    In Case C-26/00, Kingdom of the Netherlands (Agents: M. Fierstra and J. van Bakel) v Commission of the European Communities (Agents: T. van Rijn and C. van der Hauwaert), supported by Kingdom of Spain (Agent: N. Díaz Abad) — action for annulment under Article 230 EC, brought on 29 January 2000 — the Court (Second Chamber), composed of C.W.A. Timmermans, President of the Chamber, R. Silva de Lapuerta, R. Schintgen (Rapporteur), G. Arestis and J. Klučka, Judges; P. Léger, Advocate General; R. Grass, Registrar, gave a judgment on 14 July 2005, in which it:

    1.

    Dismisses the action;

    2.

    Orders the Kingdom of the Netherlands to pay the costs;

    3.

    Orders the Kingdom of Spain to bear its own costs.
