De Commissie vestigt de aandacht op het arrest „CIA Security” van 30 april 1996 in zaak C-194/94 (Jur. 1996, blz. I-2201), waarin het Hof van Justitie een interpretatie van de artikelen 8 en 9 van Richtlijn 98/34/EG (voorheen 83/189/EEG) geeft die inhoudt dat derden zich erop kunnen beroepen bij de nationale rechter; deze dient de toepassing van een niet overeenkomstig de richtlijn aangemeld nationaal technisch voorschrift te weigeren.

Met dit arrest wordt de mededeling van de Commissie van 1 oktober 1986 (PB C 245 van 1.10.1986, blz. 4) bevestigd.

Het feit dat niet aan de verplichting tot kennisgeving is voldaan, impliceert dus dat de desbetreffende technische voorschriften niet kunnen worden toegepast jegens derden.
