KOMMISSIONENS DIREKTIV 2009/2/EG
av den 15 januari 2009
om ändring, för anpassning till tekniska framsteg för trettioförsta gången, av rådets direktiv 67/548/EEG om tillnärmning av lagar och andra författningar om klassificering, förpackning och märkning av farliga ämnen

EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DETTA DIREKTIV
med beaktande av fördraget om upprättandet av Europeiska gemenskapen,
med beaktande av rådets direktiv 67/548/EEG av den 27 juni 1967 om tillnärmning av lagar och andra författningar om klassificering, förpackning och märkning av farliga ämnen (1), särskilt artikel 28, och
av följande skäl:

I artikel 4.3 i direktiv 67/548/EEG fastställs kriterierna och förfarandet för harmonisering av klassificering och märkning av ämnen. Enligt punkterna 4.1.3, 4.1.4 och 4.1.5 i bilaga VI till direktiv 67/548/EEG måste industrin lämna information till medlemsstaterna, som i sin tur snarast möjligt måste lägga fram förslag till harmoniserad klassificering och märkning, när information framkommer som styrker att ett ämne uppfyller kriterierna för mutagena, cancerframkallande eller reproduktionstoxiska ämnen. |

Bilaga I till direktiv 67/548/EEG innehåller en förteckning över farliga ämnen samt uppgifter om klassificering och märkning av respektive ämne. Förteckningen behöver uppdateras genom införande av nya ämnen som anmälts och av ytterligare existerande ämnen. Vidare måste vissa poster anpassas till de tekniska framstegen. Det är också nödvändigt att ta bort poster med vissa ämnen ur nämnda bilaga. |

Bilaga I till direktiv 67/548/EEG innehåller redan flera ämnesgrupper, framför allt när det gäller metallföreningar, som utvärderats genom jämförelser mellan strukturlika ämnen. |
(4) |
Bilaga I till direktiv 67/548/EEG innehåller också vissa grupper vars ämnen identifieras och där klassificeringen gjorts genom jämförelser mellan strukturlika ämnen, framför allt petroleumströmmar och petroleumgaser. |
(5) |
I bilaga VI till direktiv 67/548/EEG fastställs att de uppgifter som krävs för klassificering och märkning kan erhållas från olika källor, bland annat resultaten av validerade struktur-aktivitetssamband och expertbedömningar. |
(6) |
Klassificeringarna av de nickelföreningar som förtecknas i direktivet grundas på effekterna av nickel(II)joner och på tillgängliga data för nickelföreningar. Klassificeringarna är härledda genom en indelning av nickelföreningarna i kategorier på grundval av vattenlöslighet (t.ex. olösliga, måttligt lösliga och lösliga nickelföreningar). Vattenlöslighet användes som ett primärt kriterium vid definitionen av dessa kategorier med stöd av argumentet att nickelföreningar med liknande vattenlöslighet uppvisar liknande biotillgänglighet för nickel(II)jonen och liknande systemisk toxicitet. Detta motiverar att man överför testresultaten inom grupper, från de ämnen för vilka tillgängliga relevanta testdata visar en specifik systemisk effekt till ämnen för vilka det inte finns sådana testdata. När det gäller vissa effekter är det motiverat att överföra testresultaten mellan grupper, eftersom liknande effekter har observerats hos ämnen med olika vattenlöslighet. Epidemiologiska undersökningar visar till exempel att både lösliga och olösliga nickelföreningar (som ligger i varsin ände av löslighetsskalan) har lokala cancerframkallande effekter på andningsvägarna. Det finns därför goda skäl för slutsatsen att måttligt lösliga föreningar (i mitten på löslighetsskalan) har liknande cancerframkallande egenskaper. |

Vid en utvärdering av all tillgänglig information om nickelföreningarna kan vattenlösligheten användas för en approximering av nickel(II)jonens systemiska biotillgänglighet beträffande många effekter och ämnen. |

Klassificeringen och märkningen av de ämnen som förtecknas i direktivet bör ses över om ny vetenskaplig kunskap framkommer. Därvid bör, särskilt med hänsyn till att nickelbranschen nyligen har överlämnat preliminära, ofullständiga och ej expertbedömda uppgifter, särskild uppmärksamhet ägnas resultaten av de kommande diskussionerna om nickelföreningars cancerframkallande egenskaper i Världshälsoorganisationens internationella centrum för cancerforskning (IARC) liksom eventuella nya relevanta vetenskapliga rön eller tolkningar av de data som använts för att fastställa de klassificeringar av nickelföreningar som ingår i detta direktiv. |

De åtgärder som föreskrivs i detta direktiv är förenliga med yttrandet från kommittén för anpassning till tekniska framsteg av direktiv som syftar till att undanröja tekniska handelshinder avseende farliga ämnen och preparat. |
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
Artikel 1
Direktiv 67/548/EEG ska ändras på följande sätt. Bilaga I ska ändras på följande sätt:
a) |
De poster som motsvarar posterna i bilaga 1A till detta direktiv ska ersättas med posterna i den bilagan. |
b) |
Posterna i bilaga 1B till detta direktiv ska införas i bilaga I till direktiv 67/548/EEG och i samma ordningsföljd som i sistnämnda bilaga. |
c) |
Posterna i bilaga 1C till detta direktiv ska utgå. |
Artikel 2
Medlemsstaterna ska senast den 1 juni 2009 sätta i kraft de lagar och andra författningar som är nödvändiga för att följa detta direktiv. De ska till kommissionen genast överlämna texten till dessa bestämmelser tillsammans med en jämförelsetabell över dessa bestämmelser och detta direktiv.
När en medlemsstat antar dessa bestämmelser ska de innehålla en hänvisning till detta direktiv eller åtföljas av en sådan hänvisning när de offentliggörs. Närmare föreskrifter om hur hänvisningen ska göras ska varje medlemsstat själv utfärda.
Medlemsstaterna ska till kommissionen överlämna texten till de centrala bestämmelser i nationell lagstiftning som de antar inom det område som omfattas av detta direktiv.
Artikel 3
Detta direktiv träder i kraft den tjugonde dagen efter det att det har offentliggjorts i Europeiska unionens officiella tidning.
Artikel 4
Detta direktiv riktar sig till medlemsstaterna.
