tot wijziging van de bijlage bij Uitvoeringsbesluit (EU) 2023/2447 betreffende bepaalde noodmaatregelen in verband met uitbraken van hoogpathogene aviaire influenza in bepaalde lidstaten

DE EUROPESE COMMISSIE,
Gezien het Verdrag betreffende de werking van de Europese Unie,
Gezien Verordening (EU) 2016/429 van het Europees Parlement en de Raad van 9 maart 2016 betreffende overdraagbare dierziekten en tot wijziging en intrekking van bepaalde handelingen op het gebied van diergezondheid (“diergezondheidswetgeving”) (1), en met name artikel 259, lid 1, punt c),
Overwegende hetgeen volgt:

Hoogpathogene aviaire influenza (HPAI) is een besmettelijke virale ziekte bij vogels die ernstige gevolgen kan hebben voor de rentabiliteit van pluimveehouderijen en die de handel binnen de Unie en de uitvoer naar derde landen verstoort. HPAI-virussen kunnen trekvogels besmetten, die deze virussen vervolgens tijdens hun trek in de herfst en in de lente over lange afstanden kunnen verspreiden. De aanwezigheid van HPAI-virussen bij wilde vogels vormt derhalve een voortdurende bedreiging wat betreft de directe en indirecte insleep van deze virussen in bedrijven waar pluimvee of in gevangenschap levende vogels worden gehouden. Bij een uitbraak van HPAI bestaat het risico dat de ziekteverwekker wordt verspreid naar andere bedrijven waar pluimvee of in gevangenschap levende vogels worden gehouden. |

Bij Verordening (EU) 2016/429 is het wetgevingskader vastgesteld voor de preventie en bestrijding van ziekten die kunnen worden overgedragen op dieren of mensen. HPAI valt onder de definitie van een in de lijst in die verordening opgenomen ziekte en is onderworpen aan de daarin vastgestelde regels inzake ziektepreventie en -bestrijding. Daarnaast vormt Gedelegeerde Verordening (EU) 2020/687 van de Commissie (2) een aanvulling op Verordening (EU) 2016/429 wat de regels voor de preventie en bestrijding van bepaalde in de lijst opgenomen ziekten betreft, waaronder ziektebestrijdingsmaatregelen voor HPAI. |

Uitvoeringsbesluit (EU) 2023/2447 van de Commissie (3) is op 24 oktober 2023 door de Commissie vastgesteld op basis van Verordening (EU) 2016/429 en bevat noodmaatregelen op het niveau van de Unie in verband met uitbraken van HPAI. |

Met name is in Uitvoeringsbesluit (EU) 2023/2447 bepaald dat de naar aanleiding van uitbraken van HPAI door de betroffen lidstaten overeenkomstig Gedelegeerde Verordening (EU) 2020/687 in te stellen beschermings-, bewakings- en extra beperkingszones ten minste de gebieden moeten omvatten die in de lijst van de bijlage bij dat uitvoeringsbesluit als beschermings-, bewakings- en extra beperkingszones zijn opgenomen. |

Naar aanleiding van verdere uitbraken van HPAI in inrichtingen waar pluimvee werd gehouden in Duitsland, Italië, Hongarije en Polen, die in de bijlage bij Uitvoeringsbesluit (EU) 2023/2447 moesten worden weerspiegeld, is die bijlage onlangs bij Uitvoeringsbesluit (EU) 2025/124 van de Commissie (4) gewijzigd. |

Sinds de datum waarop Uitvoeringsbesluit (EU) 2025/124 is vastgesteld, hebben Italië, Polen en Portugal de Commissie in kennis gesteld van verdere uitbraken van HPAI in inrichtingen waar pluimvee of in gevangenschap levende vogels werden gehouden, in de regio’s Lombardije en Veneto in Italië, in de woiwodschappen Ermland-Mazurië en Subkarpaten in Polen en in het district Lissabon in Portugal. |

Italië, Polen en Portugal hebben de nodige ziektebestrijdingsmaatregelen genomen overeenkomstig Gedelegeerde Verordening (EU) 2020/687, waaronder de instelling van beschermings- en bewakingszones rond de uitbraken. |

De Commissie heeft de door Italië, Polen en Portugal genomen ziektebestrijdingsmaatregelen bestudeerd en heeft geconstateerd dat de grenzen van de door die lidstaten ingestelde beschermings- en bewakingszones op voldoende afstand liggen van de inrichtingen waar uitbraken van HPAI zijn bevestigd. |

Om te voorkomen dat de handel in de Unie onnodig wordt verstoord en om te vermijden dat derde landen ongerechtvaardigde handelsbelemmeringen opwerpen, moeten de door Italië, Polen en Portugal overeenkomstig Gedelegeerde Verordening (EU) 2020/687 ingestelde beschermings- en bewakingszones in samenwerking met die lidstaten snel worden vastgesteld op het niveau van de Unie. |

Daarom moeten de voor Italië, Polen en Portugal in de bijlage bij Uitvoeringsbesluit (EU) 2023/2447 opgenomen beschermings- en bewakingszones worden geactualiseerd. |

(11) |
De bijlage bij Uitvoeringsbesluit (EU) 2023/2447 moet daarom worden gewijzigd om de regionalisering op het niveau van de Unie te actualiseren en om rekening te houden met de overeenkomstig Gedelegeerde Verordening (EU) 2020/687 door Italië, Polen en Portugal ingestelde beschermings- en bewakingszones, alsook om de duur van de daarin geldende maatregelen aan te geven. |

(12) |
Uitvoeringsbesluit (EU) 2023/2447 moet daarom dienovereenkomstig worden gewijzigd. |
|
(13) |
Gezien de urgentie van de epidemiologische situatie in de Unie wat de verspreiding van HPAI betreft, is het belangrijk dat de wijzigingen die bij dit besluit in Uitvoeringsbesluit (EU) 2023/2447 worden aangebracht, zo spoedig mogelijk in werking treden. |

De in dit besluit vervatte maatregelen zijn in overeenstemming met het advies van het Permanent Comité voor planten, dieren, levensmiddelen en diervoeders, |
HEEFT HET VOLGENDE BESLUIT VASTGESTELD:
Artikel 1
De bijlage bij Uitvoeringsbesluit (EU) 2023/2447 wordt vervangen door de tekst in de bijlage bij dit besluit.
Artikel 2
Dit besluit is gericht tot de lidstaten.

Voor de toepassing van deze bijlage wordt, overeenkomstig het Akkoord inzake de terugtrekking van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland uit de Europese Unie en de Europese Gemeenschap voor Atoomenergie, en met name artikel 5, lid 4, van het Windsor-kader (zie Gezamenlijke Verklaring nr. 1/2023 van de Unie en het Verenigd Koninkrijk in het bij het Akkoord inzake de terugtrekking van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland uit de Europese Unie en de Europese Gemeenschap voor Atoomenergie ingestelde Gemengd Comité van 24 maart 2023 (PB L 102 van 17.4.2023, blz. 87)), in samenhang met bijlage 2 bij dat kader, bij verwijzingen naar de lidstaten ook het Verenigd Koninkrijk met betrekking tot Noord-Ierland bedoeld. |
