o spremembi Izvedbenega sklepa (EU) 2024/2207 o nekaterih nujnih ukrepih v zvezi z ovčjimi in kozjimi kozami v Grčiji

EVROPSKA KOMISIJA JE –
ob upoštevanju Pogodbe o delovanju Evropske unije,
ob upoštevanju Uredbe (EU) 2016/429 Evropskega parlamenta in Sveta z dne 9. marca 2016 o prenosljivih boleznih živali in o spremembi ter razveljavitvi določenih aktov na področju zdravja živali („Pravila o zdravju živali“) (1) in zlasti člena 259(1), točka (c), Uredbe,
ob upoštevanju naslednjega:

Ovčje in kozje koze so nalezljiva virusna bolezen, ki prizadene koze in ovce ter lahko močno vpliva na zadevno populacijo živali in donosnost gojenja, kar povzroča motnje pri premikih pošiljk navedenih živali in proizvodov iz njih znotraj Unije in pri izvozu v tretje države. |

V primeru izbruha ovčjih in kozjih koz pri kozah ali ovcah obstaja resno tveganje za širjenje navedene bolezni v druge obrate s kozami in ovcami. |

Delegirana uredba Komisije (EU) 2020/687 (2) dopolnjuje pravila za obvladovanje bolezni s seznama iz člena 9(1), točke (a), (b) in (c), Uredbe (EU) 2016/429, ki so opredeljene kot bolezni kategorij A, B in C v Izvedbeni uredbi Komisije (EU) 2018/1882 (3). Zlasti člena 21 in 22 Delegirane uredbe (EU) 2020/687 določata vzpostavitev območja z omejitvami v primeru izbruha bolezni kategorije A, vključno z ovčjimi in kozjimi kozami, in nekatere ukrepe, ki jih je treba na tem območju izvajati. Poleg tega člen 21(1) navedene delegirane uredbe določa, da območje z omejitvami zajema zaščitno območje, ogroženo območje in po potrebi dodatna območja z omejitvami okoli zaščitnih in ogroženih območij ali ob njih. |

Izvedbeni sklep Komisije (EU) 2024/2207 (4) je bil sprejet na podlagi Uredbe (EU) 2016/429 in določa nekatere nujne ukrepe v zvezi z ovčjimi in kozjimi kozami v Grčiji. Natančneje, Izvedbeni sklep (EU) 2024/2207 določa, da morajo zaščitna in ogrožena območja ter dodatna območja z omejitvami, ki jih po izbruhih navedene bolezni vzpostavi navedena država članica v skladu z Delegirano uredbo (EU) 2020/687, obsegati vsaj območja, navedena v Prilogi k navedenemu izvedbenemu sklepu. |

Po datumu sprejetja Izvedbenega sklepa (EU) 2024/2207 je Grčija Komisijo obvestila o dodatnih izbruhih ovčjih in kozjih koz v obratih, v katerih gojijo ovce in koze. Zato je bila Priloga k navedenemu izvedbenemu sklepu večkrat ustrezno spremenjena, da bi se upoštevali navedeni dodatni izbruhi. Izvedbeni sklep (EU) 2024/2207 je bil nazadnje spremenjen z Izvedbenim sklepom Komisije (EU) 2024/2937 (5). |

Od datuma sprejetja Izvedbenega sklepa (EU) 2024/2937 je Grčija Komisijo obvestila o sedemindvajsetih novih izbruhih ovčjih in kozjih koz v obratih, v katerih gojijo ovce in koze, v regionalnih enotah Ksanti, Rodopi, Focis, Lemnos, Larisa, Kavala, Evros in Evboja. Dva od navedenih novih izbruhov sta zunaj meja zaščitnih območij, ogroženih območij in dodatnih območij z omejitvami, ki so že bila vzpostavljena zaradi prejšnjih izbruhov, ter sta znotraj območij, na katerih bolezen prej ni bila prijavljena, vključno z regionalnima enotama Evboja in Lemnos. |

Zato bi bilo treba območja, ki so za Grčijo navedena kot zaščitna in ogrožena območja ter dodatna območja z omejitvami v Prilogi k Izvedbenemu sklepu (EU) 2024/2207, dodatno prilagoditi, da se prepreči nadaljnje širjenje bolezni v Grčiji in preostali Uniji, prilagoditi pa bi bilo treba tudi trajanje izvajanja ukrepov na teh območjih. Zato je treba spremeniti seznam območij z omejitvami in trajanje izvajanja ukrepov na njih iz Priloge k navedenemu izvedbenemu sklepu ter opredeliti nova zaščitna območja, ogrožena območja in dodatna območja z omejitvami v zvezi z izbruhi v regionalnih enotah Evboja in Lemnos. |

Velikost zaščitnih območij, ogroženih območij in dodatnih območij z omejitvami ter trajanje ukrepov, ki se uporabljajo na njih, bi morala temeljiti na merilih iz člena 64(1) Uredbe (EU) 2016/429 in pravilih iz Delegirane uredbe (EU) 2020/687, vključno z epidemiološkimi razmerami v zvezi z ovčjimi in kozjimi kozami na območjih, ki jih je prizadela navedena bolezen, in splošnim epidemiološkim stanjem glede ovčjih in kozjih koz v državi članici, prizadeti zaradi navedene bolezni, ter stopnjo tveganja za nadaljnje širjenje navedene bolezni. Pri določitvi trajanja ukrepov bi bilo treba upoštevati tudi mednarodne standarde iz Kodeksa za zdravje kopenskih živali Svetovne organizacije za zdravje živali (WOAH). V sedanjih epidemioloških razmerah obstaja zelo veliko tveganje za nadaljnje širjenje bolezni, zlasti zaradi dejstva, da je po podatkih, ki jih je predložila Grčija, v enem tednu prišlo do skupno sedemindvajset novih izbruhov ovčjih in kozjih koz, medtem ko so se izbruhi prvič pojavili v regionalni enoti Lemnos, kar kaže, da se bolezen kljub že veljavnim ukrepom nadaljuje in pokriva dolge razdalje. |

Poleg tega je treba zaradi pojava številnih novih izbruhov ovčjih in kozjih koz v Grčiji v zadnjih štirih tednih, ki so med seboj zelo oddaljeni, podaljšati prepoved premikov ovc in koz s celotnega ozemlja Grčije v namembni kraj zunaj Grčije vsaj do 15. januarja 2025, da bi se izognili širjenju bolezni v preostale dele Unije in neupravičenim trgovinskim oviram. |
