VYKONÁVACIE ROZHODNUTIE KOMISIE (EÚ) 2025/180
z 24. januára 2025,
ktorým sa mení vykonávacie rozhodnutie (EÚ) 2024/2207 o určitých núdzových opatreniach v súvislosti s kiahňami oviec a kiahňami kôz v Grécku

EURÓPSKA KOMISIA,
so zreteľom na Zmluvu o fungovaní Európskej únie,
so zreteľom na nariadenie Európskeho parlamentu a Rady (EÚ) 2016/429 z 9. marca 2016 o prenosných chorobách zvierat a zmene a zrušení určitých aktov v oblasti zdravia zvierat („právna úprava v oblasti zdravia zvierat“) (1), a najmä na jeho článok 259 ods. 1,
keďže:

Kiahne oviec a kiahne kôz sú infekčná vírusová choroba, ktorá postihuje kozy a ovce a môže mať závažný vplyv na dotknutú populáciu zvierat a ziskovosť chovu, keďže narúša premiestňovanie zásielok uvedených zvierat a produktov, resp. výrobkov z nich v rámci Únie a vývoz do tretích krajín. |

V prípade výskytu ohniska kiahní oviec a kiahní kôz u kôz alebo oviec existuje vážne riziko šírenia danej choroby do iných zariadení pre kozy a ovce. |

Delegovaným nariadením Komisie (EÚ) 2020/687 (2) sa dopĺňajú pravidlá kontroly chorôb zo zoznamu uvedených v článku 9 ods. 1 písm. a), b) a c) nariadenia (EÚ) 2016/429 a vymedzených ako choroby kategórie A, B a C vo vykonávacom nariadení Komisie (EÚ) 2018/1882 (3). V článkoch 21 a 22 delegovaného nariadenia (EÚ) 2020/687 sa v prípade výskytu ohniska choroby kategórie A vrátane kiahní oviec a kiahní kôz konkrétne stanovuje zriadenie reštrikčného pásma a určité opatrenia, ktoré sa v ňom majú uplatňovať. V článku 21 ods. 1 uvedeného delegovaného nariadenia sa stanovuje, že reštrikčné pásmo má zahŕňať ochranné pásmo, pásmo dohľadu a v prípade potreby ďalšie reštrikčné pásma, ktoré sú okolo ochranného pásma a pásma dohľadu alebo s nimi susedia. |

Komisia s cieľom riešiť výskyt ohnísk kiahní oviec a kiahní kôz v Grécku prijala na základe článku 259 nariadenia (EÚ) 2016/429 vykonávacie rozhodnutie (EÚ) 2024/2207 (4). V danom rozhodnutí sa stanovujú určité núdzové opatrenia v súvislosti s kiahňami oviec a kiahňami kôz v Grécku Vo vykonávacom rozhodnutí (EÚ) 2024/2207 sa konkrétne stanovuje, že ochranné pásma, pásma dohľadu a ďalšie reštrikčné pásma, ktoré má uvedený členský štát v súlade s delegovaným nariadením (EÚ) 2020/687 zriadiť v reakcii na výskyt ohnísk tejto choroby, majú zahŕňať aspoň oblasti uvedené v prílohe k uvedenému vykonávaciemu rozhodnutiu. |

Po prijatí vykonávacieho rozhodnutia (EÚ) 2024/2207 Grécko oznámilo Komisii ďalšie ohniská kiahní oviec a kiahní kôz v zariadeniach, v ktorých sa držia ovce a kozy. Príloha k uvedenému vykonávaciemu rozhodnutiu bola niekoľko krát náležite zmenená v snahe zohľadniť tieto ohniská. |

Grécko od poslednej zmeny vykonávacieho rozhodnutia (EÚ) 2024/2207 oznámilo Komisii 19 nových ohnísk kiahní oviec a kiahní kôz v zariadeniach, ktoré držia ovce a kozy, a to v regionálnych jednotkách Evros, Magnesia, Rhodopi, Xanthi, Aetolia-Acarnania, Iraklio a Phocis. |

Preto by sa mali oblasti uvedené v prílohe k vykonávaciemu rozhodnutiu (EÚ) 2024/2207 v prípade Grécka ako ochranné pásma, pásma dohľadu a ďalšie reštrikčné pásma ďalej upraviť, aby sa zabránilo ďalšiemu šíreniu choroby v Grécku a do zvyšku Únie alebo do tretích krajín, a malo by sa upraviť trvanie opatrení, ktoré sa v nich majú uplatňovať. Je teda potrebné zmeniť zoznam reštrikčných pásiem a trvanie opatrení, ktoré sa v nich majú uplatňovať, stanovené v prílohe k uvedenému vykonávaciemu rozhodnutiu. |

Veľkosť ochranných pásiem, pásiem dohľadu a ďalších reštrikčných pásiem a trvanie opatrení, ktoré sa v nich majú uplatňovať, vychádzajú z kritérií stanovených v článku 64 ods. 1 nariadenia (EÚ) 2016/429 a pravidiel stanovených v delegovanom nariadení (EÚ) 2020/687 vrátane epidemiologickej situácie, pokiaľ ide o kiahne oviec a kiahne kôz v oblastiach postihnutých uvedenou chorobou, a celkovej epidemiologickej situácie, pokiaľ ide o kiahne oviec a kiahne kôz v dotknutom členskom štáte, ako aj úrovne rizika ďalšieho šírenia uvedenej choroby. V tomto trvaní opatrení sa zohľadňujú aj medzinárodné normy Kódexu zdravia suchozemských zvierat Svetovej organizácie pre zdravie zvierat (WOAH). V súčasnej situácii existuje veľmi vysoké riziko ďalšieho šírenia choroby, najmä vzhľadom na to, že podľa informácií poskytnutých príslušným orgánom ide o prvé hlásené ohnisko na ostrove Samothraki v regionálnej jednotke Evros a v regionálnej jednotke Iraklio na ostrove Kréta, čo naznačuje, že choroba pretrváva a šíri sa napriek zavedeným opatreniam. |

Navyše vzhľadom na výskyt mnohých nových ohnísk kiahní oviec a kiahní kôz v Grécku počas uplynulých dvoch týždňov je tiež potrebné predĺžiť zákaz premiestňovania oviec a kôz z celého územia Grécka do miesta určenia nachádzajúceho sa mimo Grécka, a to aspoň do 15. februára 2025, aby sa zabránilo šíreniu choroby do zvyšku Únie a tretích krajín, ako aj neodôvodneným prekážkam obchodu. |

Vzhľadom na súčasnú epidemiologickú situáciu v Únii v súvislosti s kiahňami oviec a kiahňami kôz by sa obdobie, počas ktorého je nutné uplatňovať opatrenia stanovené vo vykonávacom rozhodnutí (EÚ) 2024/2207, malo predĺžiť do 31. júla 2025. |

Opatrenia stanovené v tomto rozhodnutí sú v súlade so stanoviskom Stáleho výboru pre rastliny, zvieratá, potraviny a krmivá, |
