Uredba Sveta (EGS) št. 1461/93

z dne 8. junija 1993

o dostopu do javnih naročil za ponudnike iz Združenih držav Amerike

SVET EVROPSKIH SKUPNOSTI JE

ob upoštevanju Pogodbe o ustanovitvi Evropske gospodarske skupnosti in zlasti člena 113 Pogodbe,

ob upoštevanju predloga Komisije,

ker sta 25. maja 1993 Evropska gospodarska skupnost in Združene države Amerike podpisali Sporazum v obliki Pisnega dogovora o javnih naročilih, v nadaljevanju "Sporazum", katerega namen je izdelava okvira uravnoteženih pravic in dolžnosti, da se odprejo deli njihovih trgov javnih naročil z namenom doseganja liberalizacije in razširitve trgovine;

ker sta se Skupnost in Združene države Amerike sporazumeli tudi, da nadaljujejo pogajanja zaradi doseganja uravnoteženega, izčrpnega sporazuma o naročilih, v katerih je zajetih veliko naročnikov zvezne vlade, naročnikov lokalnih vlad in drugih vladnih naročnikov, in samostojni sporazum o naročilih s telekomunikacijskega področja;

ker so Združene države Amerike ne glede na pomemben napredek pri liberalizaciji javnega naročanja, v skladu s Poglavjem VII Zakona o trgovini iz leta 1988 uvedle sankcije, ki ponudnikom iz Skupnosti preprečuje sodelovanje pri oddaji javnih naročil na zvezni ravni v Združenih državah, ki ne bi bili zajeti v Sporazumu; ker Skupnost meni, da so take sankcije nepoštene in neupravičene;

ker mora Skupnost zato sprejeti ustrezne ukrepe, da podobno omeji dostop za ponudnike iz Združenih držav glede nekaterih javnih naročil, ki jih oddajajo naročniki; ker taki ukrepi ne smejo kršiti obveznosti Skupnosti in njenih držav članic glede Sporazuma in GATT Sporazuma o vladnih javnih naročilih;

ker so potrebne določbe za izjemne primere, kjer se ukrepi omejevanja dostopa do javnih naročil Skupnosti za ponudnike iz Združenih držav ne uporabljajo zaradi javnega interesa in javne varnosti,

SPREJEL NASLEDNJO UREDBO:

Člen 1

Brez vpliva na obveznosti Skupnosti in njenih držav članic do tretjih držav, naročniki našteti v Prilogi I, zavrnejo ponudbe dobaviteljev blaga, gradbenikov in ponudnikov storitev, ki so ustanovljeni in delujejo iz Združenih držav za:

(a) oddajo javnega naročila blaga v smislu Direktive Sveta 77/62/EGS z dne 21. decembra 1976 o usklajevanju postopkov oddaje javnih naročil blaga [1], katerih ocenjena vrednost brez davka na dodano vrednost je nižja od praga, ki velja za GATT Sporazum o vladnih naročilih, sedaj 125576 ekujev;

(b) oddajo javnega naročila storitev v smislu Direktive Sveta 92/50/EGS z dne 18. junija 1992 o usklajevanju postopkov oddaje javnega naročila storitev [2], katerih ocenjena vrednost brez davka na dodano vrednost je nižja od 200000 ekujev in za vsa naročila storitev navedena na seznamu v Prilogi II;

(c) oddajo javnega naročila gradnje v smislu Direktive Sveta 71/305/EGS z dne 26. julija 1971 o usklajevanju postopkov oddaje javnih naročil za gradnjo [3], katerih ocenjena vrednost brez DDV je nižja od 5000000 ekujev.

Člen 2

Država članica lahko kljub temu dovoli svojim naročnikom iz člena 1, da sprejmejo take ponudbe, ko sprejme utemeljeno odločitev, za vsak primer posebej, da je take ponudbe treba sprejeti, da:

(a) se izogne omejevanju sodelovanja na enega samega dobavitelja blaga, gradbenika ali ponudnika storitev;

(b) zagotovi kontinuiteto dobave blaga ali zagotavljanja storitev;

(c) da dobi blago ali storitve s posebnimi lastnostmi, ki jih sicer ni na voljo;

(d) da se izogne nesorazmernemu strošku naročnika;

(e) da se zaščiti varnost te države članice.

O vseh takih odločitvah zadevna država članica takoj obvesti Komisijo. Komisija se lahko posvetuje s Svetovalnim odborom za javna naročila, ustanovljenim s Sklepom 71/306/EGS [4].

Člen 3

Komisija lahko oblikuje odločitve iz člena 2 z Odborom ustanovljenim v skladu s členom 113 Pogodbe z namenom, da z ustreznimi ukrepi zagotovi usklajeno uporabo določb člena 2 v Skupnosti.

Člen 4

Ta uredba začne veljati z dnem po objavi v Uradnem listu Evropskih skupnosti.

Ta uredba je v celoti zavezujoča in se neposredno uporablja v vseh državah članicah.
