concerning the denaturing premium certificates for sugar issued under Regulation (EEC) No 1574/72

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economie Community ;

Having regard to Council Regulation No 1009/67/EEC [1] of 18 December 1967 on the common organization of the market in sugar, as last amended by Regulation (EEC) No 1014/73 [2], and in particular Article 9 (8) ;

Whereas Commission Regulation (EEC) No 1574/72 [3] of 24 July 1972 fixing the denaturing premium for sugar intended for animal feed, as amended by Regulation (EEC) No 2351/72 [4], enabled Member States to issue denaturing premium certificates with a period of validity restricted to 30 September 1973 ; whereas the amending Regulation aforesaid gave further details of the sugar denaturing process originally provided for and enabled holders of certificates to apply, until 31 December 1972, for the cancellation of these certificates ;

Whereas a number of the premium certificates issued in certain Member States are still valid and have not been used, and whereas they concern a considerable quantity of sugar which is to be denatured before 30 September 1973 ; whereas most final users of sugar for denaturing were not able, before 31 December 1972, to appraise the true scope and practical implications of the additional details added to the denaturing process by Community instruments, and whereas they find it very difficult to use the sugar for denaturing in this way; whereas it is thus now found that many denaturers who hold premium certificates no longer are able to use them; whereas it would therefore be fair to give holders of premium certificates, on application, a chance to have them cancelled before 31 July 1973 ;

Whereas the measures provided for in this Regulation are in accordance with the Opinion of the Management Committee for Sugar ;

HAS ADOPTED THIS REGULATION :

Article 1

1. Denaturing premium certificates issued pursuant to Regulation (EEC) No 1574/72 which are still valid as regards all or part of the initial quantity of sugar concerned shall be cancelled on application from the titular holder or the transferee, as the case may be, if such application is made before 31 July 1973.

2. The denaturing security shall be released, in respect of the quantity of sugar affected, immediately after the cancellation of the certificate.

Article 2

Article 3 of Regulation (EEC) No 2351/72 is repealed.

Article 3

This Regulation shall enter into force on the day of its publication in the Officiai Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
