DECISÃO DE EXECUÇÃO (UE) 2017/564 DA COMISSÃO

de 23 de março de 2017

que altera o anexo da Decisão de Execução 2014/709/UE relativa a medidas de polícia sanitária contra a peste suína africana em determinados Estados-Membros

[notificada com o número C(2017) 1813]

A COMISSÃO EUROPEIA,

Tendo em conta o Tratado sobre o Funcionamento da União Europeia,

Tendo em conta a Diretiva 89/662/CEE do Conselho, de 11 de dezembro de 1989, relativa aos controlos veterinários aplicáveis ao comércio intracomunitário, na perspetiva da realização do mercado interno (1), nomeadamente o artigo 9.o, n.o 4,

Tendo em conta a Diretiva 90/425/CEE do Conselho, de 26 de junho de 1990, relativa aos controlos veterinários e zootécnicos aplicáveis ao comércio intracomunitário de certos animais vivos e produtos, na perspetiva da realização do mercado interno (2), nomeadamente o artigo 10.o, n.o 4,

Tendo em conta a Diretiva 2002/99/CE do Conselho, de 16 de dezembro de 2002, que estabelece as regras de polícia sanitária aplicáveis à produção, transformação, distribuição e introdução de produtos de origem animal destinados ao consumo humano (3), nomeadamente o artigo 4.o, n.o 3,

Considerando o seguinte:

A Decisão de Execução 2014/709/UE da Comissão (4) estabelece medidas de polícia sanitária contra a peste suína africana em determinados Estados-Membros. O anexo da referida decisão de execução delimita e enumera, nas suas partes I, II, III e IV, certas zonas desses Estados-Membros, diferenciando-as em função do nível de risco baseado na situação epidemiológica. Essa lista inclui, entre outras, certas zonas da Lituânia.

Desde novembro de 2016, não foram notificados surtos de peste suína africana em suínos domésticos em determinadas zonas da Lituânia incluídas na lista da parte III do anexo da Decisão de Execução 2014/709/UE. Além disso, a supervisão das medidas de bioproteção foi aplicada de forma satisfatória em explorações dessas zonas com base no programa nacional de bioproteção com vista à prevenção da propagação da peste suína africana. Estes factos indicam uma melhoria da situação epidemiológica. Por conseguinte, essas zonas da Lituânia devem passar a constar da parte II e não da parte III do anexo da Decisão de Execução 2014/709/UE.

A evolução da atual situação epidemiológica da peste suína africana nas populações afetadas de suínos domésticos e selvagens na União deve ser tida em conta na avaliação do risco zoossanitário decorrente dessa situação no que se refere à doença na Lituânia. A fim de direcionar as medidas de polícia sanitária constantes da Decisão de Execução 2014/709/UE e impedir a continuação da propagação da peste suína africana, prevenindo ao mesmo tempo qualquer perturbação desnecessária do comércio na União e evitando a criação de barreiras injustificadas ao comércio por parte de países terceiros, é oportuno alterar a lista da União de zonas sujeitas a medidas de polícia sanitária estabelecida no anexo da referida decisão de execução, de modo a ter em conta as alterações na atual situação epidemiológica no que se refere a essa doença na Lituânia.

(4)	O anexo da Decisão de Execução 2014/709/UE deve, pois, ser alterado em conformidade.

(5)	As medidas previstas na presente decisão estão em conformidade com o parecer do Comité Permanente dos Vegetais, Animais e Alimentos para Consumo Humano e Animal,

ADOTOU A PRESENTE DECISÃO:

Artigo 1.o

O anexo da Decisão de Execução 2014/709/UE é substituído pelo texto constante do anexo da presente decisão.

Artigo 2.o

Os destinatários da presente decisão são os Estados-Membros.
