SKLEP št. 2/2006 PRIDRUŽITVENEGA SVETA EU-ČILE
z dne 16. oktobra 2006
o spremembah Priloge I k Sporazumu o pridružitvi med Evropsko skupnostjo in njenimi državami članicami na eni strani in Republiko Čile na drugi strani, zaradi upoštevanja konsolidacije tarifnih preferencialov odobrenih Čilu v okviru sheme splošnih tarifnih preferencialov Skupnosti (STP)

PRIDRUŽITVENI SVET JE –
ob upoštevanju Sporazuma o pridružitvi med Evropsko skupnostjo in njenimi državami članicami na eni in Republiko Čile na drugi strani, ki je bil podpisan v Bruslju 18. novembra 2002 (v nadaljnjem besedilu „Pridružitveni sporazum“), in zlasti člena 60(5),
ob upoštevanju naslednjega:

Za zagotovitev jasnosti, dolgoročne gospodarske predvidljivosti in pravne varnosti gospodarskih subjektov so se pogodbenice strinjale, da se preostali tarifni preferenciali, ki so bili odobreni Čilu v okviru sheme splošnih tarifnih preferencialov Skupnosti in ki še niso bili upoštevani na seznamu tarifnih koncesij Skupnosti, navedenih v Prilogi I k Pridružitvenemu sporazumu EU in Čila, konsolidirajo tako, da se dodajo v dvostranski sporazum o prosti trgovini. |

Člen 60(5) Pridružitvenega sporazuma pooblašča Pridružitveni svet, da sprejme sklepe z namenom, da pospeši znižanje carin, kot je predvideno v členih 65, 68 in 71, ali drugače izboljša pogoje za dostop v skladu s temi členi. |

S tem sklepom se nadomestijo pogoji za zadevne izdelke, določeni v členih 65, 68 in 71. |

Zaželeno bi bilo, da se zagotovi nemoten prehod s STP na preferencialni dvostranski trgovinski režim, vzpostavljen s Pridružitvenim sporazumom, tako da se omogoči predložitev dokazil o poreklu blaga (potrdilo o poreklu, obrazec A ali izjava na računu) v določenem obdobju – |
SKLENIL:
Člen 1
Priloga I k Pridružitvenemu sporazumu se spremeni v skladu z določbami iz Priloge k temu sklepu.
Člen 2
S tem sklepom se za uvoz zadevnih izdelkov v Skupnost nadomestijo pogoji iz členov 65, 68 in 71 Pridružitvenega sporazuma.
Člen 3
Dokazila o poreklu, ki jih Čile pravilno izda v okviru sheme splošnih tarifnih preferencialov Skupnosti (STP), se v Evropski skupnosti sprejmejo kot veljavna dokazila o poreklu v okviru dvostranskega trgovinskega režima, vzpostavljenega s Pridružitvenim sporazumom, pod pogojem, da:
(i) |
se dokazilo o poreklu predloži v štirih mesecih od datuma začetka veljavnosti tega sklepa; |
(ii) |
se dokazilo o poreklu in prevozne listine izdajo najpozneje na dan pred začetkom veljavnosti tega sklepa; |
(iii) |
se dokazilo o poreklu predloži ob uvozu v Evropsko skupnost v korist tarifnih preferencialov, ki so bili prej odobreni v okviru STP in konsolidirani s tem sklepom. |
Člen 4
Ta sklep začne veljati 1. januarja 2006 ali na dan njegovega sprejetja, če se sklep sprejme po 1. januarju 2006.
