DECISÃO (PESC) 2024/746 DO CONSELHO
de 23 de fevereiro de 2024
que altera a Decisão 2014/512/PESC que impõe medidas restritivas tendo em conta as ações da Rússia que desestabilizam a situação na Ucrânia
O CONSELHO DA UNIÃO EUROPEIA,
Tendo em conta o Tratado da União Europeia, nomeadamente o artigo 29.o,
Tendo em conta a proposta do alto representante da União para os Negócios Estrangeiros e a Política de Segurança,
Considerando o seguinte:

Em 31 de julho de 2014, o Conselho adotou a Decisão 2014/512/PESC (1). |

(2) |
A União mantém-se inabalável no seu apoio à soberania e à integridade territorial da Ucrânia. |
|
(3) |
Nas suas Conclusões de 14 e 15 de dezembro de 2023, o Conselho Europeu reiterou a sua firme condenação da guerra de agressão da Rússia contra a Ucrânia, que constitui uma violação manifesta da Carta das Nações Unidas, e reafirmou o apoio inabalável da União à independência, à soberania e à integridade territorial da Ucrânia dentro das suas fronteiras internacionalmente reconhecidas, bem como ao direito inerente de legítima defesa da Ucrânia contra a agressão russa. O Conselho Europeu declarou igualmente que a capacidade da Rússia para travar a sua guerra de agressão tem de ser ainda mais enfraquecida, nomeadamente através de sanções mais reforçadas, da sua aplicação plena e efetiva e da prevenção da evasão às mesmas, sobretudo no que respeita aos bens de alto risco, em estreita cooperação com os parceiros e aliados. |

Dada a gravidade da situação, é conveniente adotar novas medidas restritivas. |

Em especial, o Conselho considera adequado acrescentar 27 novas entidades à lista de pessoas coletivas, entidades e organismos estabelecida no anexo IV da Decisão 2014/512/PESC, ou seja, à lista de pessoas, entidades e organismos que apoiam diretamente o complexo industrial e militar da Rússia na sua guerra de agressão contra a Ucrânia, relativamente às quais são impostas restrições mais apertadas à exportação de bens e tecnologias de dupla utilização, bem como de bens e tecnologias que possam contribuir para o reforço tecnológico do setor da defesa e segurança da Rússia. Além disso, considerando o importante papel facilitador dos componentes eletrónicos para utilização pelo complexo militar e industrial da Rússia no apoio à guerra de agressão contra a Ucrânia, é conveniente incluir nessa lista certas entidades em países terceiros que não a Rússia que apoiam indiretamente o complexo industrial e militar da Rússia na sua guerra de agressão contra a Ucrânia comercializando esses componentes, bem como certas entidades russas envolvidas no desenvolvimento, produção e fornecimento de componentes eletrónicos para o complexo militar e industrial russo. |

Além disso, é adequado alargar a lista de bens e tecnologias controlados que contribuem para o reforço militar e tecnológico da Rússia ou para o desenvolvimento do seu setor da defesa e segurança, acrescentando-lhe os componentes para o desenvolvimento e a produção de veículos aéreos não tripulados. |

Ademais, é adequado impor novas restrições às exportações de bens que contribuam, em particular, para o reforço das capacidades industriais russas. |

É também adequado alargar a lista de países parceiros que aplicam um conjunto de medidas restritivas das importações de ferro e aço e um conjunto de medidas de controlo dessas importações substancialmente equivalentes às previstas na Decisão 2014/512/PESC e no Regulamento (UE) n.o 833/2014 do Conselho (2). |

É necessária uma ação adicional por parte da União para dar execução a determinadas medidas. |

Por conseguinte, a Decisão 2014/512/PESC deverá ser alterada em conformidade, |
ADOTOU A PRESENTE DECISÃO:
Artigo 1.o
A Decisão 2014/512/PESC é alterada do seguinte modo:

No artigo 4.o-M, é inserido o seguinte número: «3-AC. No que respeita aos bens e tecnologias abrangidos pelos códigos NC 850410. 850421, 850422, 850423, 850431, 850440, 850450 e 850490, as proibições estabelecidas nos n.os 1 e 2 não são aplicáveis à execução, até 25 de maio de 2024, de contratos celebrados antes de 24 de fevereiro de 2024 ou de contratos acessórios necessários à sua execução.» |

2) |
Os anexos da Decisão 2014/512/PESC são alterados em conformidade com o anexo da presente decisão. |

A presente decisão entra em vigor no dia seguinte ao da sua publicação no Jornal Oficial da União Europeia.

O anexo IV da Decisão 2014/512/PESC passa a ter a seguinte redação:«ANEXO IV
O presente anexo enumera as pessoas singulares ou coletivas, entidades ou organismos que são utilizadores finais militares, integram o complexo militar e industrial da Rússia, têm ligações comerciais ou outras ao setor da defesa e segurança da Rússia ou que de outro modo apoiam esse mesmo setor. Estas pessoas singulares ou coletivas, entidades ou organismos contribuem para o reforço militar e tecnológico da Rússia ou para o desenvolvimento do setor da defesa e segurança da Rússia. A lista inclui pessoas singulares ou coletivas, entidades ou organismos de países terceiros que não a Rússia. A inclusão no presente anexo não implica qualquer atribuição de responsabilidade pelas suas ações à jurisdição em que operam.
