In Case C-232/01, REFERENCE to the Court under Article 234 EC by the Politierechtbank te Mechelen (Belgium) for a preliminary ruling in the criminal proceedings before that court against Hans van Lent, on the interpretation of Article 39 EC,THE COURT (Fifth Chamber),,
after considering the written observations submitted on behalf of:
having regard to the Report for the Hearing,
after hearing the oral observations of the Danish Government, represented by J. Bering Liisberg, of the Finnish Government, represented by T. Pynnä, acting as Agent, of the United Kingdom Government, represented by P. Whipple, and of the Commission, represented by H. van Lier, at the hearing on 10 October 2002,
after hearing the Opinion of the Advocate General at the sitting on 5 December 2002,
gives the following
