ter uitvoering van Richtlijn 94/28/EG wat betreft een lijst van erkende instanties in derde landen voor het bijhouden van een stamboek of register voor bepaalde dieren

DE COMMISSIE VAN DE EUROPESE GEMEENSCHAPPEN,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap,

Gelet op Richtlijn 94/28/EG van de Raad van 23 juni 1994 tot vaststelling van de beginselen inzake de zoötechnische en genealogische voorschriften voor de invoer uit derde landen van dieren, alsmede van sperma, eicellen en embryo's en tot wijziging van Richtlijn 77/504/EEG betreffende raszuivere fokrunderen ( 1 ), en met name op artikel 3, lid 1,

Overwegende hetgeen volgt:

(1)	Richtlijn 94/28/EG bevat de beginselen inzake de zoötechnische en genealogische voorschriften voor de invoer uit derde landen van bepaalde raszuivere dieren, alsmede van sperma, eicellen en embryo's daarvan.

(2)

Krachtens Richtlijn 94/28/EG en onverminderd de Gemeenschapswetgeving inzake de diergezondheid en de volksgezondheid mogen dieren slechts als „raszuiver” of „hybride” worden ingevoerd als aan bepaalde voorwaarden wordt voldaan. Onder meer moeten de dieren worden ingeschreven of geregistreerd in een stamboek of register dat wordt bijgehouden door een instantie zoals in de richtlijn omschreven en mogen sperma, eicellen en embryo's alleen worden ingevoerd als zij afkomstig zijn van een dier dat in zo'n stamboek of register is ingeschreven of geregistreerd.

(3)	Argentinië, Bulgarije, Canada, IJsland, Israël, Nieuw-Zeeland en de Verenigde Staten hebben de Commissie een lijst verstrekt van instanties die zij hebben erkend voor het bijhouden van een stamboek of register van raszuivere dieren met het oog op invoer krachtens Richtlijn 94/28/EG.

(4)	De lijst van erkende autoriteiten voor het bijhouden van een stamboek of register voor de in deze beschikking bedoelde dieren en producten moet dus met het oog op de toepassing van Richtlijn 94/28/EG worden vastgesteld.

(5)	De in deze beschikking vervatte maatregelen zijn in overeenstemming met het advies van het Permanent Zoötechnisch Comité,

HEEFT DE VOLGENDE BESCHIKKING GEGEVEN:

Voor de toepassing van Richtlijn 94/28/EG wordt in de bijlage de lijst vastgesteld van instanties die erkend zijn voor het bijhouden van een stamboek of register voor raszuivere fokrunderen, fokvarkens, fokschapen en fokgeiten, alsmede hybride fokvarkens, en van sperma, eicellen en embryo's daarvan.

De lidstaten staan de invoer van raszuivere fokrunderen, fokvarkens, fokschapen en fokgeiten, alsmede hybride fokvarkens, en van sperma, eicellen en embryo's daarvan slechts toe als zij zijn ingeschreven of geregistreerd in een stamboek of register dat wordt bijgehouden door een in de bijlage opgenomen instantie.
