VYKONÁVACIE ROZHODNUTIE KOMISIE (EÚ) 2026/332
z 9. februára 2026,
ktorým sa mení príloha k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 o núdzových opatreniach v súvislosti s výskytom ohnísk vysokopatogénnej aviárnej influenzy v určitých členských štátoch
[oznámené pod číslom C(2026) 865]

EURÓPSKA KOMISIA,
so zreteľom na Zmluvu o fungovaní Európskej únie,
so zreteľom na nariadenie Európskeho parlamentu a Rady (EÚ) 2016/429 z 9. marca 2016 o prenosných chorobách zvierat a zmene a zrušení určitých aktov v oblasti zdravia zvierat (právna úprava v oblasti zdravia zvierat) (1), a najmä na jeho článok 259 ods. 1 písm. c),
keďže:

Vysokopatogénna aviárna influenza (ďalej aj „HPAI“) je infekčná vírusová choroba vtákov, ktorá môže mať závažný dosah na ziskovosť chovu hydiny v dôsledku narúšania obchodu v rámci Únie a vývozu do tretích krajín. Vírusmi HPAI sa môžu nakaziť sťahovavé vtáky, ktoré potom môžu počas jesennej a jarnej migrácie tieto vírusy prenášať na veľké vzdialenosti. Preto prítomnosť vírusov HPAI u voľne žijúcich vtákov, ktoré ich môžu priamo alebo nepriamo zavliecť do chovov, kde sa drží hydina či vtáky chované v zajatí, predstavuje neustálu hrozbu. V prípade výskytu ohniska HPAI existuje riziko rozšírenia pôvodcu choroby do iných chovov, kde sa drží hydina či vtáky chované v zajatí. |

Nariadením (EÚ) 2016/429 sa stanovuje legislatívny rámec pre prevenciu a kontrolu chorôb, ktoré sa môžu prenášať na zvieratá alebo na ľudí. HPAI patrí do vymedzenia choroby zo zoznamu v uvedenom nariadení a vzťahujú sa na ňu pravidlá prevencie a kontroly chorôb, ktoré sú v ňom stanovené. Pravidlá prevencie a kontroly určitých chorôb zo zoznamu stanovené v nariadení (EÚ) 2016/429 vrátane opatrení na kontrolu chorôb týkajúcich sa HPAI navyše dopĺňajú pravidlá stanovené v delegovanom nariadení Komisie (EÚ) 2020/687 (2). Konkrétne sa v článku 21 uvedeného delegovaného nariadenia stanovuje, že v prípade výskytu ohniska choroby kategórie A v zariadení príslušný orgán ihneď zriadi reštrikčné pásmo, ktoré zahŕňa ochranné pásmo, pásmo dohľadu a v prípade potreby ďalšie reštrikčné pásma, ktoré sú okolo ochranného pásma a pásma dohľadu alebo s nimi susedia. |

Na základe nariadenia (EÚ) 2016/429 bolo prijaté vykonávacie rozhodnutie Komisie (EÚ) 2023/2447 (3), v ktorom sa stanovujú núdzové opatrenia na úrovni Únie v súvislosti s výskytom ohnísk HPAI. |

Konkrétne sa v článku 2 písm. a), článku 3 písm. a) a článku 4 písm. a) vykonávacieho rozhodnutia (EÚ) 2023/2447 stanovuje, že v nadväznosti na výskyt ohnísk HPAI musia ochranné pásma, pásma dohľadu a ďalšie reštrikčné pásma, ktoré majú príslušné orgány členských štátov uvedených v prílohe k danému rozhodnutiu zriadiť v súlade s delegovaným nariadením (EÚ) 2020/687, zahŕňať aspoň oblasti uvedené v danej prílohe ako ochranné pásma, pásma dohľadu a ďalšie reštrikčné pásma. V článku 2 písm. b), článku 3 písm. b) a článku 4 písm. b) vykonávacieho rozhodnutia (EÚ) 2023/2447 sa takisto stanovuje, že opatrenia, ktoré sa majú v uvedených ochranných pásmach, pásmach dohľadu a ďalších reštrikčných pásmach uplatňovať v súlade s uvedeným delegovaným nariadením, sa musia zachovať aspoň do dátumov stanovených v prílohe k uvedenému vykonávaciemu rozhodnutiu. |

Príloha k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 bola nedávno zmenená vykonávacím rozhodnutím Komisie (EÚ) 2026/282 (4) v nadväznosti na výskyt ohnísk HPAI v zariadeniach, kde sa drží hydina alebo vtáky chované v zajatí, v Belgicku, Nemecku, vo Francúzsku, v Taliansku, Maďarsku, Holandsku a Poľsku, čo bolo potrebné v uvedenej prílohe zohľadniť. |

Odo dňa prijatia vykonávacieho rozhodnutia (EÚ) 2026/282 Česko, Nemecko, Francúzsko, Taliansko, Maďarsko, Holandsko a Poľsko nahlásili Komisii výskyt nových ohnísk HPAI v uvedených členských štátoch v zariadeniach, kde sa drží hydina alebo vtáky chované v zajatí. Oznámenia sa týkali konkrétne dvoch ohnísk u vtákov chovaných v zajatí v Stredočeskom a Pardubickom kraji v Česku, siedmich ohnísk u hydiny v spolkových krajinách Brandenbursko, Meklenbursko-Predpomoransko, Dolné Sasko, Sasko, Sasko-Anhaltsko a Šlezvicko-Holštajnsko v Nemecku, jedného ohniska u vtákov chovaných v zajatí v departemente Haute-Vienne a jedného ohniska u hydiny v departemente Pas-de-Calais vo Francúzsku, ôsmich ohnísk u hydiny v regiónoch Emilia-Romagna, Toskánsko a Benátsko v Taliansku, dvoch ohnísk u hydiny v Békešskej a Jasovsko-veľkokumánsko-solnockej župe v Maďarsku, jedného ohniska u vtákov chovaných v zajatí v provincii Gelderland a jedného ohniska u hydiny v provincii Drenthe v Holandsku, jedného ohniska u vtákov chovaných v zajatí v Západopomoranskom vojvodstve a štyroch ohnísk u hydiny v Pomoranskom, Sliezskom a Veľkopoľskom vojvodstve v Poľsku. |

V nadväznosti na výskyt týchto 28 nových ohnísk Česko, Nemecko, Francúzsko, Taliansko, Maďarsko, Holandsko a Poľsko prijali opatrenia na kontrolu chorôb požadované v súlade s delegovaným nariadením (EÚ) 2020/687 vrátane zriadenia ochranných pásiem a pásiem dohľadu okolo týchto ohnísk. |

Okrem toho sa ohnisko HPAI u hydiny v provincii Drenthe v Holandsku nachádza v tesnej blízkosti hranice s Nemeckom. Keďže pásmo dohľadu týkajúce sa uvedeného ohniska v Holandsku zasahuje na územie Nemecka, príslušný orgán Nemecka náležite spolupracoval s príslušným orgánom Holandska na zriadení potrebného pásma dohľadu v súlade s delegovaným nariadením (EÚ) 2020/687. |

Okrem toho sa ohnisko HPAI u hydiny v Békešskej župe v Maďarsku nachádza v tesnej blízkosti hranice s Rumunskom. Keďže pásmo dohľadu týkajúce sa uvedeného ohniska v Maďarsku zasahuje na územie Rumunska, príslušný orgán Rumunska náležite spolupracoval s príslušným orgánom Maďarska na zriadení potrebného pásma dohľadu v súlade s delegovaným nariadením (EÚ) 2020/687. |

Komisia preskúmala opatrenia na kontrolu choroby, ktoré prijalo Česko, Nemecko, Francúzsko, Taliansko, Maďarsko, Holandsko, Rumunsko a Poľsko, a s uspokojením konštatuje, že hranice ochranných pásiem a pásiem dohľadu, ktoré zriadili uvedené členské štáty, sú v dostatočnej vzdialenosti od zariadení s potvrdenými výskytmi ohniska HPAI. |

S cieľom predísť akémukoľvek zbytočnému narušeniu obchodu v rámci Únie a vyhnúť sa vytváraniu neodôvodnených prekážok obchodu zo strany tretích krajín je nevyhnutné, aby sa na úrovni Únie v spolupráci s Českom, Nemeckom, Francúzskom, Talianskom, Maďarskom, Holandskom, Rumunskom a Poľskom urýchlene vymedzili ochranné pásma a pásma dohľadu zriadené uvedenými členskými štátmi v súlade s delegovaným nariadením (EÚ) 2020/687. |

Preto by sa oblasti uvedené ako ochranné pásma a pásma dohľadu v Česku, Nemecku, vo Francúzsku, v Taliansku, Maďarsku, Holandsku a Poľsku v prílohe k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 mali zmeniť, aby sa v nich zohľadnili hranice ochranných pásiem a pásiem dohľadu zriadených uvedenými členskými štátmi v nadväznosti na výskyt nových ohnísk HPAI v uvedených členských štátoch, ako aj požadované trvanie opatrení, ktoré sa majú uplatňovať v týchto pásmach, v súlade s delegovaným nariadením (EÚ) 2020/687. |

V prílohe k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 nie sú v súčasnosti uvedené žiadne oblasti ako pásma dohľadu v prípade Rumunska. |
|

Dotknuté oblasti by sa preto teraz mali v prílohe k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 uvádzať ako pásmo dohľadu v Rumunsku, aby sa zohľadnili hranice pásma dohľadu zriadeného uvedeným členským štátom v nadväznosti na nedávny výskyt ohniska HPAI v Maďarsku, ako aj trvanie opatrení, ktoré sa majú uplatňovať v uvedenom pásme, v súlade s delegovaným nariadením (EÚ) 2020/687. |

Príloha k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 by sa preto mala zodpovedajúcim spôsobom zmeniť. |
|
(16) |
Vzhľadom na naliehavosť epidemiologickej situácie v Únii, pokiaľ ide o šírenie HPAI, je dôležité, aby zmeny vykonávacieho rozhodnutia (EÚ) 2023/2447, ktoré sa majú vykonať týmto rozhodnutím, nadobudli účinnosť čo najskôr. |

Opatrenia stanovené v tomto rozhodnutí sú v súlade so stanoviskom Stáleho výboru pre rastliny, zvieratá, potraviny a krmivá, |
PRIJALA TOTO ROZHODNUTIE:
Článok 1
Príloha k vykonávaciemu rozhodnutiu (EÚ) 2023/2447 sa nahrádza textom uvedeným v prílohe k tomuto rozhodnutiu.
Článok 2
Toto rozhodnutie je určené členským štátom.
