IL-KUMMISSJONI EWROPEA,
Wara li kkunsidrat it-Trattat dwar il-Funzjonament tal-Unjoni Ewropea,
Wara li kkunsidrat id-Direttiva (UE) 2016/797 tal-Parlament Ewropew u tal-Kunsill tal-11 ta' Mejju 2016 dwar l-interoperabilità tas-sistema ferrovjarja fl-Unjoni Ewropea (1), u b'mod partikolari l-Artikolu 5(11) tagħha,
Billi:

L-Artikolu 19 tar-Regolament (UE) 2016/796 tal-Parlament Ewropew u tal-Kunsill (2) jeħtieġ li l-Aġenzija tal-Unjoni Ewropea għall-Ferroviji (l-“Aġenzija”) tindirizza rakkomandazzjonijiet lill-Kummissjoni dwar l-ispeċifikazzjonijiet tekniċi għall-interoperabilità (“TSIs”) u r-reviżjoni tagħhom, skont l-Artikolu 5 tad-Direttiva (UE) 2016/797, u li tiżgura li t-TSIs jiġu adattati għall-progress tekniku, ix-xejriet tas-suq u l-ħtiġijiet soċjali. |

L-Artikolu 3(5)(c) tad-Deċiżjoni Delegata tal-Kummissjoni (UE) 2017/1474 (3) jeħtieġ li t-TSIs jiġu riveduti biex jingħalqu l-punti miftuħa li jifdal. |

Fit-22 ta' Settembru 2017, il-Kummissjoni talbet lill-Aġenzija biex toħroġ rakkomandazzjonijiet skont il-paragrafu 2 tal-Artikolu 5 tad-Direttiva (UE) 2016/797 għar-reviżjoni tat-TSI relatata mas-subsistema tal-“enerġija” tas-sistema ferrovjarja fl-Unjoni (“ENE TSI”), u tat-TSI relatata mas-subsistema tal-“vetturi ferrovjarji — lokomotivi u vetturi ferrovjarji għat-trasport tal-passiġġieri” tas-sistema ferrovjarja fl-Unjoni (“LOC&PAS TSI”). |

Jenħtieġ li l-Anness tar-Regolament tal-Kummissjoni (UE) Nru 1301/2014 (4) jiġi emendat sabiex jingħalaq il-punt li jindirizza l-ispeċifikazzjoni relatata mal-protokolli tal-interfaċċa bejn is-sistema tal-kejl tal-enerġija (“EMS”) u s-sistema tal-ġbir tad-dejta u biex tittejjeb iċ-ċarezza tat-test. |

Jenħtieġ li l-Anness tar-Regolament tal-Kummissjoni (UE) Nru 1302/2014 (5) relatat mal-EMS jiġi emendat sabiex tiġi żgurata l-koerenza bejn iż-żewġ TSIs. |

Fl-4 ta' Ottubru 2017, l-Aġenzija ħarġet rakkomandazzjoni dwar l-emendi għar-Regolament (UE) Nru 1301/2014. |

Fl-14 ta' Novembru 2017, l-Aġenzija ħarġet rakkomandazzjoni dwar l-emendi għar-Regolament (UE) Nru 1302/2014, li jkopru, fost l-oħrajn, id-dispożizzjonijiet relatati mal-EMS. |

Il-miżuri stipulati f'dan ir-Regolament huma skont l-opinjoni tal-Kumitat imwaqqaf skont l-Artikolu 51(1) tad-Direttiva (UE) 2016/797, |
ADOTTAT DAN IR-REGOLAMENT:
Artikolu 1
Ir-Regolament (UE) Nru 1301/2014 huwa emendat kif ġej:

l-aħħar sentenza tal-premessa (6) hija mħassra; |
(2) |
l-Artikolu 3 huwa mħassar; |
(3) |
fl-Artikolu 9, il-paragrafu 4 jinbidel b'dan li ġej: “4. Minbarra l-implimentazzjoni tas-sistema tal-ġbir tad-dejta dwar l-enerġija ta' fuq l-art (DCS) iddefinita fil-punt 7.2.4 tal-Anness u mingħajr ħsara għad-dispożizzjonijiet tal-punt 4.2.8.2.8 tal-Anness għar-Regolament tal-Kummissjoni (UE) Nru 1302/2014 (*1), l-Istati Membri għandhom jiżguraw li tiġi implimentata sistema ta' saldu ta' fuq l-art li tkun tista' tirċievi d-dejta mingħand sistema tal-ġbir tad-dejta u taċċettaha għall-ħruġ tal-kontijiet sal-4 ta' Lulju 2020. Is-sistema ta' saldu ta' fuq l-art għandha tkun tista' tiskambja d-dejta miġbura dwar il-kontijiet tal-enerġija ma' sistemi ta' saldu oħrajn, tivvalida d-dejta miġbura dwar il-kontijiet tal-enerġija u talloka d-dejta dwar il-konsum lill-partijiet it-tajbin. Dan għandu jsir billi titqies il-leġiżlazzjoni rilevanti dwar is-suq tal-enerġija. (*1) Ir-Regolament tal-Kummissjoni (UE) Nru 1302/2014 tat-18 ta' Novembru 2014 dwar speċifikazzjoni teknika għall-interoperabbiltà fir-rigward tas-subsistema tal-‘Vetturi ferrovjarji — lokomotivi u vetturi ferrovjarji għat-trasport tal-passiġġieri’ tas-sistema ferrovjarja fl-Unjoni Ewropea (Ara paġna 228 ta' dan il-Ġurnal Uffiċjali)”." |

l-Anness tar-Regolament tal-Kummissjoni (UE) Nru 1301/2014 huwa emendat skont l-Anness I ta' dan ir-Regolament ta' Implimentazzjoni. |

L-Anness tar-Regolament (UE) Nru 1302/2014 huwa emendat skont l-Anness II ta' dan ir-Regolament ta' Implimentazzjoni.
Artikolu 3
Dan ir-Regolament għandu jidħol fis-seħħ fl-għoxrin jum wara dak tal-pubblikazzjoni tiegħu f'Il-Ġurnal Uffiċjali tal-Unjoni Ewropea.
Dan ir-Regolament għandu jorbot fl-intier tiegħu u japplika direttament fl-Istati Membri kollha.

4.2.8.2.8.4 Interface protocols and transferred data format between EMS and DCS The data exchange between EMS and DCS shall fulfil the following requirements:

The input quantity and power factor range when testing shall correspond to the values set out in Table 3 of the specification referenced in Appendix J-1, index 117. The effects of temperature on accuracy of the each device containing one or more functions of EMF shall be assessed by testing each function, under reference conditions (except for temperature), using the relevant method as described in clauses 5.4.3.4.3.1, and 5.4.4.3.2.1 of the specification referenced in Appendix J-1, index 117. The mean temperature coefficient of each device containing one or more functions of EMF shall be assessed by testing each function, under reference conditions (except for temperature), using the relevant method as described in clauses 5.4.3.4.3.2 and 5.4.4.3.2.2 of the specification referenced in Appendix J-1, index 120. (2) Data handling system (DHS) The compiling and handling of data within the DHS shall be assessed by testing using the method as described in the specification referenced in Appendix J-1, index 121. (3) On-board energy measurement system (EMS) The EMS shall be assessed by testing as described in the specification referenced in the specification referenced in Appendix J-1, index 122.’; |

in chapter 7 ‘Implementation’, the following clause is added below clause 7.1.1.4: ‘7.1.1.4a Transitional measure for on-board energy measurement system requirement Requirements set out in 4.2.8.2.8 are not mandatory during a transition period ending on 1 January 2022 for projects which, on 14 June 2018, are projects at an advanced stage of development, contracts in course of performance and rolling stock of an existing design as set out in point 7.1.1.2 of this TSI. When the requirements set out in 4.2.8.2.8.4 are not applied, national rules as regards specification related to interface protocols and transferred data format shall apply and the description of on-board to ground communication shall be provided in the technical documentation.’; |
