THE DIRECTOR,

Having regard to Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data,

Having regard to Article 5 of Council Regulation (EC) No 1035/97 of 2 June 1997 establishing a European Monitoring Centre on Racism and Xenophobia,

Having regard to the proposal of the Commission of the European Communities for a Regulation of the European Parliament and of the Council on data protection of individuals with regard to the processing of personal data by the institutions and bodies of the Community, COM(1999) 337 final, published in the Official Journal of the European Communities, C 376 of 28 December 1999,

Giving due consideration to the aim that it is desirable to implement a common data protection policy of all Community institutions,

Considering that it is nevertheless important that the EUMC is in a position to collect and process data even before the proposed Regulation COM(1999) 337 final enters into force,

HAS ADOPTED THIS INTERIM REGULATION:

1. The proposed Regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the institutions and bodies of the Community and on the free movement of such data, COM(1999) 337 final, as published in the Official Journal of the European Communities, C 376 of 28 December 1999, is adopted by the EUMC as its interim data protection regulation according to Article 5 of Regulation (EC) No 1035/97.

2. A data protection officer of the EUMC is appointed as supervisory authority according to Article 28 of Directive 95/46/EC. All powers provided for in Article 28 of Directive 95/46/EC are vested in the data protection officer of the EUMC.

3. The data protection officer of the EUMC shall be responsible for implementing this Interim Regulation.

4. This Interim Regulation enters into force immediately upon publication in the Official Journal of the European Communities.

5. This Interim Regulation shall no longer be applicable as soon as the proposed Regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the institutions and bodies of the Community and on the free movement of such data, COM(1999) 337 final enters into force with effect for the EUMC.
