KOMMISSIONENS FÖRORDNING (EEG) nr 2723/87 av den 10 september 1987 om fastställande av särskilda tillämpningsföreskrifter för systemet med exportbidrag för spannmål som exporteras i form av pastaprodukter som hänförs till nummer 19.03 i Gemensamma tulltaxan

EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DENNA FÖRORDNING

med beaktande av Fördraget om upprättandet av Europeiska ekonomiska gemenskapen,

med beaktande av rådets förordning (EEG) nr 2727/75 av den 29 oktober 1975 om den gemensamma organisationen av marknaden för spannmål (), senast ändrad genom förordning (EEG) nr 1900/87 (), särskilt artiklarna 16.6 och 24 i denna,

med beaktande av rådets förordning (EEG) nr 2746/75 av den 29 oktober 1975 om fastställande av allmänna bestämmelser om beviljande av exportbidrag för spannmål och kriterier för fastställande av bidragsbeloppet (), särskilt artikel 8.2 andra stycket och 8.3 i denna, och

med beaktande av följande:

I kommissionens förordning (EEG) nr 2730/79 (), senast ändrad genom förordning (EEG) nr 1180/87 (), fastställs gemensamma tillämpningsföreskrifter för systemet med exportbidrag för jordbruksprodukter.

I artikel 4.7 i rådets förordning (EEG) nr 3035/80 () av den 11 november 1980, senast ändrad genom förordning (EEG) nr 2223/86 (), föreskrivs att exportbidraget för varor som hänförs till nummer 19.03 i Gemensamma tulltaxan får differentieras beroende på destinationsort.

Inom ramen för den gemensamma handelspolitiken har en sådan differentiering fastställts med verkan från och med den 1 oktober 1987 för export av nämnda varor till USA.

I artikel 21 i förordning (EEG) nr 2730/79 fastställs att den del av bidraget som utbetalas så snart produkten har lämnat gemenskapens geografiska territorium, skall beräknas på grundval av den lägsta bidragssatsen. Denna bestämmelse kan hindra export av pastaprodukter som hänförs till nummer 19.03 i Gemensamma tulltaxan till andra destinationsorter än USA. Ett undantag bör därför göras från denna regel.

Begreppet lägsta bidragssats förekommer även i rådets förordning (EEG) nr 565/80 ().

Det är därför nödvändigt att fastställa tillämpningsföreskrifter för bidragssystemet för att undvika att de administrativa kontrollformaliteterna blir onödigt betungande. Undantag bör därför göras från vissa av de närmare bestämmelser som fastställs i förordning (EEG) nr 2730/79.

Till följd av de beslut som fattats inom ramen för den gemensamma handelspolitiken, bör det föreskrivas att pastaprodukter som hänförs till nummer 19.03 i Gemensamma tulltaxan och som exporteras till USA åtföljs antingen av ett intyg som anger att de exporteras efter aktiv förädling, eller ett intyg som anger att de omfattas av en bidragssats som vad avser export till USA är tillämplig för de spannmålsbasprodukter som används när de framställs. De nämnda pastaprodukterna kan ha framställts av spannmålsbasprodukter av vilka vissa har varit föremål för aktiva förädlingsåtgärder och vissa har befunnit sig i en av de situationer som anges i artikel 9.2 i fördraget. Det bör därför fastställas att en och samma kvantitet pastaprodukter som exporteras till USA endast får åtföljas av ett av de nämnda intygen.

För att systemet skall förvaltas på ett riktigt sätt skall de behöriga myndigheterna i medlemsstaterna till kommissionen överlämna nödvändig statistisk information.

De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från Förvaltningskommittén för spannmål.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

Artikel 1

1. När varor som hänförs till nummer 19.03 i Gemensamma tulltaxan exporteras till en annan destinationsort än USA, skall det särskilda bidrag som fastställs för export till USA av spannmål i form av varor som hänförs till nummer 19.03 i Gemensamma tulltaxan, inte beaktas

P när den lägsta bidragssatsen enligt artikel 21 i förordning (EEG) nr 2730/79 bestäms,

P vid tillämpningen av artiklarna 4.7 och 5.3 i förordning (EEG) nr 565/80.

2. När spannmålsprodukter som befinner sig i en av de situationer som anges i artikel 9.2 i fördraget används för framställning av varor som hänförs till nummer 19.03 i Gemensamma tulltaxan, i vilka det även ingår vissa kvantiteter spannmål som omfattas av förfarandet för aktiv förädling, ger export av nämnda varor till USA inte rätt till exportbidrag för nämnda produkter.

Artikel 2

1. Vid export till USA av varor som hänförs till nummer 19.03 i Gemensamma tulltaxan, skall de behöriga myndigheterna i de medlemsstater där tullmyndigheterna godkänner exportdeklarationen, på begäran av berörda parter, utfärda ett "Certificate for the export with refund of pasta to the USA", nedan kallat certificate P 2.

2. Certificate P 2, som skall utgöras av ett original och tre kopior, skall utarbetas enligt den modell som finns i bilaga 1 och uppfylla de tekniska krav som fastställs i bilaga 2.

Artikel 3

1. Certificate P 2 och kopiorna av detta skall utfärdas av det utfärdande organ som varje medlemsstat utser. Varje utfärdat intyg skall identifieras med ett löpnummer som det tilldelas av det utfärdande organet. Kopiorna skall vara försedda med samma löpnummer som originalet.

2. Det utfärdande organet skall behålla kopia nr 3 och överlämna originalet och de två andra kopiorna, försedda med organets stämpel i fält 9 som framgår av modellen i bilaga 1, till exportören, som skall överlämna dem till tullkontoret i gemenskapen vid godkännandet av deklarationen om export till USA.

Artikel 4

1. Vid tillämpningen av denna förordning skall det i det dokument som avses i artikel 4.3 i förordning (EEG) nr 2730/79 utöver de upplysningar som föreskrivs i nämnda artikel, anges löpnummer och det datum då certificate P 2 utfärdades.

2. Det tullkontor som anges i artikel 3.2 skall kontrollera att dokumentet är i behörig ordning ifyllt och i fält 10 stämpla originalet och kopiorna av certificate P 2, som framgår av modellen i bilaga 1.

3. I det fall som anges i artikel 1.2, skall det tullkontor som anges i artikel 3.2 inte stämpla certificate P 2.

4. Tullkontoret skall överlämna certificate P 2 och kopia nr 1 av detta till den berörda parten. Tullkontoret skall behålla kopia nr 2.

Artikel 5

Vid export till USA skall det utbetalande organet utbetala exportbidraget när de allmänna villkor som fastställts i gemenskapsreglerna är uppfyllda och när dessutom det i behörig ordning ifyllda dokument som anges i artikel 4.1 samt det original av certificate P 2 som stämplats av det tullkontor som anges i artikel 3.2 överlämnas.

Artikel 6

Medlemsstaternas behöriga myndigheter skall senast vid utgången av varje månad, till kommissionen överlämna den statistiska information om de kvantiteter pastaprodukter efter undernummer i tulltaxan för vilka intyg har stämplats under föregående månad av de tullkontor där exportdeklarationerna har godkänts, till följande adress:

Artikel 7

Denna förordning träder i kraft den tredje dagen efter det att den har offentliggjorts i Europeiska gemenskapernas officiella tidning.

Den skall tillämpas för export för vilken tullmyndigheterna godkänner exportdeklarationen från och med den 1 oktober 1987.

Denna förordning är till alla delar bindande och direkt tillämplig i alla medlemsstater.

BILAGA 2

Bestämmelser för det intyg som anges i artikel 2.2

1. Det formulär på vilket "Certificate for the export with refund of pasta to the USA" utfärdas skall tryckas på vitt papper, fritt från mekanisk pappersmassa, som väger mellan 40 och 65 gram/m2. Det får även tryckas på självkopierande papper med samma egenskaper.

2. Formulärens format skall vara 210 × 297 mm (A4).

3. Medlemsstaterna skall trycka eller låta trycka formulären.

4. Medlemsstaterna får kräva att det intyg som används inom deras territorium utfärdas på något av deras officiella språk utöver den engelska texten.

5. Originalet och kopiorna skall ifyllas med skrivmaskin eller för hand. I det sistnämnda fallet skall bläck användas och bokstäverna textas.
