) ändras på följande sätt:

1. I artikel 2.1 skall meningen "Certificate for the export with refund of pasta to the USA" ersättas med "Certificate for the export of pasta to the USA".

2. Artikel 4.2 skall ersättas med följande:

"2. Den behöriga myndigheten skall i ruta 10 på originalet och på kopiorna av 'certificate P2`, bocka för lämpligt stycke beroende på om varorna är berättigade till exportbidrag eller inte.

Det tullkontor som anges i artikel 3.2 skall kontrollera att dokumentet är vederbörligt ifyllt och sätta sin stämpel i ruta 10 på originalet och på kopiorna av 'certificate P2`."

3. Artikel 6 skall ersättas med följande:

"Artikel 6

De behöriga myndigheterna i medlemsstaterna skall till kommissionen senast den sista i varje månad lämna statistik rörande de kvantiteter pastaprodukter, fördelade på KN-nummer i gemensamma tulltaxan och med angivande av vilka kvantiteter som är berättigade till exportbidrag och vilka som inte är det, för vilka intyget 'certificate P2` har stämplats under föregående månad av de tullkontor där exportdeklarationen godkänts. Denna statistik skall sändas till:

4. Bilaga I skall ersättas med bilagan i denna förordning.

Artikel 2

Denna förordning träder i kraft den sjunde dagen efter det att den har offentliggjorts i Europeiska gemenskapernas officiella tidning.

Den är tillämplig för sådan export där exportdeklarationen godkänns av tullmyndigheterna från och med den 1 juli 1995.

Denna förordning är till alla delar bindande och direkt tillämplig i alla medlemsstater.
