COMMON POSITION of 17 December 1996 defined by the Council on the basis of Article J.2 of the Treaty on European Union concerning the derogations from the embargo with regard to Iraq (96/741/EC) THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union, and in particular Article J.2 thereof, Having regard to resolutions 660, 661, 666, 670 (1990) and 687 (1991) adopted by the United Nations Security Council, Having regard to resolution 986 (1995) adopted by the United Nations Security Council on 14 April 1995 and the memorandum of understanding of 20 May 1996 between Iraq and the United Nations Secretary-General on the implementation of that resolution, HAS DEFINED THE FOLLOWING COMMON POSITION: Article 1 Within the framework of the embargo established with regard to Iraq in accordance with the provisions resolutions 660, 661, 666, 670 (1990) and 687 (1991) adopted by the United Nations Security Council, derogations are allowed in accordance with the provisions of resolution 986 (1995) adopted by the United Nations Security Council on 14 April 1995, in accordance with the memorandum of understanding of 20 May 1996 between Iraq and the United Nations Secretary-General as provided for in paragraph 13 of that resolution and with the procedures established by the Committee established by resolution 661 (1990). Article 2 This common position shall enter into force on the date of its adoption. It shall be published in the Official Journal. Done at Brussels, 17 December 1996. For the Council The President I.
