PADOMES REGULA (EK) Nr. 129/2007
(2007. gada 12. februāris),
ar ko paredz beznodokļu režīmu noteiktām farmaceitiski aktīvām vielām ar starptautisku nepatentētu nosaukumu (SNN), ko piešķīrusi Pasaules Veselības organizācija, un noteiktiem produktiem, kurus izmanto gatavu farmaceitisko produktu ražošanai, un ar ko groza Regulas (EEK) Nr. 2658/87 I pielikumu
EIROPAS SAVIENĪBAS PADOME,
ņemot vērā Eiropas Kopienas dibināšanas līgumu, un jo īpaši tā 133. pantu,
ņemot vērā Komisijas priekšlikumu,
tā kā:

Urugvajas raunda sarunās Kopiena un vairākas valstis vienojās, ka beznodokļu režīms jānodrošina farmaceitiskiem produktiem, kas ietilpst Harmonizētās sistēmas (HS) 30. nodaļā un HS pozīcijās 2936, 2937, 2939 un 2941, kā arī konkrētām farmaceitiski aktīvām vielām ar starptautisku nepatentētu nosaukumu (SNN), ko piešķīrusi Pasaules Veselības organizācija, konkrētiem šo SNN sāļiem, esteriem vai hidrātiem, kā arī konkrētiem starpproduktiem, kurus izmanto gatavu produktu ražošanai. |

Šo sarunu rezultāti, kas izklāstīti sarunu protokolā, tika iekļauti dalībnieku tarifu sarakstos, kas pievienoti VVTT 1994. gada Marakešas protokolam. |

Dalībnieki secināja, ka PTO to dalībnieku pārstāvji, kas ir sarunu protokola puses, tiksies PTO Preču tirdzniecības padomē vismaz reizi trīs gados, lai pārskatītu ietvertos produktus un vienprātīgi iekļautu papildu farmaceitiskos produktus, kurām nepiemēro tarifus. |

Trīs šādu pārskatīšanu gaitā tika secināts, ka beznodokļu režīms būtu jānodrošina zināmam skaitam jaunu SNN un starpproduktu, ko izmanto gatavu farmaceitisko produktu ražošanā, ka daži no šiem starpproduktiem būtu jāpārnes uz SNN sarakstu un ka būtu jāpaplašina sāļu, esteru un hidrātu SNN izmantojamo prefiksu un sufiksu saraksts. |

Ar Padomes Regulu (EEK) Nr. 2658/87 (1987. gada 23. jūlijs) par tarifu un statistikas nomenklatūru un kopējo muitas tarifu (1) ir izveidota kombinētā nomenklatūra (“KN”) un ir noteiktas kopējā muitas tarifa līgtās nodokļu likmes. |

Tādēļ attiecīgi būtu jāgroza Regula (EEK) Nr. 2658/87, |
IR PIEŅĒMUSI ŠO REGULU.
1. pants
Kopiena no 2007. gada 1. janvāra attiecina beznodokļu režīmu uz I pielikumā minētajiem SNN.
2. pants
No 2007. gada 1. janvāra sarakstu ar prefiksiem un sufiksiem, kurus kopā ar SNN izmanto šo vielu sāļu, esteru un hidrātu apzīmēšanai, kam arī var nodrošināt beznodokļu režīmu, ja tie ir klasificējami tajā pašā HS sešciparu apakšpozīcijā, kur atbilstīgais SNN, aizstāj ar sarakstu II pielikumā.
3. pants
No 2007. gada 1. janvāra Kopiena attiecina beznodokļu režīmu uz III pielikumā uzskaitītajiem starpproduktiem, ko izmanto farmaceitisku produktu ražošanā.
4. pants
No 2007. gada 1. janvāra IV pielikumā uzskaitītajiem starpproduktiem vairs nepiemēro beznodokļu režīmu.
5. pants
Attiecīgi groza 3., 4. un 6. pielikumu Regulas (EEK) Nr. 2658/87 I pielikuma trešās daļas II sadaļā (Farmaceitiskas vielas, kam piemērojams beznodokļu režīms).
6. pants
Šī regula stājas spēkā nākamajā dienā pēc tās publicēšanas Eiropas Savienības Oficiālajā Vēstnesī.
Šī regula uzliek saistības kopumā un ir tieši piemērojama visās dalībvalstīs.

II PIELIKUMS
Prefiksu un sufiksu saraksts, kas kopā ar Komisijas regulas (EK) Nr. 1549/2006 3. pielikumā minētajiem SNN apzīmē SNN sāļus, esterus vai hidrātus; šiem sāļiem, esteriem un hidrātiem nodokli nepiemēro, ja tie ir klasificējami vienā HS sešciparu apakšpozīcijā ar attiecīgajiem SNN
Prefiksus un sufiksus var kombinēt (piemēram, hidrohlorīda fosfāts). To priekšā var atrasties tādi priedēkļi struktūrelementu daudzkārtņu apzīmēšanai kā bi-, bis, di-, hemi-, hepta-, heksa-, mono-, penta-, seskvi- tetra-, tri-, tris… (piemēram, diacetāts). Līdzīgi var lietot sinonīmus un sistemātiskos nosaukumus.
SNN ir Pasaules Veselības organizācijas piešķirtie ārstniecības vielu starptautiskie nepatentētie nosaukumi.
RGSNN ir radikāļu un grupu starptautiskie nepatentētie nosaukumi (SNN), kas uzskaitīti 2004. gada visaptverošajā sarakstā.
SNNĶN ir starptautisko nepatentēto nosaukumu (SNN) ķīmiskie vai sistemātiskie nosaukumi, kas uzskaitīti 2004. gada visaptverošajā sarakstā.
