Wyniki przeglądu wniosków legislacyjnych nierozstrzygniętych przez prawodawcę

Zgodnie z komunikatem z dnia 16 marca 2005 r. w sprawie „Poprawy otoczenia regulacyjnego w dziedzinie wzrostu gospodarczego i zatrudnienia w Unii Europejskiej”[1] Komisja podjęła decyzję o kontynuacji tego podejścia w działaniach zapewniających jakość prawodawstwa w Europie poprzez wspieranie celów wyznaczonych w ramach partnerstwa na rzecz wzrostu gospodarczego i zatrudnienia.

W celu zwiększenia europejskiej konkurencyjności, otoczenie regulacyjne w Unii Europejskiej powinno być na możliwie najwyższym poziomie. Aby osiągnąć ten cel „wspólnotowy dorobek prawny” czyli zbiór obowiązujących aktów prawnych powinien być uproszczony i w razie konieczności zaktualizowany, w związku z czym przewidziano szereg środków, w tym zwłaszcza uruchomienie w październiku 2005 r. kolejnego etapu programu upraszczania.

Komisja postanowiła również, że lepsze stanowienie prawa musi być włączone do planowania polityki oraz, że nowe wnioski legislacyjne przedstawione przez Komisję muszą wspierać lepsze stanowienie prawa i przyczyniać się do zwiększenia konkurencyjności. W praktyce jest to realizowane zwłaszcza poprzez obowiązek poddawania nowych inicjatyw legislacyjnych ocenie wpływu zgodnie z programem legislacyjnym i programem działań Komisji na rok 2005, dla których niedawno przyjęte zostały wyczerpujące i szczegółowe wytyczne[2].

W odniesieniu do wniosków przedstawionych wcześniej przez Komisję i wniosków będących w trakcie procesu legislacyjnego, w komunikacie z marca stwierdzono, że Komisja zamierza „dokonać przeglądu wniosków, które czekają na rozstrzygnięcie przez Radę/Parlament pod względem ich ogólnego znaczenia, ich wpływu na konkurencyjność i innych skutków”. W niniejszym komunikacie przedstawione są cele, proces i wyniki pierwszego przeprowadzonego przeglądu tego rodzaju.

1. Cele przeglądu nierozstrzygniętych wniosków

Celem przeglądu było umożliwienie Komisji zapewnienia, że wszystkie nierozstrzygnięte wnioski legislacyjne są w pełni zgodne z priorytetami politycznymi Komisji oraz sprawdzenie czy zmiana okoliczności uzasadnia przegląd początkowego podejścia.

W przypadku, gdy przegląd uznany został za konieczny, kontrola również wykazała, że należy podjąć odpowiednie środki takie jak zmiana, zastąpienie lub wycofanie nierozstrzygniętych wniosków oraz poprawa oceny ich wpływu.

Celem kontroli było w szczególności zbadanie nierozstrzygniętych wniosków w trzech płaszczyznach:

Po pierwsze, nierozstrzygnięte wnioski zostały zbadane pod względem ich zgodności z celami strategii lizbońskiej, a zwłaszcza celu związanego z promowaniem konkurencyjności. Przy ocenie wniosków pod tym względem wykorzystano kryteria określone w „teście konkurencyjności” stanowiącym część zweryfikowanych ostatnio wytycznych dotyczących oceny wpływu[3].

Po drugie, nierozstrzygnięte wnioski zostały sprawdzone pod względem ewentualnego braku znaczącego postępu w procesie legislacyjnym w ciągu stosunkowo długiego okresu czasu. W takich przypadkach zbadane zostały również przeszkody, które przyczyniły się do spowolnienia procesu legislacyjnego oraz możliwości ich usunięcia.

Po trzecie, nierozstrzygnięte wnioski zostały zbadane w celu określenia czy są one zgodne z obecnymi wymaganiami w zakresie lepszego stanowienia prawa, ze szczególnym uwzględnieniem właściwej oceny wpływu. Kryterium to dotyczy przede wszystkim wniosków, które zostały przedłożone w chwili, gdy ocena wpływu nie była oficjalnie wymagana.

2. Przebieg przeglądu

W chwili rozpoczęcia przeglądu w kwietniu 2005 r. całkowita liczba wszystkich nierozstrzygniętych wniosków wynosiła 489[4]. Zakres przeglądu określony w komunikacie z marca został wyraźnie ograniczony do wniosków nierozstrzygniętych przed dniem 1 stycznia 2004 r. i objął 183 wnioski.

Wnioski te zostały poddane dokładnej analizie, w wyniku której ustalono, że około 100 wniosków stanowi rzeczywiście nową inicjatywę legislacyjną i że zostały one następnie ocenione pod względem ich ewentualnego niekorzystnego wpływu na konkurencyjność i szerzej pojętych aspektów ekonomicznych. Pozostałe wnioski mogą mieć znikomy lub nie mieć żadnego wpływu na konkurencyjność. Odnosi się to głównie do wniosków wynikających z międzynarodowych zobowiązań lub dostosowujących wspólnotowy dorobek prawny do postępów w nauce i technice. Niektóre z tych wniosków również bezpośrednio przyczyniają się do „lepszego stanowienia prawa” kodyfikując i upraszczając wspólnotowy dorobek prawny.

3. Wyniki przeglądu

W następstwie szczegółowej analizy wszystkich oczekujących na rozstrzygnięcie wniosków Komisja przewiduje dwa rodzaje działań o szerokim zasięgu:

(1) Wycofanie wniosków. Komisja zamierza wycofać ogółem 68 wniosków. Wnioski te uznane są za niezgodne z celami strategii lizbońskiej lub zasadami lepszego stanowienia prawa, bądź nie wykazano w odniesieniu do nich znaczących postępów w procesie legislacyjnym lub są one już bezprzedmiotowe[5] (tzn. zamierzone cele są osiągane lub będą osiągnięte przy zastosowaniu innych środków). Niektóre z tych wniosków mogą być ponownie rozpatrzone w świetle dalszej analizy. Komisja zamierza ponownie rozważyć, czy w niektórych przypadkach interwencja legislacyjna jest niezbędna, z uwzględnieniem wyników pełnej oceny wpływu.

(2) Wnioski, których proces legislacyjny będzie kontynuowany i których analiza ekonomiczna będzie przedłożona władzom legislacyjnym do oceny[6]. Dotyczy to 5 wniosków, o słuszności których Komisja jest przekonana, lecz w przypadku których dodatkowe przedstawienie analizy wpływu prawdopodobnie ułatwi władzom legislacyjnym podejmowanie decyzji.

W wyniku przeglądu przeprowadzonego przez Komisję w sumie 73 nierozstrzygnięte wnioski podlegać będą niektórym formom interwencji. Obejmuje to wnioski, które nie są w pełni zgodne z celami konkurencyjności i których dalsza analiza ekonomiczna będzie musiała być przedstawiona prawodawcy do oceny, a także wnioski w przypadku których nie wykazano znaczących postępów w procesie legislacyjnym lub które się zdezaktualizowały.

Do dnia 1 stycznia 2004 r. Komisja wycofała 31 %[7] wszystkich nierozstrzygniętych wniosków. Wszystkie interwencje, w tym wnioski będące przedmiotem kolejnej analizy ekonomicznej, stanowią 33 %[8] nierozstrzygniętych wniosków.

Ponadto w przypadku co najmniej 2 wniosków przegląd wykazał, iż nie odpowiadają one bezpośrednio wymienionym powyżej kategoriom. Po pierwsze w odniesieniu do wniosku dotyczącego dyrektywy Rady w sprawie minimalnych wymagań w dziedzinie bezpieczeństwa i ochrony zdrowia dotyczących narażenia pracowników na ryzyko spowodowane czynnikami fizycznymi - promieniowanie optyczne, 1992/0449/COD, na podstawie przeglądu Komisja stwierdziła, że aspekty związane z narażeniem pracowników na promieniowanie optyczne powinny zostać usunięte zgodnie również z propozycją Parlamentu Europejskiego.

Po drugie, w odniesieniu do wniosku w sprawie pracowników tymczasowych (2002/0072/COD) Komisja wstrzymuje się z ponownym rozpatrzeniem wniosku w świetle przyszłych dyskusji na temat innych wniosków.

Załącznik do niniejszego komunikatu zawiera podsumowanie sytuacji i szczegółowe informacje dotyczące omawianych wniosków.

Wnioski

Przegląd nierozstrzygniętych wniosków jest pierwszym pełnym przeglądem przeprowadzonym przez Komisję. Jest on potwierdzeniem zobowiązania Komisji Europejskiej dotyczącego partnerstwa na rzecz wzrostu gospodarczego i zatrudnienia oraz zapewnienia surowego przestrzegania w praktyce zasad lepszego stanowienia prawa.

Działania podjęte w wyniku przeglądu, tzn. planowane interwencje w sprawie nierozstrzygniętych wniosków, o których mowa w załączniku, mają na celu pozytywne oddziaływanie na realizację celów strategii lizbońskiej poprzez wspieranie konkurencyjności, na tworzenie lepszego otoczenia regulacyjnego oraz eliminowanie wniosków, które nie mają szansy na przyjęcie lub się zdezaktualizowały.

Wycofanie nierozstrzygniętych wniosków odbędzie się, w niektórych przypadkach, w ramach całościowego przeglądu polityk lub w celu ponownego rozpatrzenia wniosków w świetle nowych elementów polityki i pełnej oceny wpływu.

Zgodnie ze zobowiązaniami podjętymi w ramach Porozumienia ramowego dotyczącego stosunków pomiędzy Parlamentem Europejskim i Komisją (ust. 32), niniejszym Komisja zawiadamia Parlament i Radę przed wycofaniem złożonych przez siebie wniosków.

[4] Istotnie, Komisja ka|[pic]dego roku staje w obliczu aktualizacji - wspólnotowego dorobku prawnego , rozpatruj[pic]c okoB[pic]o 200-250 wniosków w ramach mi[pic]dzynarodowych zobowi[pic]zaD[pic] UE, i/lub wypeB[pic]nienia zobowi[pic]zaD[pic] wobeIstotnie, Komisja każdego roku staje w obliczu aktualizacji „wspólnotowego dorobku prawnego”, rozpatrując około 200-250 wniosków w ramach międzynarodowych zobowiązań UE, i/lub wypełnienia zobowiązań wobec prawodawcy.

[5] Komisja systematycznie wycofywała wnioski, co zmniejszyło liczbę nierozstrzygniętych wniosków. W 1997 r. wycofane zostały 34 wnioski, w 1999 r. - 58, w 2001 r. - 108 i w 2004 r. - 102.

[6] Gazy fluorowane, transport odpadów, podpisanie umowy o przenośnym wyposażeniu samolotów, pośrednicy turystyczni podlegający VAT oraz współpraca administracyjna w dziedzinie podatku VAT, efektywność wykorzystania energii przez odbiorców końcowych oraz usługi energetyczne.

7 Spośród wszystkich 68 wycofanych wniosków, 12 wniosków Komisja przyjęła w 2004 r.
