UREDBA KOMISIJE (EU) 2019/220
z dne 6. februarja 2019
o spremembi Uredbe (ES) št. 865/2006 o določitvi podrobnih pravil za izvajanje Uredbe Sveta (ES) št. 338/97 o varstvu prosto živečih živalskih in rastlinskih vrst z zakonsko ureditvijo trgovine z njimi
EVROPSKA KOMISIJA JE –
ob upoštevanju Pogodbe o delovanju Evropske unije,
ob upoštevanju Uredbe Sveta (ES) št. 338/97 z dne 9. decembra 1996 o varstvu prosto živečih živalskih in rastlinskih vrst z zakonsko ureditvijo trgovine z njimi (1) ter zlasti člena 19(4) Uredbe,
ob upoštevanju naslednjega:

Uredba Komisije (ES) št. 865/2006 (2) je namenjena izvajanju Uredbe (ES) št. 338/97 in zagotavljanju popolne skladnosti z določbami Konvencije o mednarodni trgovini z ogroženimi prosto živečimi živalskimi in rastlinskimi vrstami (CITES) (v nadaljnjem besedilu: Konvencija). |

Na sedemnajstem zasedanju konference pogodbenic Konvencije so bile dogovorjene določene spremembe Resolucije konference pogodbenic CITES 11.20 (Rev. CoP17) v zvezi s trgovino z živimi sloni in nosorogi. Na istem zasedanju je bil prestrukturiran in posodobljen seznam standardnih virov nomenklature, priložen Resoluciji konference pogodbenic CITES 12.11 (Rev. CoP17) in ki se uporablja za navajanje znanstvenih imen vrst v dovoljenjih in potrdilih. |

Stalni odbor Konvencije je na svojem 67. zasedanju sprejel revidirane smernice za predložitev letnih poročil. Smernice zajemajo revidirane kode, ki se vključijo v opis osebkov, in merske enote, ki se uporabijo v dovoljenjih in potrdilih. |

(4) |
Spremembe resolucij konference pogodbenic CITES 11.20 in 12.11 ter revidirane kode in merske enote morajo biti upoštevane v Uredbi (ES) št. 865/2006. |
|
(5) |
Zato je treba Uredbo (ES) št. 865/2006 ustrezno spremeniti. |
|
(6) |
Ukrepi iz te uredbe so v skladu z mnenjem Odbora za trgovino s prosto živečimi živalskimi in rastlinskimi vrstami – |
SPREJELA NASLEDNJO UREDBO:
Člen 1
Uredba (ES) št. 865/2006 se spremeni:

vstavi se naslednji člen 5b: „Člen 5b Posebna vsebina dovoljenj in potrdil za žive nosoroge in žive slone Dovoljenja in potrdila, izdana v skladu s členom 4 ali členom 5 Uredbe (ES) št. 338/97 za uvoz ali ponovni izvoz živih nosorogov ali živih slonov iz populacij, vključenih v Prilogo B k navedeni uredbi, vsebujejo pogoj, ki navaja, da roževina ali slonovina iz navedenih živali ali njihovih potomcev ne sme postati predmet trgovine ali komercialnih dejavnosti v Uniji. Poleg tega živi nosorogi ali živi sloni iz navedenih populacij niso predmet trofejnega lova zunaj njihovega zgodovinskega območja razširjenosti.“; |

(2) |
Prilogi VII in VIII se nadomestita z besedilom iz Priloge k tej uredbi. |
Člen 2
Ta uredba začne veljati dvajseti dan po objavi v Uradnem listu Evropske unije.
Ta uredba je v celoti zavezujoča in se neposredno uporablja v vseh državah članicah.
