REGULAMENTO (CE) Nº 1054/95 DA COMISSÃO de 11 de Maio de 1995 que altera o Regulamento (CEE) nº 2723/87 que estabelece regras especiais de aplicação do regime de restituições à exportação para os cereais exportados sob a forma de massas alimentícias, das subposições 1902 11 00 e 1902 19 da Nomenclatura Combinada

A COMISSÃO DAS COMUNIDADES EUROPEIAS,

Tendo em conta o Tratado que institui a Comunidade Europeia,

Tendo em conta o Regulamento (CE) nº 3448/93 do Conselho, de 6 de Dezembro de 1993, que estabelece o regime de trocas aplicável a certas mercadorias resultantes da transformação dos produtos agrícolas (1), e, nomeadamente, o nº 3 do seu artigo 8º,

Considerando que é oportuno prever que as massas alimentícias dos códigos NC 1902 11 e 1902 19 exportadas para os Estados Unidos sejam acompanhadas, quer de um certificado que indique que são exportadas na sequência de uma operação de tráfico de aperfeiçoamento activo, quer de um certificado que indique que beneficiam ou não beneficiam de uma taxa de restituição aplicável, em caso de exportação para os Estados Unidos da América, aos produtos de base do sector dos cereais que tenham sido utilizados na sua elaboração;

Considerando que é conveniente actualizar a denominação do serviço da Comissão responsável pela recepção das comunicações dos Estados-membros sobre os dados estatísticos relativos às quantidades de massas alimentícias;

Considerando que as medidas previstas no presente regulamento estão em conformidade com o parecer do Comité de gestão das questões horizontais relativas às trocas de produtos agrícolas transformados fora do anexo II,

ADOPTOU O PRESENTE REGULAMENTO:

Artigo 1º

O Regulamento (CEE) nº 2723/87 da Comissão (2) é alterado do seguinte modo:

1. No nº 1 do artigo 2º, a expressão « Certificate for the export with refund of pasta to the USA » é substituída por « Certificate for the export of pasta to the USA ».

2. No artigo 4º, o nº 2 passa a ter a seguinte redacção:

« 2. A autoridade competente preenche a parte adequada na casa 10 do original e das cópias do "Certificate P2"; consoante as mercadorias beneficiem ou não de uma restituição. A estância aduaneira referida no nº 2 do artigo 3º verifica que o documento está devidamente completado e apõe o seu visto na casa 10 do original e das cópias do "Certificate P2". ».

3. O artigo 6º passa a ter a seguinte redacção:

« Artigo 6 As autoridades competentes dos Estados-membros comunicam à Comissão, o mais tardar no fim de cada mês, os dados estatísticos relativos às quantidades de massas alimentícias, por subposição da pauta aduaneira comum, especificando as quantidades que beneficiarão da restituição à exportação e as quantidades que não beneficiarão da restituição à exportação, para as quais tenham sido visados certificados durante o mês precedente pelas estâncias aduaneiras onde ocorrem as aceitações das declarações de exportação, para o seguinte endereço:

4. O anexo I é substituído pelo anexo do presente regulamento.

Artigo 2º

O presente regulamento entra em vigor no sétimo dia seguinte ao da sua publicação no Jornal Oficial das Comunidades Europeias.

O presente regulamento é aplicável às exportações em relação às quais a aceitação, pelos serviços aduaneiros, da declaração de exportação ocorra a partir de 1 de Julho de 1995.

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-membros.
