REGULATION ( EEC ) N 2940/73 OF THE COMMISSION OF 29 OCTOBER 1973 AMENDING REGULATION ( EEC ) N 756/70 ON GRANTING AID FOR SKIMMED MILK PROCESSED INTO CASEIN AND CASEINATES THE COMMISSION OF THE EUROPEAN COMMUNITIES , HAVING REGARD TO THE TREATY ESTABLISHING THE EUROPEAN ECONOMIC COMMUNITY ; HAVING REGARD TO COUNCIL REGULATION ( EEC ) N 804/68 ( 1 ) OF 27 JUNE 1968 ON THE COMMON ORGANIZATION OF THE MARKET IN MILK AND MILK PRODUCTS , AS LAST AMENDED BY THE ACT ( 2 ) CONCERNING THE CONDITIONS OF ACCESSION AND THE ADJUSTMENTS TO THE TREATIES , AND IN PARTICULAR ARTICLE 11 ( 3 ) THEREOF ; WHEREAS COMMISSION REGULATION ( EEC ) N 756/70 ( 3 ) OF 24 APRIL 1970 ON GRANTING AID FOR SKIMMED MILK PROCESSED INTO CASEIN AND CASEINATES , AS LAST AMENDED BY REGULATION ( EEC ) N 1399/73 ( 4 ) , DEFINES CASEIN AND CASEINATES FOR WHOSE MANUFACTURE AID IS GRANTED ON THE SKIMMED MILK UTILIZED ; WHEREAS , IN ORDER TO TAKE ACCOUNT OF THE CHANGE IN MANUFACTURING TECHNIQUES WHICH WIDEN THE RANGE OF USAGE , IT IS APPROPRIATE TO SUPPLEMENT THE LIST OF PRODUCTS CONCERNED ; WHEREAS THE COMPOSITION OF CERTAIN CASEINS AND CASEINATES SET OUT IN THIS LIST SHOULD ACCORDINGLY BE DEFINED ; WHEREAS THE MEASURES PROVIDED FOR IN THIS REGULATION ARE IN ACCORDANCE WITH THE OPINION OF THE MANAGEMENT COMMITTEE FOR MILK AND MILK PRODUCTS , HAS ADOPTED THIS REGULATION : ARTICLE 1 1 . IN ARTICLE 2 ( 2 ) OF REGULATION ( EEC ) N 756/70 : _ THE FOLLOWING SUBPARAGRAPHS ARE INSERTED AFTER THE PROVISION ( D ) : " ( E ) 1 KILOGRAMME OF CASEIN DEFINED IN ANNEX III HAS BEEN MANUFACTURED FROM 27 * 75 KILOGRAMMES OF SKIMMED MILK ; ( F ) 1 KILOGRAMME OF CASEINATE DEFINED IN ANNEX III HAS BEEN MANUFACTURED FROM 31 * 75 KILOGRAMMES OF SKIMMED MILK . " _ THE PHRASE " IN ( A ) TO ( D ) " IN THE LAST SUBPARAGRAPH IS REPLACED BY " IN ( A ) TO ( F ) " . 2 . IN ANNEX I AND II OF REGULATION ( EEC ) N 756/70 , THE FOLLOWING TITLE IS ADDED : " CASEIN AND CASEINATES SET OUT BELOW SHALL HAVE A MILK PROTEIN CONTENT , OTHER THAN CASEIN , NOT EXCEEDING 5 % OF THE TOTAL MILK PROTEIN CONTENT . IT SHALL APPLY ONLY TO CASEINS AND CASEINATES WHICH ARE MANUFACTURED AS FROM THIS DATE . THIS REGULATION SHALL BE BINDING IN ITS ENTIRETY AND DIRECTLY APPLICABLE IN ALL MEMBER STATES .
