Primeiro relatório intercalar sobre a estratégia de simplificação do quadro regulador

Resumo

O presente documento de trabalho da Comissão dá seguimento à Comunicação COM(2005) 535, de Outubro de 2005, intitulada «Aplicar o Programa Comunitário de Lisboa - Estratégia de simplificação do quadro regulador». Completa também a comunicação relativa à «Análise estratégica do programa "Legislar Melhor" na União Europeia».

A simplificação da legislação comunitária pode contribuir significativamente para melhorar o quadro regulador, para actualizar e modernizar as regras em vigor, bem como para reduzir os encargos administrativos em prol do bem-estar da economia europeia e tendo em conta a evolução das tecnologias, dos mercados e da conjuntura internacional. Esta a razão pela qual, com o seu programa "Legislar melhor", a Comissão coloca a simplificação legislativa entre as principais prioridades políticas.

Em linha com esta orientação, o presente documento de trabalho da Comissão faz um balanço dos progressos realizados na concretização da estratégia de simplificação de Outubro de 2005, evoca os trabalhos em curso e apresenta novas iniciativas com vista ao reforço do programa continuado de simplificação para o período 2006-2009. Um dos principais resultados da simplificação reside na progressiva cobertura de todos os domínios de regulamentação comunitária. O documento faz também o ponto da situação em matéria de codificação.

Paralelamente, este primeiro relatório analisa os factores de sucesso para a concretização dos objectivos de simplificação, designadamente um conjunto sólido de metodologias, uma cooperação institucional melhorada com o Parlamento Europeu e o Conselho para levar os trabalhos a bom termo, o recurso acrescido à auto-regulação e à co-regulação, assim como a simplificação no plano nacional para garantir que os benefícios da simplificação à escala da UE não são aniquilados por novas regras ou barreiras técnicas nacionais.

INTRODUÇÃO

Em conformidade com as prioridades do programa "Legislar melhor", de Março de 2005, a Comissão adoptou, em Outubro de 2005, uma nova estratégia de simplificação do ambiente regulador[1]. A principal finalidade da estratégia reside na melhoria da qualidade e eficácia do acervo e na eliminação de encargos inúteis impostos aos operadores, contribuindo assim para o objectivo de tornar a economia europeia mais competitiva.

O Parlamento Europeu[2] acolheu com agrado o programa da Comissão para simplificar o acervo e o Conselho Europeu[3] exortou o Conselho de Ministros a dar prioridade ao tratamento legislativo das propostas de simplificação. A cooperação com os co-legisladores é essencial para a concretização dessas propostas.

O presente documento de trabalho da Comissão, que completa a «Análise estratégica do programa "Legislar melhor" na União Europeia»[4], dá conta pela primeira vez dos resultados obtidos desde o lançamento da estratégia, em Outubro de 2005, e apresenta novos desenvolvimentos na realização dos objectivos desta estratégia. Em especial:

- faz o ponto da situação sobre a aplicação da estratégia de simplificação e do processo de codificação, centrando-se nos seguintes aspectos:

- acções do programa continuado que foram concluídas

- acções em curso que devem ser prosseguidas

- novas acções identificadas pela Comissão

- evoca os factores de sucesso para a concretização de um quadro regulador genuinamente simplificado, tais como um conjunto sólido de metodologias, uma estreita cooperação entre as instituições da UE, o recurso acrescido à auto-regulação e à co-regulação, assim como a simplificação no plano nacional.

O programa actualizado para o período 2006–2009 integra as iniciativas de simplificação inscritas no programa legislativo e de trabalho da Comissão para 2007 e dá uma ideia dos esforços empreendidos pela Comissão para simplificar o actual ambiente regulamentar numa perspectiva plurianual. A inclusão, pela primeira vez, das iniciativas de simplificação no programa legislativo e de trabalho da Comissão para 2007, constitui uma prova clara da importância política conferida à estratégia de simplificação.

A cultura normativa atravessa um processo de mudança. Pela primeira vez, com efeito, a Comissão adaptou os seus métodos de trabalho, prioridades e recursos em função dos objectivos da simplificação. Um dos principais avanços reside na progressiva cobertura de todas as áreas de intervenção política.

No futuro, o trabalho actualmente em curso para reduzir os encargos administrativos irá apoiar os esforços de simplificação, os quais, por seu lado, contribuirão para realizar um objectivo comum de redução de 25% dos encargos administrativos da legislação da UE e nacional a atingir até 2012, conforme consta da «Análise estratégica do programa "Legislar melhor" na União Europeia».

Paralelamente, os benefícios decorrentes das intensas consultas das partes interessadas e das avaliações de impacto contribuirão para melhorar a qualidade das novas propostas da Comissão e darão aos legisladores meios para produzirem um quadro normativo que esteja em plena sintonia com o princípio da subsidiariedade e mais favorável à competitividade, à inovação e ao crescimento. Tudo isto deverá reduzir os futuros trabalhos de simplificação.

Periodicamente, serão elaborados relatórios de progressos.

1. A SITUAÇÃO ACTUAL

1.1. Situação actual - Programa continuado de simplificação

A estratégia de simplificação de Outubro de 2005 abrange um conjunto de métodos de simplificação no âmbito de um programa continuado de três anos, enumerando, para o período 2005–2008, cerca de 100 iniciativas relativamente a 220 actos legislativos de base que a Comissão pretende simplificar, na sequência das intensas consultas a que procedeu junto dos Estados-Membros, das empresas e dos cidadãos.

Ciente da importância que tem uma reavaliação permanente do acervo, a Comissão já identificou mais 43 iniciativas que se poderiam prestar a um exercício de simplificação no período 2006–2009. Estas iniciativas foram incluídas na versão actualizada no programa continuado, constante do anexo 1. O programa confirma a determinação da Comissão no sentido de reduzir os encargos administrativos gerados pelo quadro normativo e actualizar e modernizar este último, tendo em conta a evolução das tecnologias, dos mercados e da conjuntura internacional.

1.1.1. Progressos realizados pela Comissão

Das 14[5] iniciativas programadas para 2005, foram concluídas 12. No que diz respeito a 2006, estavam programadas 54 iniciativas na comunicação de Outubro de 2005, tendo sido recentemente identificadas mais 3, além de uma iniciativa de 2005 que foi transferida para 2006 e uma de 2008 que foi antecipada para este ano. Até à data, foram adoptadas 15[6]. Acresce que 24 propostas de simplificação serão adoptadas antes do final do ano, constando as mesmas do anexo 1. Quinze iniciativas serão adiadas para 2007/2008. Cinco foram retiradas, após análises aprofundadas e consultas com as partes interessadas.

Até à data, a Comissão aprovou 27 das 71 iniciativas previstas para 2005–2006 e mais de metade das propostas do programa serão adoptadas até ao final de 2006. O ritmo de execução do programa de simplificação em 2006 varia consoante a complexidade do domínio em questão e, em alguns casos, os trabalhos estão atrasados, ainda que certas iniciativas tenham sido aprovadas antes da data prevista. Quase todas as iniciativas adiadas estão, no entanto, confirmadas para 2007.

Importa sublinhar que este programa é, de longe, o projecto de simplificação mais ambicioso que a Comissão alguma vez empreendeu. O exercício de simplificação revela-se particularmente árduo nos casos em que as vantagens para as empresas e para os cidadãos têm de ser equilibradas com os esforços e os custos necessários à adaptação ao novo quadro regulador. Com efeito, a simplificação pode implicar reformas do quadro normativo em certos domínios políticos. Para ultrapassar as resistências à mudança que tais planos de reformas geram, é muitas vezes necessário mais tempo para ajudar a demonstrar os benefícios macroeconómicos globais e reais das mudanças propostas.

Por outro lado, as avaliações de impacto podem por vezes evidenciar novos elementos relevantes para o decisor político, quando este tem de proceder à opção política mais apropriada[7]. O programa de simplificação tem sido aplicado tendo em conta os resultados destas avaliações de impacto.

Actualmente, quase todas as propostas de simplificação apresentadas pela Comissão continuam pendentes no Conselho e no Parlamento Europeu. As propostas em questão constam do anexo 3.

Apresentam-se a seguir alguns exemplos de resultados que demonstram que importantes pontos de interesse para as empresas e os cidadãos já foram tratados pelo programa de simplificação da Comissão.

Exemplos de propostas aprovadas pela Comissão:

- Modernização do Código Aduaneiro e «alfândega electrónica» ( e-customs )[8]: reformulação da legislação aduaneira comunitária e criação de sistemas electrónicos pan-europeus para o intercâmbio de dados entre as administrações públicas e as empresas. O comércio internacional será facilitado com a racionalização e a simplificação dos procedimentos e das regras em matéria aduaneira, com a informatização e a interconexão dos sistemas aduaneiros e a estreita cooperação de todas as autoridades e agências que participam na circulação transfronteiriça de mercadorias na Comunidade.

- Ambiente [9] : modernização da directiva-quadro relativa aos resíduos:

- simplificação da legislação em matéria de resíduos, mercê da clarificação das definições, da racionalização das disposições e da integração das directivas relativas aos resíduos perigosos e aos óleos usados;

- modernização do mercado da reciclagem, através da fixação de normas ambientais que especifiquem as condições em que certos resíduos reciclados deixam de ser considerados resíduos.

- Livre circulação de trabalhadores [10]:

- modernização das disposições actuais em matéria de coordenação dos sistemas nacionais de segurança social;

- flexibilização dos procedimentos para as pessoas seguradas e redução do prazo de resposta e tratamento das situações transfronteiriças pelas instituições nos diferentes ramos da segurança social (doença, acidentes de trabalho, doenças profissionais, invalidez, velhice, desemprego, prestações familiares).

- Aditivos e aromatizantes alimentares [11]:

- simplificação da legislação relativa aos aditivos alimentares, de forma a que os princípios, os procedimentos e as aprovações sejam regidos por um instrumento único;

- melhoria dos procedimentos para actualizar a lista comunitária dos aditivos alimentares autorizados.

- Pequenas e médias empresas da indústria farmacêutica [12]: criação de um quadro regulador simplificado para as micro, as pequenas e as médias empresas, com taxas reduzidas, pagamentos diferidos e assistência administrativa e jurídica na apresentação de pedidos à Agência Europeia de Medicamentos.

- Serviços de pagamentos [13]: definição de um quadro regulador simplificado para os serviços de pagamentos destinados a consumidores e empresas. A proposta prevê a simplificação da legislação (com a substituição de três directivas e três recomendações por um conjunto coerente de normas) e dos procedimentos administrativos a cumprir pelas administrações públicas (à escala nacional ou da UE) e pelo sector privado. Introduz maior transparência e estabelece obrigações de informação mais claras e sucintas para os utilizadores de serviços de pagamentos e os consumidores.

- Regras contabilísticas [14]: alteração das regras contabilísticas existentes, dando aos Estados-Membros maior margem de manobra para isentar empresas de certas obrigações de publicidade (mediante subida dos limiares nesta matéria), o que trará uma simplificação administrativa para as empresas mais pequenas.

- Estatísticas estruturais das empresas [15]: a proposta simplifica o processo de apuramento de tais estatísticas, suprimindo 15 variáveis obrigatórias (relativas a I&D, emprego, energia e locação financeira), passando outras variáveis de uma recolha anual dos dados para uma recolha plurianual e suprimindo as variáveis facultativas. Por outro lado, o Eurostat está a desenvolver um programa de reengenharia das estatísticas das empresas, a fim de apoiar os Estados-Membros com novos métodos susceptíveis de reduzir substancialmente os encargos com as respostas aos inquéritos, mercê de um recurso acrescido aos dados administrativos e à transmissão electrónica automática das contas das empresas.

- Mercado dos transportes aéreos [16]: a revisão do chamado "terceiro pacote" da liberalização dos transportes aéreos deverá tornar a legislação mais legível, mercê da fusão num novo documento dos 3 regulamentos existentes. A legislação moderniza e simplifica o quadro normativo, garante uma aplicação coerente em todos os Estados-Membros e visa corrigir potenciais distorções e restrições de concorrência em alguns segmentos do mercado. Os consumidores terão assim maior liberdade de escolha, tarifas mais baixas e mais concorrência.

1.1.2. Trabalhos em curso

Várias importantes iniciativas de simplificação relevantes para a competitividade estão agora confirmadas para 2006, 2007 ou 2008:

- Agricultura: reunião das 21 organizações comuns de mercado (OCM) existentes num só regime, a fim de estabelecer um quadro jurídico horizontal racionalizado que defina um conjunto único de regras harmonizadas nas várias áreas da política de mercado (intervenção, armazenagem privada, contingentes pautais de importação, restituições à exportação, medidas de salvaguarda, promoção dos produtos agrícolas, regras aplicáveis aos auxílios estatais, comunicações e transmissão de dados).

- Ambiente: reexame da directiva sobre prevenção e controlo integrados da poluição (IPPC) e de outros instrumentos legislativos conexos em matéria de emissões industriais, a fim de a tornar mais clara e coerente (designadamente em termos de obrigações de comunicação de dados) e racionalizar as exigências.

- Directiva relativa aos produtos de construção , com vista à simplificação, clarificação e redução dos encargos administrativos, em particular para as pequenas e médias empresas, através de uma maior flexibilidade na formulação e na utilização das especificações técnicas, da simplificação das regras de certificação e da eliminação dos obstáculos à execução, que têm dificultado a plena realização de um mercado interno para os produtos de construção.

- Estatísticas: redução das obrigações em matéria comunicação de dados estatísticos impostas aos operadores económicos, em especial às PME, tendo em conta os trabalhos em curso com vista à melhoria da governação estatística na União Europeia e os resultados finais dos projectos-piloto em curso para quantificar e reduzir os encargos administrativos.

- Rotulagem dos produtos alimentares e das rações animais: a modernização da legislação irá clarificar as regras em matéria de rotulagem, a fim de possibilitar aos consumidores escolhas conscientes, seguras, saudáveis e duradouras, contribuindo para contribuir para criar um ambiente comercial propício à concorrência, no qual os operadores possam utilizar eficientemente a rotulagem para venderem os seus produtos.

- Defesa do consumidor: racionalização e simplificação de todo o acervo em matéria de defesa do consumidor, a fim de suprimir eventuais incoerências, sobreposições, barreiras ao mercado interno e distorções da concorrência.

- Cosméticos: adoptada há trinta anos, a directiva relativa aos cosméticos foi alterada mais de 40 vezes. A reformulação do texto torna-se necessária, para fins de coerência e de clareza. Este exercício deverá contribuir para reduzir os custos administrativos inerentes à execução e à gestão da directiva, sem alterar o regime em vigor de progressiva proibição dos testes realizados em animais.

- Normas contabilísticas e de comunicação financeira: disponibilização às empresas da UE de um conjunto actualizado de normas de comunicação financeira, mercê da fusão do conjunto de regulamentos actualmente em vigor[17], que representa mais de 2 000 páginas, num único regulamento de leitura e consulta mais fáceis.

- Quadro regulador para a indústria automóvel: Depois de aprovada, a proposta pendente de revisão da directiva-quadro relativa à recepção dos veículos a motor permitirá:

- a substituição das directivas comunitárias (CE) por regulamentos UNECE. Esta simplificação irá racionalizar os regulamentos e suprimir exigências redundantes. Ajudará também a indústria mundial a suprimir as barreiras não pautais ao comércio, mantendo a liderança da UE na definição de normas internacionais e permitindo à indústria uma adaptação mais rápida às evoluções tecnológicas à escala internacional;

- a introdução das disposições técnicas necessárias em matéria de auto-diagnóstico e ensaios virtuais em 25 directivas comunitárias e regulamentos da UNECE. O objectivo é simplificar o procedimento de homologação e permitir que o quadro normativo acompanhe a evolução técnica. O ensaio virtual e o auto-diagnóstico permitirão acelerar o desenvolvimento de produtos e reduzir os custos tanto para a indústria como para os consumidores. Acresce que a Comissão propõe o aditamento, na directiva relativa à recepção dos veículos a motor, de uma disposição de carácter geral que permita que os construtores actuem enquanto laboratório de ensaio, desde que a autoridade homologadora lhes reconheça competências para o efeito.

- Acesso à profissão e ao mercado do transporte rodoviário: reformulação de quatro regulamentos e uma directiva com vista a clarificar, simplificar e viabilizar a aplicação das disposições que regem o acesso à profissão e ao mercado, incluindo a cabotagem nos transportes rodoviários de mercadorias e de passageiros. Com a reformulação deverá ser possível aplicar a regulamentação de forma harmonizada e eficaz em termos de custos, também no contexto internacional, limitando assim as distorções de concorrência, salvaguardando o direito de estabelecimento e melhorando a qualidade dos serviços e a segurança rodoviária.

- Consolidação das directivas e dos regulamentos relativos à «Nova abordagem» técnica [18] para a comercialização dos produtos, com base em definições coerentes, procedimentos de certificação simplificados e uma cooperação administrativa aligeirada, com o objectivo de facilitar a colocação dos produtos no mercado e ao mesmo tempo proteger os fabricantes contra produtos não conformes.

1.1.3. Novas iniciativas para reforçar o programa de simplificação

A partir do programa continuado que foi lançado no ano passado, a Comissão reforça agora a sua acção de simplificação com 43[19] iniciativas novas para o período 2006-2009 que têm por objectivo:

- estimular a inovação e reduzir os encargos administrativos decorrentes das exigências reguladoras;

- reduzir o volume total do acervo comunitário e promover a transição para abordagens reguladoras mais flexíveis.

Apresentam-se a seguir algumas das principais iniciativas.

- Simplificação das regras aplicáveis às alterações introduzidas nos medicamentos posteriormente à emissão da autorização de comercialização (regulamentos de alteração). Actualmente, a gestão administrativa destas disposições mobiliza mais de 60 % dos recursos humanos e financeiros dos serviços jurídicos das empresas. Em alguns casos, estes condicionalismos podem ter efeitos perversos na inovação, já que impedem a introdução de alterações que poderiam ser benéficas para os doentes e para a sociedade. Os procedimentos serão racionalizados de forma a tornar os regulamentos de alteração mais simples, mais claros e mais flexíveis, sem comprometer a saúde pública e animal.

- Reconhecimento mútuo [20] de mercadorias que não estão abrangidas por disposições comunitárias harmonizadas . A Comissão está actualmente a trabalhar numa proposta legislativa destinada a eliminar as barreiras técnicas à livre circulação de mercadorias na União (proposta de reconhecimento mútuo). No documento serão definidos os direitos e as obrigações das autoridades nacionais e das empresas interessadas em vender num Estado-Membro produtos que já fabricam ou comercializam noutro.

- Clarificação da definição do âmbito de aplicação no que se refere à avaliação da segurança de novos produtos alimentares e racionalização do procedimento de autorização.

- Simplificação da gestão dos procedimentos administrativos no sector agrícola através de simplificações técnicas. Foi instituído um plano de acção continuado para alterar disposições jurídicas que têm consequências directas para os agricultores, para outros operadores económicos e para as administrações nacionais. Estas alterações dizem respeito, por exemplo, às obrigações impostas aos agricultores no tocante a documentos que devem manter à disposição, às obrigações de controlo dos Estados-Membros, às condições para beneficiar de apoios, etc.

- Simplificação e melhoria da política comum das pescas mercê da simplificação jurídica e administrativa a que se procedeu por força do «Plano de acção 2006–2008» que a Comissão adoptou em 2005[21]. O plano de acção abrange certas disposições relativas à gestão e ao controlo das actividades pescatórias e visa também tornar o quadro legislativo mais legível e ao mesmo tempo reduzir os encargos administrativos impostos aos pescadores e às administrações envolvidas.

- Revisão do quadro normativo das redes e serviços de comunicação electrónicos , a fim de reduzir as necessidades de regulamentação ex-ante e fomentar a flexibilidade e a inovação, em benefício do sector em questão e dos cidadãos.

- Substituição das directivas sobre têxteis por um regulamento único para simplificar os procedimentos para a determinação do nome de novas fibras. Por outro lado, os métodos quantitativos para medir o teor em fibras passarão a integrar o processo de normalização.

- Simplificação da legislação existente sobre brinquedos , clarificando os requisitos essenciais de segurança e criando condições propícias a uma abordagem comum mais adequada por parte das autoridades nacionais de supervisão dos mercados.

- Limitação dos actos legislativos sobre metrologia e fertilizantes às exigências essenciais, através da «Nova abordagem». As especificações técnicas circunstanciadas serão substituídas por normas.

- Revisão do mecanismo de atribuição do rótulo ecológico comunitário com o objectivo de:

- Criar um sistema mais adaptado às necessidades das empresas, associando as partes interessadas ao processo de tomada de decisão e tendo em conta as necessidades das PME;

- Externalizar a definição dos critérios de atribuição a um organismo especializado e associar o rótulo aos contratos públicos ecológicos.

- Reformulação de uma directiva relativa à comercialização de material de propagação de fruteiras e de fruteiras destinados à produção de frutos

- Tratar a questão das lesões musculo-esqueléticas de origem profissional num instrumento jurídico único que integre os diferentes requisitos mínimos de saúde e segurança, designadamente no que se refere ao manuseamento de cargas ou ao trabalho com ecrãs de visualização.

Todos os serviços da Comissão concluirão a análise do acervo da respectiva área de competências até 2009, a fim de verificar a pertinência dos instrumentos, a escolha do instrumento técnico e a oportunidade de recorrer a um dos métodos de simplificação descritos na estratégia de Outubro de 2005. Este processo poderá levar, se necessário e oportuno, à identificação de novas iniciativas de simplificação e à actualização no futuro do programa continuado.

1.2. Situação actual - codificação

A codificação é uma parte essencial do processo lançado pela Comissão Europeia e que visa legislar melhor. Consiste em reunir num único instrumento as disposições de actos em vigor e respectivas alterações ulteriores, o que reduz o volume do acervo comunitário e o torna mais transparente, legível e claro no plano jurídico.

O programa continuado de codificação (ver anexo 2) incide sobre cerca de 500 actos. Um total de 52 actos passaram com êxito pelo processo de codificação[22] , tendo sido adoptados e publicados no Jornal Oficial (trata-se de 38 actos da Comissão e 14 do Parlamento Europeu e do Conselho). Acresce que 33 actos estão pendentes junto da autoridade legislativa e 8 encontram-se em procedimento escrito. Ao todo, 85 actos foram finalizados pela Comissão Europeia.

Para cumprir o objectivo de levar a bom termo o programa de codificação até meados de 2008, foram tomadas medidas para acelerar a conversão nas novas línguas da UE dos textos consolidados acumulados. Esta acumulação deve-se aos atrasos verificados na tradução dos textos codificados nestas línguas.

Devem também ser tomadas medidas adequadas para maximizar o número de textos codificados disponíveis em búlgaro, romeno, gaélico e maltês, dando prioridade à codificação dos actos que já estão traduzidos nestas línguas.

Foi também preparado um programa para a adopção dos actos que estão por codificar. O objectivo é garantir a transparência do processo para, entre outros aspectos, conseguir que os actos que estão em fase de codificação sejam alterados o menos possível, a fim de estabilizar a legislação em causa e reduzir os atrasos. Este programa só tem valor indicativo, na medida em que a conclusão do projecto de codificação depende da disponibilidade de todas as versões linguísticas dos actos em questão. Esta observação é particularmente válida no que diz respeito ao búlgaro e ao romeno. Acresce que a codificação é adiada cada vez que se prevêem novas alterações aos actos. A ordem dos actos no programa irá variar em função destes dois factores.

Convém também ter presente que a adopção de actos codificados pelo legislador deve ser feita em conformidade com as disposições do Acordo Interinstitucional de 20 de Dezembro de 2004, relativo a um método de trabalho acelerado para a codificação oficial dos textos legislativos.

2. FACTORES DE SUCESSO

O quadro regulador para as empresas e os cidadãos europeus consiste numa sobreposição de legislações e regras muitas vezes estreitamente ligadas e adoptadas a diferentes níveis (internacional[23], comunitário, nacional, regional e local). Nenhuma destas instâncias de regulação pode, por si só, melhorar de forma significativa a qualidade do quadro regulador. Para conseguir melhorias concretas na qualidade global, são necessários esforços determinados, coerentes e coordenados a todos os níveis.

2.1. Trabalho de simplificação assente em bases metodológicas sólidas.

2.1.1. Consulta de todos os intervenientes

O programa continuado de simplificação 2006-2009 e a sua actualização foram desenvolvidos tendo em conta os contributos das partes interessadas e dos Estados-Membros, cuja experiência é indispensável para a eficácia e a pertinência do mesmo. As consultas intensas das partes, o reexame de inteiras áreas de intervenção política, a avaliação ex-post de actos legislativos e as análises de peritos ajudam os decisores políticos a identificar com maior exactidão os problemas reais. Estas práticas propiciam também a ulterior adesão das partes interessadas às medidas propostas.

A comunicação de Outubro de 2005[24] sobre simplificação anunciava uma série de medidas específicas

- Conforme se anunciava na comunicação da Comissão «Política agrícola comum - simplificar e legislar melhor», foi elaborado um plano de acção, o qual foi apresentado na conferência «A simple CAP for Europe, a challenge for all», realizada em Outubro de 2006. O plano de acção apresenta 20 projectos concretos de simplificação técnica (redução da burocracia sem alterar as orientações políticas fundamentais), a realizar até 2007. Marca o início de um processo de simplificação continuado, convidando as partes interessadas e os Estados-Membros a apresentar novas propostas de simplificação.

- O «Plano de acção 2006-2008 para a simplificação e a melhoria da politica comum da pesca», aprovado em 2005 pela Comissão recebeu todo o apoio das instituições europeias e das partes consultadas.

- Será em breve adoptada a comunicação relativa à redução dos encargos de resposta, à simplificação e ao estabelecimento de prioridades no domínio das estatísticas comunitárias. Esta comunicação define uma abordagem estratégica para continuar a reduzir os encargos impostos às empresas em matéria estatística, mercê da combinação de dois elementos: Simplificação das exigências estatísticas em certos domínios prioritários e incentivo ao recurso a instrumentos e métodos estatísticos que facilitem o cumprimento das obrigações nesta matéria. A Comissão irá ainda propor a introdução de um sistema de fluxo único para o Intrastat, um programa de transformação das estatísticas das empresas, e prosseguirá activamente a simplificação do sistema europeu de estatísticas agrícolas.

Acresce que o artigo 138.º do Tratado prevê a consulta dos parceiros sociais europeus sobre as iniciativas comunitárias no domínio da política social[25].

Os resultados de certas consultas levaram os serviços da Comissão a reconsiderar as suas intenções iniciais. Assim aconteceu com o exercício de reavaliação do direito das sociedades e do quadro normativo dos direitos de autor que deu origem a outras iniciativas:

- No que se refere ao direito das sociedades, a Comissão tenciona lançar antes do final do corrente ano uma iniciativa de grande envergadura para quantificar os custos administrativos das directivas «Direito das sociedades» e procurar, com os Estados-Membros e os intervenientes, formas de reduzir estes custos. A Comissão apresentará os resultados desta iniciativa numa comunicação prevista para o segundo semestre de 2007.

- No que se refere aos direitos de autor, o reexame da legislação traduziu-se em diversas iniciativas, entre as quais se conta uma avaliação da directiva de 2001 relativa aos direitos de autor, exercício este que poderá levar à definição de derrogações à aplicação da directiva em questão. Os resultados deste exercício poderão estar disponíveis no Verão de 2007.

2.1.2. Análise sectorial

Na sua anterior comunicação, a Comissão evocava a necessidade de abordar a simplificação numa perspectiva sectorial, a fim de avaliar melhor o impacto do quadro regulador na competitividade dos vários sectores de actividade.

Refira-se, a título de exemplo, os trabalhos em curso no âmbito dos produtos de construção. Trata-se de uma análise dos factores que determinam a competitividade dos operadores do sector em questão e de uma acção específica de simplificação da Directiva 89/106/CEE relativa aos produtos de construção. A consulta das partes interessadas começou e as respostas estão agora a ser analisadas pela Comissão.

No que se refere aos veículos a motor, o grupo de alto nível CARS 21 estudou as principais áreas de intervenção política que têm impacto na competitividade da indústria automóvel europeia e formulou um conjunto de recomendações.

Paralelamente a este exercício, a aplicação dos princípios do programa "Legislar melhor" está actualmente a ser analisada pelo novo fórum instituído no âmbito da comunicação relativa à política industrial[26]. As análises sectoriais já começaram no âmbito de grupos de trabalho como a task-force «Competitividade nas TIC» e o diálogo sobre política industrial no sector da indústria mecânica.

2.1.3. Trabalhos em curso no domínio dos encargos administrativos

Em resposta às conclusões do Conselho Europeu de Junho de 2006, e no contexto da vertente "competitividade" da estratégia de Lisboa renovada, a Comissão vai lançar, no início de 2007, um plano de acção de grande envergadura para reduzir os encargos administrativos decorrentes da legislação comunitária em vigor. O plano em questão basear-se-á nas experiências de quatro Estados-Membros (Reino Unido, Países Baixos, Dinamarca e República Checa) que já fixaram objectivos de redução depois de terem concluído toda uma série de avaliações de referência. O documento de trabalho da Comissão intitulado «Quantificação dos custos administrativos e redução dos encargos administrativos na União Europeia»[27] apresenta os resultados de um projecto piloto sobre encargos administrativos, realizado em 2006, no qual se analisam estas experiências e se tiram conclusões para o futuro. A médio prazo, este processo deveria permitir ao legislador europeu e ao Estados-Membros dispor de informações quantificadas para determinar os domínios prioritários nos quais há margem para ulterior simplificação.

Importa ter presente neste contexto que está em curso actualmente um estudo sobre os encargos administrativos impostos aos agricultores. O estudo em questão diz respeito à implementação da reforma da PAC e as suas posteriores alterações. Os primeiros resultados são esperados para 2007.

2.2. Cooperação estreita entre as instituições da UE

Mesmo que a Comissão apresente propostas legislativas de grande qualidade, é ao Conselho e ao Parlamento Europeu que incumbe a responsabilidade por levar este trabalho de simplificação até à sua fase final.

Há 22 propostas de simplificação adoptadas pela Comissão que estão pendentes no Conselho e no Parlamento Europeu (ver anexo 3). Destas 22 propostas, 7 referem-se a programas de simplificação anteriores a 2003[28] e continuam pendentes. A lista de propostas pendentes consta do anexo 3 e inclui textos de grande importância para as empresas, tais como a revisão da 6ª directiva sobre o IVA, a modernização do Código Aduaneiro, a revisão da legislação relativa aos resíduos, a racionalização das estatísticas estruturais das empresas e a revogação das disposições em matéria de pré-embalagem. A adopção da directiva «Contas»[29], que prevê um regime de excepção para as PME, assim como a recente aprovação pelo Conselho da posição comum respeitante à pré-embalagem, demonstram a determinação de todas as instituições em relação à simplificação do quadro regulador.

Convidado pela Comissão a pronunciar-se sobre a estratégia de simplificação de Outubro de 2005, o Parlamento Europeu respondeu em Abril de 2006. As posições das comissões parlamentares relativamente ao programa plurianual de simplificação denotam uma convergência significativa com as prioridades da Comissão quanto ao que deve ser simplificado.

Em Maio de 2006, o Parlamento Europeu adoptou uma série de relatórios que abrangem diversos aspectos do programa "Legislar melhor", designadamente a simplificação[30]. O Parlamento Europeu propõe, entre outros aspectos, que seja definido um novo instrumento a associar à codificação e à reformulação[31], para tipos específicos de propostas de simplificação que poderiam beneficiar de métodos de trabalho adaptados e prazos de adopção mais rápidos.

O Acordo Interinstitucional (AII) "Legislar melhor"[32], em vigor desde Dezembro de 2003, criou uma plataforma para o desenvolvimento da cooperação entre as três instituições. O grupo técnico de alto nível encarregado do acompanhamento da aplicação do acordo tem procedido a um exame periódico dos progressos realizados, designadamente em matéria de coordenação da programação do trabalho legislativo, qualidade da legislação (em especial a avaliação de impacto), transposição e aplicação da legislação comunitária e simplificação. A identificação por parte dos co-legisladores de acções concretas que dêem prioridade à simplificação e acelerem os trabalhos legislativos revelou-se difícil.

O acordo a que as instituições chegaram em Dezembro de 2005 no que diz respeito a uma abordagem interinstitucional comum sobre a análise de impacto[33] demonstra que, quando existe vontade política, o acordo interinstitucional «Legislar melhor» pode produzir melhorias concretas na aplicação interinstitucional dos princípios a ele subjacentes Quando, em 2008, as instituições procederem à reavaliação da abordagem comum, deverão acordar em que as iniciativas dos Estados-Membros no domínio da cooperação policial e judiciária em matéria penal sejam acompanhadas de avaliações de impacto.

A Comissão anunciou que entendia facilitar o processo de tomada de decisões mercê da melhoria da programação e da visibilidade das iniciativas de simplificação, através das seguintes medidas:

- Integração de propostas de simplificação no Programa de trabalho e legislativo da Comissão, o que já foi feito, mediante inserção das propostas de simplificação no programa para 2007;

- Utilização da «Exposição de motivos» para explicar com maior clareza os objectivos de simplificação que as propostas visam. No que se refere às propostas de simplificação que carecem de avaliação de impacto, a Comissão procurará avaliar as consequências da simplificação, designadamente em termos de encargos administrativos.

- Identificação de casos paradigmáticos de propostas de simplificação que permitam testar as possíveis métodos de trabalho interinstitucionais em matéria de simplificação.

2.3. Recorrer com maior frequência à co-regulação e à auto-regulação

A co-regulação e a auto-regulação são exemplos de técnicas que podem ser utilizadas e, certas situações para atingir objectivos políticos com uma intervenção limitada do legislador.

Assim por exemplo, os organismos europeus de normalização e a Comissão estão actualmente a trabalhar em conjunto, com o propósito de propor novas iniciativas de normalização no sector dos serviços, focalizadas especificamente no mercado interno. As normas permitem aos consumidores comparar livremente produtos e serviços, o que constitui um factor de reforço da concorrência e do comércio intracomunitário de serviços. Após intensas consultas, a definição de um plano de acção de normalização para estimular a competitividade industrial e a aprovação de uma decisão de financiamento comunitário irão dinamizar as actividades de normalização.

Em matéria de auto-regulação, os parceiros sociais europeus têm um papel específico a desempenhar, na medida em que podem celebrar acordos[34] que se tornam vinculativos através de uma proposta legislativa ou são aplicados de forma autónoma. A auto-regulação vai ao encontro da política da Comissão para promover a responsabilidade social das empresas (RSE). É de esperar que as iniciativas voluntárias no âmbito da Aliança Europeia para a RSE venham a traduzir-se em novos acordos de auto-regulação. Tais iniciativas, que partem das empresas da UE em estreita cooperação com os principais intervenientes, deveriam também contribuir para a generalização das práticas de RSE na Europa e no mundo. Para informar melhor os agentes do sector privado interessados em melhorar os mecanismos de auto-regulação, bem como as autoridades públicas a quem compete definir as modalidades da co-regulação, o Comité Económico e Social Europeu (CESE) e a Comissão constituíram uma base de dados que reúne perto de uma centena de mecanismos deste tipo. Esta base de dados, que deveria estar operacional a partir de Novembro de 2006, circunstancia os vários tipos de problemas que levaram à criação do mecanismo de auto-regulação na UE, os objectivos e as características organizacionais. Será assim muito mais fácil identificar boas e más práticas.

2.4. A simplificação à escala nacional

2.4.1. A simplificação da legislação comunitária tem de repercutir-se também na esfera nacional

O exercício de simplificação da UE tem de ser plenamente apoiado pelos Estados-Membros, a fim de que as vantagens de um ambiente regulador mais ligeiro à escala comunitária não fiquem comprometidas por novas disposições ou barreiras técnicas no plano nacional. A colaboração de muitos Estados-Membros é já uma realidade, mas há ainda muito por fazer. O facto de se manterem certas exigências estatísticas a nível nacional quando a regulamentação comunitária já foi racionalizada, é disso um bom exemplo.

Assim, em recentes propostas de revogação, a Comissão estabeleceu uma regra de reconhecimento mútuo destinada a evitar a emergência de novos obstáculos ao comércio na sequência da revogação de actos comunitários. Refira-se, a título de exemplo, a proposta relativa à pré-embalagem que foi concebida para prevenir eventuais obstáculos ao comércio decorrentes da manutenção de exigências nacionais.

Da mesma forma, para que a decisão de revogação da directiva comunitária relativa à classificação da madeira em bruto se torne efectiva, são necessárias medidas uniformes em toda a UE. As legislações nacionais que fazem referência à directiva devem ser alteradas em conformidade e os Estados-Membros devem fazer o necessário para que as modificações técnicas sejam introduzidas com rapidez e clareza.

As empresas europeias que pretendem exercer a sua actividade noutro Estado-Membro são confrontadas com excessiva frequência com formalidades e controlos administrativos. Nas situações em que se aplicam, as disposições do Tratado contribuem para simplificar as transacções no mercado interno. A Comissão está empenhada em reduzir tais condicionalismos, mercê da aplicação do artigo 28.º do Tratado CE relativo à livre circulação de mercadorias, designadamente através do acompanhamento dos projectos de actos legislativos de direito interno.

Em 2007, a Comissão irá trabalhar na integração dos mercados da defesa, com o objectivo de reduzir encargos administrativos excessivos que têm efeitos nefastos para a competitividade das empresas da União nesta área. Com efeito, os custos anuais que representa, para os industriais e para a administração, a concessão de licenças de importação ou de exportação de material militar dentro da Comunidade, estão avaliados em cerca 238,90 milhões de euros e, na prática, estes pedidos de licenças quase nunca são recusados. [35].

2.4.2. Evitar a regulamentação desnecessária («gold-plating»)

Nas disposições nacionais de transposição das directivas comunitárias, abundam os exemplos de exigências técnicas, obrigações de rotulagem, prazos, procedimentos de autorização e outros condicionalismos administrativos que o legislador nacional acrescenta às disposições comunitárias (o chamado gold-plating) . O ambiente regulador das empresas para da UE só pode ser melhorado se as iniciativas comunitárias forem completadas por medidas adequadas no plano nacional.

Outras fontes confirmam este facto, designadamente um estudo recente[36] realizado por conta de uma federação nacional de PME. Segundo este estudo, o alargamento do âmbito de aplicação inicial das directivas nas medidas de transposição pode ser altamente prejudicial para a produtividade das pequenas empresas, na medida em que absorve recursos financeiros necessários à criação de riqueza e de emprego. Acresce que a regulamentação desnecessária pode colocar as empresas nacionais em situação de desvantagem em relação a concorrentes de outros países.

Ciente destes problemas, a Comissão anunciou, na comunicação de Outubro de 2005, da sua intenção de explorar melhor as possibilidades de simplificação, recorrendo, sempre que oportuno, a regulamentos em vez de directivas. A substituição da Directiva 91/414/CEE pelo regulamento relativo à colocação no mercado de produtos fitofarmacêuticos é um exemplo concreto desta inflexão nas práticas reguladoras.

2.4.3. Programas nacionais de reforma

As exigências regulamentares e as medidas de aplicação são essencialmente produzidas ao nível nacional.

Os programas nacionais de reforma (PNR) inscrevem-se no âmbito deste nova estrutura de governação da estratégia de crescimento e emprego (estratégia de Lisboa), ao definir políticas nacionais de reforma económica com base em orientações comunitárias. Têm por isso um papel particularmente importante na criação de um ambiente mais favorável às empresas na UE. Todos os Estados-Membros responderam às orientações do programa "Legislar melhor" e incluíram medidas destinadas a promover os seus princípios nos respectivos planos nacionais de reforma.

Até à data, nove Estados-Membros lançaram programas de simplificação, com diferentes graus de ambição, no contexto dos PNR. É porém essencial que o programa de simplificação da UE seja completado por avanços nesta matéria em todos os Estados-Membros e a todos os níveis de decisão. A nota ao Comité de Política Económica – Promover a iniciativa "Legislar melhor"[37], e o Relatório da Competitividade de 2006 tiram as principais conclusões em matéria de melhoria do ambiente regulador ao nível dos Estados-Membros e descrevem com maior pormenor os progressos realizados neste matéria.

Entre as iniciativas nacionais, contam-se as seguintes:

- Redução dos custos administrativos: 17 Estados-Membros tomaram consciência da necessidade de examinar os encargos administrativos impostos às empresas e lançaram actividades de quantificação. Alguns fixaram objectivos quantificados de redução de custos (por exemplo, de 20 ou 25 % até 2010). Para lá chegar, recorre-se, por exemplo, à administração em linha, aos sistemas de balcão único[38] ou aos registos centrais, à redução da legislação fiscal, à simplificação das formalidades administrativas ligadas ao emprego e ao trabalho independente ou a iniciativas transversais em que intervêm diversas entidades.

- Administração em linha e soluções TIC para reduzir a burocracia nas administrações públicas: Criação de portais de acesso à legislação e aos formulários (pedidos, instrumentos para comunicação de dados, etc.) e disponibilidade acrescida de banda larga;

- Exame da legislação para determinar se os seus objectivos - simplificação do direito do trabalho, difusão de boas práticas regulamentares em toda a administração, análise custo/benefício da legislação, criação de um fórum sobre regulamentação aplicável às empresas, princípios gerais de boas práticas reguladoras, designadamente a proporcionalidade, a subsidiariedade, a transparência, a obrigação de prestação de contas, a acessibilidade e a simplicidade;

- Simplificação das obrigações fiscais, das formalidades administrativas e das obrigações de informação: especialmente mediante sistemas de balcão único para as empresas, as PME e os cidadãos, reforma dos impostos sobre as sociedades e sobre os rendimentos de capital;

- Simplificação das obrigações em matéria de IVA, por exemplo, com a supressão dos obstáculos fiscais às actividades transfronteiriças mercê da introdução de reduções fiscais aplicáveis às contribuições de reforma nos Estados-Membros da UE, em benefício dos migrantes e dos prestadores de serviços transfronteiriços;

- Melhoria da aplicação da legislação do mercado interno a fim de maximizar os seus efeitos benéficos;

- PME: melhorar o acesso ao financiamento, reduzir as obrigações de informação, criação de um sistema em linha de balcão único para as novas empresas;

- Datas comuns de entrada em vigor[39].

O intercâmbio de boas práticas entre os Estados-Membros e as avaliações interpares são essenciais para melhorar o ambiente normativo. A Comissão facilita este intercâmbio através do Grupo de Alto Nível "Legislar melhor" e no âmbito do processo de Lisboa.

Os Estados-Membros e as regiões devem ser encorajados e trabalhar em conjunto na definição de boas práticas, através, designadamente, da iniciativa BEST[40].

3. CONCLUSÃO

A estratégia de simplificação, que constitui um dos pilares da iniciativa "Legislar melhor", está a começar a produzir resultados.

A Comissão Europeia está determinada em avançar na concretização dos compromissos que assumiu em prol de um ambiente normativo mais eficaz, através de um programa de acção melhorado e ambicioso.

Para cumprir este objectivo comum, o Conselho e o Parlamento devem intensificar a sua participação, para levar a bom termo o trabalho de simplificação.

Uma parte do trabalho incumbe também aos Estados-Membros que deveriam proceder a intercâmbios de boas práticas e implementar programas de simplificação.

[1] Comunicação COM(2005) 535 "Aplicar o Programa Comunitário de Lisboa: - Estratégia de simplificação do quadro regulador". A simplificação abrange um vasto conjunto de instrumentos como a revogação, a codificação, a reformulação ou a modificação da abordagem reguladora. No presente documento, o conceito de codificação é definido no ponto 1.2 «Ponto da situação em matéria de codificação». A reformulação consiste em adoptar um novo acto legislativo vinculativo que revoga os actos que substitui, introduz alterações à substância da legislação e codifica as disposições remanescentes que se pretende manter inalteradas.

De harmonia com os princípios do programa "Legislar melhor", a Comissão decidiu lançar uma extensa avaliação de impacto, a fim de analisar as diferentes opções possíveis, incluindo a revogação ou a liberalização parcial da regulamentação existente, e consultar de novo as partes interessadas. (b) A recente evolução da situação internacional no domínio da energia e o subsequente debate sobre a questão da segurança energética levaram a Comissão a adiar, provavelmente até 2008, a prevista revisão da legislação sobre os stocks petrolíferos. A política futura da Comissão neste domínio dependerá, em grande medida, dos resultados da consulta sobre o Livro Verde sobre a política energética europeia, publicado em Março de 2006.

Esta acordo autónomo apresenta uma lista de boas práticas que permitem minimizar a exposição dos trabalhadores às poeiras de silício cristalino e deveria contribuir para fazer respeitar os limites de exposição profissional. Negociado pelos parceiros sociais dos diferentes sectores industriais envolvidos, o acordo constitui a primeira convenção multisectorial autónoma celebrada no âmbito do diálogo social europeu.

[38] O balcão único reúne várias formalidades administrativas numa só operação. É mais eficaz, traz vantagens para as PME e permite quantificar os resultados.

[39] As datas comuns de entrada em vigor deveriam ajudar as empresas a programar a introdução de nova regulamentação e chamar a sua atenção para exigências novas ou alteradas. O objectivo de reduzir para duas datas, por exemplo, a entrada em vigor de nova regulamentação é de conseguir que as empresas, ao estarem mais cientes das novas exigências, produzam níveis de conformidade melhorados.

[40] A Task Force para a Simplificação do Enquadramento Empresarial (BEST) foi criada em Setembro de 1997. Constituída por representantes da comunidade empresarial e das administrações públicas dos Estados-Membros, esta task force tinha por missão redigir um relatório independente sobre as formas de melhorar a legislação e suprimir os obstáculos inúteis ao desenvolvimento das empresas europeias e, mais particularmente, das pequenas e médias empresas (PME). Identificou iniciativas que constituem boas práticas (como a promoção dos sistemas de balcão único, a definição de regulamentação baseada nos riscos, etc.) assinaladas em diferentes países e das quais outros poderão beneficiar. A regulamentação baseada no risco consiste em concentrar os esforços de regulamentação (bem como os custos desses para as empresas) em actividades que apresentam maiores riscos para a saúde e o ambiente.
