IL-KUMMISSJONI EWROPEA,
Wara li kkunsidrat it-Trattat dwar il-Funzjonament tal-Unjoni Ewropea,
Wara li kkunsidrat ir-Regolament (UE) 2016/429 tal-Parlament Ewropew u tal-Kunsill tad-9 ta’ Marzu 2016 dwar il-mard trażmissibbli tal-annimali u li jemenda u jħassar ċerti atti fil-qasam tas-saħħa tal-annimali (“Liġi dwar is-Saħħa tal-Annimali”) (1), u b’mod partikolari l-Artikolu 259(1) tiegħu,
Billi:

Il-marda tal-ilsien u d-dwiefer hija marda virali infettiva li taffettwa lill-annimali mammiferi tal-ordnijiet Artiodactyla u Proboscidea u li jista’ jkollha impatt serju fuq il-popolazzjoni tal-annimali kkonċernata u fuq il-profittabbiltà tat-trobbija tal-annimali, u dan jikkawża tfixkil fil-movimenti tal-kunsinni ta’ dawk l-annimali u tal-prodotti tagħhom fl-Unjoni u fl-esportazzjonijiet lejn pajjiżi terzi. F’każ ta’ tifqigħa tal-marda tal-ilsien u d-dwiefer fl-annimali, hemm riskju serju li dik il-marda tinxtered fi stabbilimenti oħra li jżommu l-annimali tal-ispeċijiet elenkati, kif stabbilit fl-Anness tar-Regolament ta’ Implimentazzjoni tal-Kummissjoni (UE) 2018/1882 (2) (l-ispeċijiet elenkati). |

Ir-Regolament Delegat tal-Kummissjoni (UE) 2020/687 (3) jissupplimenta r-regoli għall-kontroll tal-mard elenkat imsemmi fl-Artikolu 9(1), il-punti (a), (b) u (c), tar-Regolament (UE) 2016/429, u ddefinit bħala mard tal-kategoriji A, B u C fir-Regolament ta’ Implimentazzjoni (UE) 2018/1882. B’mod partikolari, l-Artikoli 21 u 22 tar-Regolament Delegat (UE) 2020/687 jipprevedu l-istabbiliment ta’ żona ristretta f’każ ta’ tifqigħa ta’ marda tal-kategorija A, inkluż il-marda tal-ilsien u d-dwiefer, kif ukoll ċerti miżuri li jridu jiġu applikati fiha. Barra minn hekk, l-Artikolu 21(1) ta’ dak ir-Regolament Delegat jipprevedi li ż-żona ristretta trid tkun tinkludi żona ta’ protezzjoni u żona ta’ sorveljanza, u, jekk ikun meħtieġ, żoni ristretti ulterjuri madwar iż-żoni ta’ protezzjoni u ta’ sorveljanza jew maġenbhom. |

Id-Deċiżjoni ta’ Implimentazzjoni tal-Kummissjoni (UE) 2026/582 (4) ġiet adottata abbażi tar-Regolament (UE) 2016/429, u tistabbilixxi ċerti miżuri ta’ emerġenza relatati mat-tifqigħat tal-marda tal-ilsien u d-dwiefer fi stabbilimenti li jżommu l-annimali ruminanti fid-distretti ta’ Larnaca u Nikosija f’Ċipru. B’mod aktar partikolari, id-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582 tipprevedi li Ċipru jrid jistabbilixxi żoni ristretti, li jinkludu żoni ta’ protezzjoni u ta’ sorveljanza, kif ukoll żona ristretta ulterjuri, f’konformità mal-Artikolu 21 tar-Regolament Delegat (UE) 2020/687, fejn il-miżuri li jeħtieġ jiġu applikati fiż-żoni ta’ protezzjoni u ta’ sorveljanza, u fiż-żona ristretta ulterjuri, iridu japplikaw imqar sad-dati elenkati fl-Anness ta’ dik id-Deċiżjoni ta’ Implimentazzjoni, u li ż-żoni ta’ protezzjoni u ta’ sorveljanza, kif ukoll iż-żona ristretta ulterjuri, iridu jinkludu mqar iż-żoni elenkati f’dak l-Anness. Id-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582 ġiet emendata l-aħħar bid-Deċiżjoni ta’ Implimentazzjoni tal-Kummissjoni (UE) 2026/782 (5). |

Mill-adozzjoni tad-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/782 ’l hawn, il-miżuri ta’ emerġenza li jeħtieġ jiġu applikati fiż-żoni ta’ protezzjoni u ta’ sorveljanza u fiż-żona ristretta ulterjuri elenkati fl-Anness tagħha, u l-iskeda ta’ żmien għall-applikazzjoni tagħhom, ġew rieżaminati abbażi tal-informazzjoni provduta minn Ċipru, b’mod partikolari fir-rigward tad-dati tat-tindif u tad-diżinfezzjoni preliminari tal-istabbilimenti affettwati, li jeħtieġ jitwettqu f’konformità mar-Regolament Delegat (UE) 2020/687. B’konsegwenza ta’ dan, id-durata tal-miżuri ta’ emerġenza f’dawk iż-żoni ta’ protezzjoni u ta’ sorveljanza trid tiġi eżaminata mill-ġdid. |

Barra minn hekk, wara l-adozzjoni tad-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/782 kien hemm aktar tifqigħat tal-marda tal-ilsien u d-dwiefer fi stabbilimenti fid-distretti ta’ Larnaca u Nikosija f’Ċipru, inkluż barra miż-żoni li bħalissa huma elenkati bħala żoni ta’ protezzjoni u ta’ sorveljanza fl-Anness tad-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582. |

Għaldaqstant, minħabba s-sitwazzjoni epidemjoloġika attwali fir-rigward tal-marda tal-ilsien u d-dwiefer f’Ċipru, u sabiex jiġi evitat li dik il-marda tkompli tinxtered f’dak l-Istat Membru, jew fi Stati Membri oħra jew f’pajjiżi terzi, jeħtieġ jiġu rieżaminati b’mod urġenti ż-żoni li bħalissa huma elenkati bħala żoni ta’ protezzjoni, żoni ta’ sorveljanza jew żoni ristretti ulterjuri fl-Anness tad-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582 biex jiġu adattati kemm fl-ispazju kif ukoll fiż-żmien, meta jkun meħtieġ, kif ukoll biex jiġu stabbiliti żoni ta’ protezzjoni u ta’ sorveljanza ġodda billi jitqiesu t-tifqigħat l-aktar riċenti f’Ċipru. Dan huwa meħtieġ ukoll sabiex jiġi evitat kwalunkwe tfixkil bla bżonn fil-kummerċ fl-Unjoni, biex tiġi evitata l-impożizzjoni ta’ ostakli mhux ġustifikati għall-kummerċ minn pajjiżi terzi. |

Għalhekk, jenħtieġ li d-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582 tiġi emendata kif xieraq. |

Il-miżuri previsti f’din id-Deċiżjoni huma f’konformità mal-opinjoni tal-Kumitat Permanenti dwar il-Pjanti, l-Annimali, l-Ikel u l-Għalf, |

Artikolu 1
L-Anness tad-Deċiżjoni ta’ Implimentazzjoni (UE) 2026/582 huwa sostitwit bit-test stabbilit fl-Anness ta’ din id-Deċiżjoni.
Artikolu 2
Din id-Deċiżjoni hija indirizzata lir-Repubblika ta’ Ċipru.
