UITVOERINGSVERORDENING (EU) 2024/1748 VAN DE COMMISSIE

van 21 juni 2024

tot wijziging van Uitvoeringsverordening (EU) 2021/1378 van de Commissie wat betreft de erkenning van bepaalde controleorganen overeenkomstig artikel 46 van Verordening (EU) 2018/848 van het Europees Parlement en de Raad als zijnde bevoegd om in derde landen controles uit te voeren en biologische certificaten af te geven met het oog op de invoer van biologische producten in de Unie

DE EUROPESE COMMISSIE,

Gezien het Verdrag betreffende de werking van de Europese Unie,

Gezien Verordening (EU) 2018/848 van het Europees Parlement en de Raad van 30 mei 2018 inzake de biologische productie en de etikettering van biologische producten en tot intrekking van Verordening (EG) nr. 834/2007 van de Raad (1), en met name artikel 46, lid 1,

Overwegende hetgeen volgt:

Bijlage II bij Uitvoeringsverordening (EU) 2021/1378 van de Commissie (2) bevat de lijst van controleautoriteiten en controleorganen die overeenkomstig artikel 46, lid 1, van Verordening (EU) 2018/848 zijn erkend als zijnde bevoegd om in derde landen controles uit te voeren en biologische certificaten af te geven met het oog op de invoer van biologische producten in de Unie overeenkomstig artikel 45, lid 1, punt b), i), van laatstgenoemde verordening.

Artikel 46, lid 2, van Verordening (EU) 2018/848 schrijft voor aan welke criteria de controleautoriteiten en controleorganen moeten voldoen om te worden erkend overeenkomstig artikel 46, lid 1, van die verordening. Gedelegeerde Verordening (EU) 2021/1698 van de Commissie (3) bevat de procedurele voorschriften waaraan die controleautoriteiten en controleorganen moeten voldoen wanneer zij bij de Commissie een erkenningsverzoek indienen, dat uit een technisch dossier bestaat.

Sinds de vaststelling van Uitvoeringsverordening (EU) 2021/1378 heeft de Commissie van een aantal controleorganen erkenningsverzoeken ontvangen die overeenkomstig artikel 46, lid 4, van Verordening (EU) 2018/848 zijn ingediend.

De Commissie heeft de erkenningsverzoeken van “bio.inspecta AG”, “Caucascert LLC”, “CCPB Srl”, “Ceres Certification of Environmental Standards GmbH”, “Certimex, Certificadora Mexicana de Productos y Procesos Ecologicos S.C.”, “Control Union Certifications B.V.”, “Ecocert SAS”, “Ecoglobe LLC”, “Food Safety SA”, “IMO Control Private Limited”, “Kiwa BCS Öko-Garantie GmbH”, “Mayacert SA”, “Organic Control System LLC Subotica”, “Organic Standard LLC”, “Servicio de Certificación CAAE S.L.U.”, “Southern Cross Certified Australia Pty Ltd” en “Tse-Xin Organic Certification Corporation” overeenkomstig artikel 1 van Gedelegeerde Verordening (EU) 2021/1698 ontvangen en onderzocht. Op basis van de informatie in hun technische dossiers is de Commissie tot de conclusie gekomen dat die controleorganen voor bepaalde productcategorieën in bepaalde derde landen voor onbepaalde tijd moeten worden erkend.

Uitvoeringsverordening (EU) 2021/1378 moet daarom dienovereenkomstig worden gewijzigd.

De maatregelen van deze verordening zijn in overeenstemming met het advies van het Comité voor de biologische productie,

HEEFT DE VOLGENDE VERORDENING VASTGESTELD:

Artikel 1

Bijlage II bij Uitvoeringsverordening (EU) 2021/1378 wordt gewijzigd overeenkomstig de bijlage bij de onderhavige verordening.

Artikel 2

Deze verordening treedt in werking op de derde dag na die van de bekendmaking ervan in het Publicatieblad van de Europese Unie.

Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke lidstaat.
