IEVADS Padomes Regulas (EK) Nr. 2371/2002[1] 14. pantā un Komisijas Regulas (EK) Nr. 1438/2003[2] 12. pantā prasīts, lai dalībvalstis līdz katra gada 1. maijam iesniegtu Komisijai ziņojumu par darbībām, kas veiktas iepriekšējā gadā, lai nodrošinātu flotes zvejas kapacitātes un pieejamo zvejas iespēju noturīgu līdzsvaru. Dalībvalstu ziņojumi ir pieejami Europa tīmekļa vietnē[3]. Pamatojoties uz minētajiem ziņojumiem un Kopienas Zvejas flotes reģistra datiem[4], Komisija sagatavoja kopsavilkuma ziņojumu par 2005. gadu, kas tika iesniegts Zivsaimniecības zinātnes, tehnikas un ekonomikas komitejai ( STECF) un Zivsaimniecības un akvakultūras komitejai. Šajā ziņojumā Komisija minēto kopsavilkumu, kas papildināts ar minēto komiteju atzinumiem, iesniedz Padomei un Eiropas Parlamentam. Šim ziņojumam ir divas daļas: - pirmajā daļā raksturoti noteikumi, kas jāievēro dalībvalstīm, īstenojot savu flotu pārvaldību, un apkopota informācija, kas iesniegta saskaņā ar 13. pantu Komisijas Regulā, ar ko paredz īstenošanas noteikumus attiecībā uz Kopienas flotes politiku; - otrajā daļā ar skaitlisku tabulu palīdzību raksturota dalībvalstu flotes kapacitātes attīstība 2005. gadā, sniedzot būtisku informāciju par katras valsts flotes kuģu iekļaušanas un izslēgšanas pārvaldību. 2. Flotu pārvaldība saskaņā ar reformēto kopējo zivsaimniecības politiku Saskaņā ar 2002. gada decembrī pieņemto kopējo zivsaimniecības politiku (KZP) zvejas flotes pārvalda, ievērojot vispārēju principu, ka jauna flotes kapacitāte kuģu tilpības (GT) un jaudas izteiksmē nedrīkst pārsniegt kapacitātes samazinājumu (sk. 1. tehnisko pielikumu). 3. DALīBVALSTU GADA ZIņOJUMU KOPSAVILKUMS Arī šogad tikai desmit dalībvalstis iesniedza gada ziņojumus līdz noteiktajam termiņam – 2006. gada 30. aprīlim; pārējie ziņojumi tika iesniegti ar novēlošanos (piemēram, Itālija vai Francija iesniedza ziņojumus vairākus mēnešus pēc termiņa). Apvienotā Karaliste neiesniedza gada ziņojumu. Turklāt dalībvalstu ziņojumos iekļautā informācija nav viendabīga un dažreiz netiek ievērota gada ziņojumu iesniegšanas forma/saturs. Turklāt vairākas dalībvalstis atkārtoti ir pārsniegušas ziņojuma maksimālo 10 lappušu garumu un ir pievienojušas daudzus pielikumus un skaidrojošās tabulas. Minēto neatbilstību rezultātā bija sarežģīti sniegt dalībvalstu ziņojumu kopēju novērtējumu, un Komisija saskārās ar nopietnām grūtībām ievērot termiņu (2006. gada 31. jūlijs), lai iesniegtu kopsavilkuma ziņojumu STECF un Zivsaimniecības un akvakultūras komitejai. a) Flotu raksturojums, ņemot vērā zivsaimniecības nozares stāvokli Dalībvalstu gada ziņojumos sniegts vispārējs zvejas flotu apraksts, norādot kuģu skaitu, kapacitāti, mērķsugas un zvejas apgabalus. Tomēr dalībvalstīs ir izmantotas dažādas segmentācijas sistēmas: dažās dalībvalstīs joprojām izmanto iepriekšējo VGVP IV segmentāciju, citās – nacionālas segmentācijas sistēmas. Visumā nacionālās zvejas flotes segmentācijas pārvaldību īsteno šādi: - VGVP IV segmentāciju izmanto Vācijā, Francijā, Portugālē, Somijā un Īrijā (ar dažiem izņēmumiem); - pēc kuģu tipa/zvejas rīkiem/lielākā garuma – Dānijā un Kiprā; - pēc lielākā garuma un zvejas rīkiem – Grieķijā un Slovēnijā; - pēc zvejas rīkiem – Beļģijā; - pēc ģeogrāfiski noteiktām zvejas vietām un zvejas kuģu tipa – Spānijā, Latvijā, Lietuvā un Polijā; - pēc kopējā garuma, zvejas vietām, izmantotajiem zvejas rīkiem un zvejotajām zivju sugām – Igaunijā un Zviedrijā (neizmantojot zvejas vietas kā raksturojošu rādītāju); - dala divās daļās: akvakultūras un kontinentālās flotes (galvenokārt zvejas kuteru) segmentā – Nīderlandē. Vairākas dalībvalstis uzsvēra, ka maza mēroga piekrastes zvejas flotei (tā veido 80 % no Kopienas kopējās zvejas flotes) ir nozīmīga sociālekonomiska ietekme piekrastes iedzīvotāju dzīvē. Šā sektora labāka pārvaldība un attīstība, piemēram, ir noteikta kā prioritārs uzdevums Zviedrijā un Grieķijā. Lielākā daļa dalībvalstu savos ziņojumos centās sniegt zvejas flotes kapacitātes un pieejamo zvejas iespēju līdzsvara novērtējumu. Dažādas pieejas tika izmantotas, lai noteiktu korelāciju starp pieejamajiem zivju krājumiem un flotēm. Vairākas dalībvalstis analizēja pieejamos zivju krājumus saistībā ar kapacitātes izmaiņām katrā to flotes segmentā. Dažas dalībvalstis vairāk izmantoja sociālekonomisku pieeju, lai novērtētu to zvejas flotes kapacitātes attīstību. 2005. gadā dalībvalstis īstenoja vairākus pasākumus, lai panāktu labāku līdzsvaru starp pieejamajiem resursiem un zvejas flotēm: flotes kapacitātes samazināšana, zvejas dienu skaita ierobežošana, ierobežojumi attiecībā uz piekļuvi resursiem valsts līmenī, zvejas licenču skaita ierobežojumi, zvejas kvotu piešķiršana utt. Visas dalībvalstis ziņoja par pakāpenisku zvejas kapacitātes samazināšanu 2005. gadā, izteiktu gan GT, gan kW, kas panākta ar ekspluatācijas pārtraukšanas programmu palīdzību. b) Zvejas piepūles samazināšanas shēmu ietekme uz kapacitāti Kā jau tika minēts dalībvalstis 2005. gadā varēja izmantot dažādus krājumu atjaunošanas pasākumus un zvejas piepūles samazināšanas shēmas. Visas dalībvalstis, kuras zvejoja Kategatā, Ziemeļjūrā un Skagerakā, uz rietumiem no Skotijas, Lamanša austrumu daļā, Īrijas jūrā, Biskajas līcī, Kantabrijas jūrā un Ibērijas pussalas rietumdaļā, kā arī Baltijas jūrā, skāra zvejas piepūles samazināšanas pasākumi (daži no tiem ir noteikti Padomes Regulā (EK) Nr. 27/2005)[5]. Lai īstenotu šos pasākumus, ir jāsamazina to dienu skaits, kuras kuģi pavada jūrā, un ir jāierobežo izmantotais zvejas rīku skaits. Lielākā daļa attiecīgo dalībvalstu ziņoja par zvejas piepūles vispārēju samazinājumu. Turklāt attiecīgās dalībvalstis ziņoja, ka to zvejas piepūles samazināšana panākta, galvenokārt ierobežojot dažādus zvejas piepūles veidus un īstenojot ekspluatācijas pārtraukšanas programmas. Dažas dalībvalstis ziņoja, ka degvielas cenu pieaugumam 2005. gadā arī ir bijusi nozīmīga loma zvejas piepūles samazināšanā. Turpmāk tiek sniegti daži dalībvalstu komentāri attiecībā uz zvejas piepūles shēmām 2005. gadā. Beļģijā flotes darbības tika veiktas Ziemeļjūrā, rietumu daļas ūdeņos un Biskajas līcī, ievērojot ierobežojumus, kas noteikti saskaņā ar Regulu 27/2005. Katrā no minētajiem apgabaliem flotei nācās ievērot atjaunošanas vai pārvaldības plānu (izņemot garneļu zvejas floti). Turklāt Beļģijas sistēma paredz ierobežojumus attiecībā uz vienam zvejas kuģim ik gadu atļauto kopējo jūrā pavadīto dienu skaitu, attiecinot to uz visiem apgabaliem. Jūrā pavadāmo atļauto dienu skaita ierobežojums mencu krājumu atjaunošanas apgabalā tika uztverts kā rāmju traļu flotes ierobežojums, samazinot kuģu skaitu. Visas flotes kopējais jūrā pavadīto dienu skaits netika pārsniegts, jo daži kuģi neizmantoja visu tiem atvēlēto dienu skaitu. Jūrā pavadīto dienu skaita ierobežojuma rezultātā netika pilnībā apgūtas visas pieejamās kvotas. Dānijā mencu atjaunošanas plāna rezultātā Ziemeļjūrā pretstatā 81,330 plānotajām dienām jūrā tika izmantotas 71,642 dienas jūrā, tādējādi tika panākts samazinājums par 12 %. Resursu un flotes pārvaldības mijiedarbība kopējās pieļaujamās nozvejas (KPN)/kvotu ierobežojuma un zvejas piepūles/kapacitātes izteiksmē ir pētīta pētniecības projektā. Secinājums ir šāds: no ekonomiskās darbības viedokļa raugoties, flotei ir liela nozīme zivju krājumu ieguvē, tādēļ flote jāsamazina.4 īstermiņa scenāriju analīzē kuģu skaits tiek samazināts visos gadījumos, izņemot tad, ja tiek ierobežota kuģu darbība (dienas jūrā). Paredzamais ieguvums būtu ievērojams krājumu atjaunošanai ilgtermiņā. Tomēr līdzvērtīgu guvumu varētu panākt ar pienācīgu flotes pārvaldību, kas līdzvērtīga zvejas krājumu pārvaldībai. Darbs turpinās pie tā, lai panāktu flotes lieluma un zvejas iespēju faktisku līdzsvaru. Vācijā tā kā zvejas flote ir neliela, zvejas piepūles samazināšanas shēmām ir tikai neliela ietekme uz zvejas kapacitāti, kas galvenokārt saistīta ar zveju Baltijas jūrā. Flotes pārvaldības sistēmas kontekstā, lai panāktu noturīgu zvejas kapacitātes un pieejamo resursu līdzsvaru, Vācijas zvejas flotei jāsaglabā pietiekama vispārējā kapacitāte, lai apgūtu Vācijai piešķirtās zvejas kvotas. Vācijas zvejas flotes attīstība liecina, ka tā ir pielāgota gan ekonomiskajiem nosacījumiem, kas noteikti ar jauno KZP, gan ierobežotiem pieejamajiem resursiem. Tādēļ Vācijas iestādēm nav vajadzības veikt ar flotes attīstību saistītus pasākumus. Igaunijā tiek ievērots KPN samazinājums attiecībā uz mencu krājumiem Baltijas jūrā un Ziemeļrietumu Atlantijas zvejniecības organizācijas (NAFO) pieņemtais Atjaunošanas plāns, kā noteikts Padomes Regulā (EK) Nr. 27/2005. Grieķijā netika piemēroti daudzgadu pārvaldības un krājumu atjaunošanas plāni, jo šādu plānu nav attiecībā uz zveju Vidusjūrā, tajā pašā laikā saskaņā ar darbības programmu zvejniecības jomā turpinās darbs pie flotes kapacitātes un zvejas iespēju atkārtotas koriģēšanas saskaņā ar Padomes Regulu (EK) Nr. 2792/1999 un Padomes Regulu (EK) 2369/2002. Spānijā tika turpināta flotes atjaunošanas un modernizēšanas pieeja, ko sāka 2003. gadā saskaņā ar Regulas 2371/2002 noteikumiem. Tādējādi iekļaušanas un izslēgšanas pārvaldība ir devusi iespēju panākt nelielu flotes jaudas samazinājumu un tā rezultātā panākt kopējo zvejas piepūles samazinājumu. 2005. gadā Kadisas līča zvejas vietās tika īstenoti divi valsts mēroga plāni. Tie attiecas uz to krājumu atjaunošanu un noturīgu pārvaldību, kurus zvejo ar traļiem un riņķvadiem, un tie neapšaubāmi ietver pasākumus zvejas piepūles samazināšanai. Ierobežojot dienu skaitu jūrā, ir izdevies samazināt zvejas piepūli par aptuveni 32 % salīdzinājumā ar iepriekšējiem gadiem. Francijā Francijas kontinentālās flotes jauda 2005. gadā bija nemainīga; 2005. gadā publiskais atbalsts netika piešķirts ekspluatācijas pārtraukšanas programmām. Jauna ekspluatācijas pārtraukšanas programma ir paredzēta 2006. gadā, un tās mērķis ir flotes, kuras plāno veikt darbību attiecībā uz pārmērīgi nozvejotiem zivju krājumiem. Zvejas piepūles ierobežojumi, kas pieņemti saskaņā ar atjaunošanas plāniem vai KPN IV pielikuma noteikumiem, attiecas uz aptuveni 850 kuģiem; minēto pasākumu rezultātā 2005. gadā nav samazināta kapacitāte. Īrijā zveja, ko veic saskaņā ar krājumu atjaunošanas plāniem, ir ļoti daudzveidīga. Tādēļ ir grūti noteikt zvejas piepūles samazināšanas plānu ietekmi uz zvejas kapacitāti. Lai ievērotu Padomes Regulu (EK) Nr. 27/2005, Īrijā ieviesa sistēmu, ievērojot kuru zvejas kuģiem, kas zvejoja konkrētos apgabalos un izmantoja konkrētus zvejas rīkus, bija jāaizpilda veidlapa "Deklarācija par oficiālo jūrā pavadīto dienu skaitu". Turklāt papildus centieniem, kas saistīti ar mencu krājumu daudzgadu atjaunošanas plānu Īrijas jūrā un uz rietumiem no Skotijas, ir ieviests arī vispārējs zvejas piepūles kontroles mehānisms, kas vispārēji piemērojams bentiskajām sugām (tāpat arī krabjiem un gliemenēm) visos ūdeņos, kas atrodas ap Īriju. Īrijā pārvaldīja zvejas piepūles līmeņus minētajos zvejas apgabalos un ieviesa pārvaldības pasākumus, lai saglabātu floti, ņemot vērā zvejas piepūles piešķīrumus. Īrijas Jūrlietu ministrs 2005. gadā uzsāka jaunu programmu, lai līdz pat 25 % samazinātu vecāko, lielāko un bentiskajos (daudzfunkcionālo un rāmju traļu) sektoros aktīvāko zvejas flotes kuģu skaitu, kā arī samazinātu pārmērīgu kapacitāti gliemeņu zvejas flotē. Saskaņā ar šo shēmu 22 kuģi (kopā 2 464 GT un 7 742 kW) tika izslēgti no flotes 2005. gadā. Itālijā lejupejošā tendence attiecībā uz izkrāvumiem, kas reģistrēta 2005. gadā, saistāma gan ar kuģu skaita samazinājumu, gan ar darbības mēroga samazinājumu. Šajā sakarā jāatceras, ka degvielas cenas ir būtiski ietekmējušas kopējo zvejas dienu skaitu jūrā, liekot daudziem zvejniekiem mainīt savu zvejas stratēģiju, t.i., ierobežot zvejas piepūli, lai segtu darbības izmaksas. 2005. gadā zvejas kapacitātes samazināšanas plāns, ko īstenoja ar publiskā atbalsta palīdzību, tāpat kā iepriekšējos gados sniedza labus rezultātus. Lai gan tas nav ietekmējis novērtējumu, kas saistīts ar iekļaušanas/izslēgšanas režīmu, ir ievērojami samazināta zvejas piepūle Itālijai piederošos ūdeņos absolūtā izteiksmē. Kiprā divi grunts traļi tika nodoti sadalīšanai un divi kuģi tika tālāknodoti vietējiem muzejiem. Kopumā flotes kapacitāte tika samazināta par 2 864 GT un 5 423 kW. Latvijā 2005. gadā 31 kuģis tika nodots sadalīšanai, izmantojot valsts atbalstu; visi šie kuģi tika izslēgti no Baltijas jūras flotes. Galvenais iemesls, kādēļ minēto kuģu īpašnieki iesniedza pieteikumu kuģu ekspluatācijas pārtraukšanai, bija Baltijas jūras zivju krājumu sliktais stāvoklis. Īpaši slikts šobrīd ir mencu krājumu stāvoklis, tādēļ lielākā daļa ekspluatācijas pārtraukšanai paredzēto kuģu bija mencu krājumu zvejas kuģi. Cits svarīgs iemesls kuģu nodošanai sadalīšanai bija to vecums un kuģu sliktais tehniskais stāvoklis, liels degvielas cenu pieaugums un citu ar zvejas darbībām saistītu izmaksu pieaugums. Zvejas piepūles samazināšanas shēmas vispārējā ietekme, kā arī Latvijas zvejas flotes samazināšana, kuģus eksportējot vai nododot sadalīšanai, nesaņemot publisko atbalstu, samazināja mencu krājumu zvejas kuģu kapacitāti par 11 %. No 2004. gada 1. maija šim kapacitātes samazinājumam ir pozitīva ietekme attiecībā uz mencu krājumiem un tas sekmē šo tik ļoti svarīgā Baltijas jūras zivju krājuma atjaunošanos. Lietuvā 2005. gadā zvejas kuģu kapacitāte, kuri zvejoja Baltijas jūrā un tās piekrastē, salīdzinājumā ar 2004. gadu tika samazināta par 1 576 GT un 3 104 kW – tas tika panākts, nododot kuģus sadalīšanai, izmantojot publisko atbalstu. Baltijas jūrā zvejojošo zvejas kuģu kapacitātes samazinājums par 22 % sekmēja zvejas kvotu palielinājumu pārējiem zvejas kuģiem. Maltā visumā gadalaikam raksturīgie zvejas veidi 2005. gadā bija tādi paši kā iepriekšējos gados, neuzrādot zvejas piepūles pieaugumu nevienā zvejas apgabalā. Netika īstenotas zvejas piepūles samazināšanas shēmas, tādēļ netiek ziņots par ietekmi uz zvejas kapacitāti. Maltas zvejas apgabalu pārvaldība tika veikta saskaņā ar Padomes Regulu 813/2004, ar ko noteikti kopēji zvejas piepūles kontroles pasākumi attiecībā uz ūdeņiem, kas atrodas ap Maltu. Maltas zvejas flotes zvejoto krājumu stāvoklis ir tāds, ka nav jāsamazina flotes kapacitāte. Nīderlandē zvejas kuteru sektorā jau daudzus gadus ir saspringts stāvoklis ierobežoto kvotu un ievērojamā izmaksu pieauguma dēļ. Dažu pēdējo gadu laikā ievērojami samazinājušās jūras zeltplekstu zvejas iespējas. Tāpēc valsts iestādes un zvejas nozares uzņēmumi ir uzsākuši vairākas iniciatīvas, lai mazinātu negatīvo ietekmi uz jūras zeltplekstu krājumiem. Lai pastāvīgi samazinātu zvejas kapacitāti, pārtraukta vienas flotes daļas ekspluatācija. Tādā veidā ir izdevies panākt labāku līdzsvaru starp kapacitāti un zvejas iespējām un sekmēt jūras zeltplekstu krājumu atjaunošanos. Nākamais ieguvums ir labākas finansiālās izredzes zvejniekiem, kas nav pārtraukuši darbību, jo zvejas iespējas katram kuģim ir palielinājušās. Regula par jūras zvejas kapacitātes samazināšanu stājās spēkā 2005. gada septembrī, to piemērojot, tika pārtraukta 29 kuģu ekspluatācija, kopējais samazinājums — 36 092 kW un 8 982 GT. Daļēji saistībā ar minēto regulu samazināja arī zvejas kuteru floti, tādējādi panākot labāku līdzsvaru starp flotes lielumu un pašreizējām zvejas iespējām. Nīderlandes kuteru flotes kilovatdienu skaits 2005. gadā Ziemeļjūras atjaunošanas plāna apgabalā tika samazināts par 15 % salīdzinājumā ar 2004. gadu. Atlikušās flotes lielums zivju krājumu pašreizējā apjoma un stāvokļa ziņā ir pamatots. Īstenotā kapacitātes samazinājuma un 2005. gadā izmantotās kapacitātes samazinājuma rezultātā panākts labāks līdzsvars starp krājumu apjomu un flotes lielumu. Polijā izveidota zvejas piepūles samazināšanas shēma, galvenais iemesls ir pārāk liela mencu krājumu zvejas kapacitāte Baltijas jūrā, kā arī zemā rentabilitāte. 2005. gadā 270 kuģi ir nodoti sadalīšanai vai mainījuši darbības jomu, šādā veidā zvejas kapacitāti izdevies pastāvīgi samazināt par 15 564 GT un 42 237 kW. Portugālē floti ietekmējuši šādi zvejas piepūles ierobežojumi: ierobežojumi zvejai ar riņķvadiem (sardīnes), dienvidu heka atjaunošanas plāns (Padomes Regula (EK) Nr. 27/2005), melnā paltusa atjaunošanas plāns NAFO apgabalā un regulas par dziļjūras sugām. Attiecībā uz pēdējo minēto Portugālē tika izmantota licencēšanas sistēma, lai ierobežotu kuģu piekļuvi dziļjūras sugu zvejai. 2005. gadā tika apstiprināti 34 samazināšanas priekšlikumi, un minētajā gadā 25 kuģi no kontinentālā flotes segmenta jau tika nodoti sadalīšanai, tādā veidā panākot samazinājumu par 5011 GT un 10 123 kW. Slovēnija nevar ziņot par zvejas piepūles samazināšanas programmu ietekmi uz zvejas kapacitāti, jo pārvaldības vai atjaunošanas plāni attiecībā uz zveju Vidusjūrā vēl nav ieviesti. Valstī nav arī shēmu zvejas kuģu ekspluatācijas pārtraukšanai un novirzīšanai citiem mērķiem. Somijā ir izstrādāta īpaša zvejas kapacitātes samazināšanas shēma. Tas veikts tāpēc, ka konstatēta pārāk liela siļķu un brētliņu zvejas kapacitāte, kā arī aizliegts zvejot ar dreifējošiem tīkliem Baltijas jūrā. Somija īstenoja minēto kapacitātes samazināšanas shēmu attiecībā uz pelaģiskās zvejas traleriem un kuģiem zvejai ar pasīvajiem zvejas rīkiem. Kapacitāte bez publiskā atbalsta saņemšanas samazināta par 1378 GT un 6025 kW. Pelaģiskās zvejas flotes piepūle laikā no 2003.–2005. gadam ir ievērojami samazināta — par aptuveni 15 %. Specializētā bentisko sugu (galvenokārt mencu) zveja ar velkamajiem un statiskajiem zvejas rīkiem 2005. gadā ir būtiski samazināta — par aptuveni 79 %, tomēr tas attiecas tikai uz mazām nozvejām un dažiem kuģiem. Lašu, foreļu un saldūdens sugu zvejas piepūle pēdējos gados ir samazināta visvairāk — par aptuveni 88 %. Zviedrijā saskaņā ar daudzgadu pārvaldības un atjaunošanas plāniem, ko īsteno Ziemeļjūrā, Skagerakā un Kategatā, zvejas kapacitāte ir pakāpeniski samazināta, nosakot mazākas KPN un samazinot jūrā pavadāmo dienu skaitu. Zvejas kapacitāte samazināta arī, īstenojot valsts noteikumus, ar kuriem koriģēti tralēšanas limiti, ieviesta selektīvo traļu obligāta lietošana un paredzēti ierobežojumi piekrastes zvejai ar traļiem un riņķvadiem. Paredzot īpašas licences mencu zvejai Baltijas jūrā, samazināta šā zvejas veida kapacitāte. Ņemot vērā grunts zivju krājumu nopietno stāvokli Kategatā un Skagerakā, kā arī piekrastes zveju ar statiskajiem rīkiem, zvejas iespējas piekrastes apgabalos samazinātas, nosakot „tralēšanas limitu”. Minētais ierobežojums nozīmē, ka zveja ar riņķvadu tika aizliegta vēl divās fjordu sistēmās. Tika noteikti arī laika ierobežojumi zvejai ar riņķvadu mākslīgā apgaismojuma apstākļos. Ierobežotas arī siļķu pelaģiskās zvejas iespējas, un lielākajiem pelaģiskās zvejas kuģiem vairs nav atļauts izmantot piekrastes zvejas licenci. Zveja ar pelaģiskajiem traļiem ir aizliegta apgabalos, kas ir īpaši nozīmīgi zvejniekiem, kuri izmanto murdus. Kopumā lielākā daļa dalībvalstu apstiprināja, ka spēkā esošo zvejas piepūles samazināšanas shēmu īstenošanas rezultāti ir bijuši sekmīgi un tās ir palīdzējušas panākt labāku līdzsvaru starp zvejas kapacitāti un zvejas iespējām. Turklāt dažas dalībvalstis norādīja, ka arī turpmāk vajadzētu pastiprināt pasākumus kapacitātes un zvejas piepūles samazināšanai. Piemēram, Beļģija norādīja, ka tās zvejnieki jau sen ir zinājuši, ka zivju krājumu apjoms nav tāds kā pirms desmit gadiem. Tāpēc viņi piekrīt, ka ir jārīkojas, lai mazinātu zivju krājumu apdraudētību, un ka flote jāsamazina, lai atlikušo zvejnieku darbība būtu ilgtspējīga un ekonomiski stabila. Tomēr ar ierobežojumiem, ko nosaka saskaņā ar atjaunošanas vai pārvaldības plāniem, uzskatāmi rezultāti jāsasniedz īsā vai vidēji ilgā laikā, ja vēlas panākt, lai zvejnieki tos uzskatītu par pārliecinošiem un pieņemamiem. Beļģijā veikts pētījums liecina, ka pašreizējā Beļģijas flotes zvejas kapacitāte jāsamazina par 10 000 kW (15 % no pašreizējās flotes kapacitātes), lai palīdzētu flotei īsā laikā atgūt rentabilitāti, pamatojoties uz pašreizējo izmaksu struktūru un zvejas iespējām. Līdzīgi arī Zviedrija ierosināja, ka turpmāka zvejas kapacitātes samazināšana ir vēlama, lai sasniegtu līdzsvaru starp zvejas kapacitāti un iespējām. Tas ir arī priekšnoteikums zvejas flotes ilgtspējīgas stabilitātes nodrošināšanai. Zivju krājumu apjoms dažos nākamajos gados, visticamāk, nemainīsies, tāpēc sagaidāma flotes lieluma pakāpeniska samazināšana. Svarīgi arī apvienot flotes pārvaldību ar citiem pasākumiem, lai nodrošinātu līdzsvaru starp zvejas kapacitāti un resursiem, piemēram, pasākumi, kuru mērķis ir saistīts ar kvotu un zvejas iespēju sadali un zvejas piepūles un rīku ierobežojumiem. c) Priekšrocības un trūkumi Visas dalībvalstis ieviesa iekļaušanas/izslēgšanas režīmu. Lielākajā daļā gadījumu valsts flotes reģistra datus paziņoja Komisijai saskaņā ar Regulu 26/2004. Tomēr dažas organizatoriskas un ar datu apstrādi saistītas grūtības saglabājās; galvenais iemesls tam ir ierobežotās administratīvās iespējas atsevišķās dalībvalstīs. Neraugoties uz šīm grūtībām, to datu kvalitāte, ko dalībvalstis nosūtīja Komisijai, 2005. gadā ievērojami uzlabojās. Viens no svarīgiem uzdevumiem bija uzsāktais flotes reģistra datu kontrolpārbaudes process un „brīdinājumu ziņojumu” pārbaudīšana. Gandrīz visās dalībvalstīs 2005. gadā darbojās zivsaimniecības integrētās informācijas sistēmas, kas nereti aptvēra dažādu programmu lietojumus (flotes reģistrs, zvejas kapacitātes pārvaldība, licences, izkrāvumi, pieejamās kvotas, nozvejas paziņošana u.c.). Īrijā un Zviedrijā 2005. gadā sāka darboties zivsaimniecības integrētās IT sistēmas jaunas versijas. Arī Slovēnija ir rīkojusies, lai ieviestu zivsaimniecības integrētās informācijas sistēmu. Šīs sistēmas visbiežāk saista vairākas pārvaldes iestādes, kā arī centrālās pārvaldes iestādes ar vietējām iestādēm, tādā veidā ievērojami stiprinot valsts zvejas flotes administrāciju. Turklāt dalībvalstis paziņoja, ka valsts reģistru dati ir pareizi, pilnīgi un aktuāli. d) Iekļaušanas/izslēgšanas režīma un robežlīmeņu ievērošana Visas dalībvalstis ziņojumos norādīja, ka tās pilnībā ievēro spēkā esošos iekļaušanas/ izslēgšanas noteikumus. Iekļaušanas/izslēgšanas režīma un robežlīmeņu ievērošana (attiecīgā gadījumā) 2005. gada beigās ir izklāstīta 1. un 2. tehniskajā pielikumā, izmantojot Komisijas Regulā (EK) Nr. 1438/2003 noteiktās formulas. Šajos tehniskajos pielikumos, kuru pamatā ir Kopienas zvejas flotes reģistra ( CFR ) dati, sniegta vispārīga informācija par minēto kritēriju ievērošanu Kopienā un katrā dalībvalstī. 4. KOMISIJAS SECINĀJUMI Dalībvalstu iesniegto ziņojumu kvalitāte salīdzinājumā ar 2004. gadu ir uzlabojusies. Dažas dalībvalstis iesniedza ļoti sīki izstrādātus ziņojumus, kuros bija sniegta plašāka informācija, nekā prasīts. Tomēr citas dalībvalstis neievēroja iesniegšanas termiņu vai Komisijas Regulas (EK) Nr. 1438/2003 13. pantā noteiktās prasības attiecībā uz ziņojumu iesniegšanas formu un saturu. Šā ziņojuma sagatavošanas laikā Apvienotā Karaliste vēl nebija iesniegusi gada ziņojumu. Dalībvalstis ziņojumos īpaši akcentēja valsts flotes pārvaldības režīma īstenošanu, bet līdzsvars starp zvejas flotes kapacitāti un pieejamām zvejas iespējām bija atspoguļots pilnīgāk nekā iepriekšējo gadu ziņojumos. Kontinentālās flotes rādītāji (Kopienas flote, izņemot attālākajos reģionos reģistrētos kuģus) Saskaņā ar Kopienas zvejas flotes reģistra datiem trīs gadu laikposmā no 2003. līdz 2005. gadam ES 15 dalībvalstu Kopienas flotes kopējā kapacitāte tika samazināta par 117 000 GT un 499 000 kW, kas veido ES 15 dalībvalstu flotes tilpības samazinājumu par 6,27 % un dzinēju jaudas samazinājumu par 7,28 %. Neto samazinājums 2005. gadā bija aptuveni 50 000 GT, savukārt 2004. gadā tas bija 23 000 GT un 2003. gadā — 44 000 GT. Šie samazinājumi šķiet samērā nelieli, ja ņem vērā lielo zvejas intensitāti lielākajā daļā Kopienas zvejas veidu, jo īpaši bentisko sugu zvejā. Jaunajās dalībvalstīs no 2004. gada 1. maija flotes kapacitāte ir samazināta par 41 000 GT un 101 000 kW, kas veido flotu tilpības samazinājumu par 18 % un dzinēju jaudas samazinājumu par 18 % salīdzinājumā ar šo dalībvalstu zvejas kapacitāti pievienošanās dienā. ES flotes kapacitāte 2003., 2004. un 2005. gadā ar publiskā atbalsta palīdzību tika samazināta par aptuveni 132 000 GT un 427 000 kW, tas nozīmē, ka šo zvejas kapacitāti nevar aizstāt. Lielākā daļa zvejas kapacitātes samazinājuma, ko panāca, saņemot publisko atbalstu, attiecās uz ES 15 dalībvalstīm (112 000 GT un 373 000 kW). Kapacitātes samazinājums, kas kopš 2004. gada 1. maija panākts jaunajās dalībvalstīs, saņemot publisko atbalstu, ir 20 000 GT un 54 000 kW. Ziņojuma 1. tehniskā pielikuma 1. un 2. tabulā ir apkopoti dati par atbilstību iekļaušanas/ izslēgšanas režīmam un robežlīmeņiem 2005. gada 31. decembrī. Lielākā daļa dalībvalstu ir ievērojušas šos noteikumus. Tomēr Grieķija nav ievērojusi iekļaušanas/izslēgšanas režīmu attiecībā uz tilpību, lai gan tās neatbilstības pakāpe ir ļoti zema, jo tilpības robežlīmenis pārsniegts tikai par 0,29 %. Grieķijas iestādes apstrīd Komisijas novērtējumu, tās uzskata, ka Grieķija ir ievērojusi iekļaušanas/izslēgšanas režīmu. Ziņojuma 1. tehniskā pielikuma 3. un 4. tabulā sniegts kopsavilkums par flotes kapacitātes izmaiņām no 2003. gada 1. janvāra (jaunajām dalībvalstīm no 2004. gada 1. maija) līdz 2005. gada 31. decembrim. Šajās tabulās norādīts arī kuģu skaits. Minētā pielikuma 3. tabula aptver visas dalībvalstis. Sīki izstrādāts katras valsts novērtējums ir iekļauts 2. tehniskajā pielikumā. Attālākajos reģionos reģistrēto zvejas flotu rādītāji Attālākajos reģionos reģistrēto zvejas flotu kapacitāte un tās izmaiņas laikā no 2003. gada 1. janvāra līdz 2005. gada 31. decembrim norādītas 4. tabulā. Rezultāti liecina, ka ievērojami samazināta gan tilpība, gan dzinēju jauda Spānijas un Portugāles attālākajos reģionos reģistrētajām zvejas flotēm. Attiecībā uz Francijas aizjūras departamentiem nedaudz samazināts kopējais kuģu skaits un to tilpība un palielināta dzinēju jauda. Tabulās, kas iekļautas 3. tehniskajā pielikumā, sniegta sīkāka informācija par īpaša režīma piemērošanu šīm flotēm. Vienā no 17 attālākajos reģionos reģistrēto zvejas flotu segmentiem 2005. gada beigās ir pārsniegts dzinēju jaudas robežlīmenis (segments „4FJ” — Francijas aizjūras departamenta Martinikas kuģi, kuru garums ir mazāks nekā 12 m), un citā segmentā ir pārsniegts tilpības robežlīmenis (segments „CA3” — Kanāriju salās reģistrēti kuģi, kuru garums ir lielāks nekā 12 m un kuri zvejo starptautiskos un trešo valstu ūdeņos). Īpašo režīmu šiem segmentiem pārtrauc piemērot no brīža, kad tie sasniedz maksimālo robežlīmeni un atbilstību regulai[6]. Vispārīgas piezīmes Kā iepriekš paskaidrots, šā kopsavilkuma ziņojuma pamatā ir dalībvalstu gada ziņojumi un dati, kas iegūti no CFR . Zināma nebūtiska neatbilstība saglabājas starp tiem datiem, ko dalībvalstis norādījušas gada ziņojumos, un datiem, kurus tās deklarējušas CFR . Paticoties dalībvalstu un Komisijas centieniem sinhronizēt datus, šī neatbilstība nav svarīga no flotes pārvaldības viedokļa. Tomēr jāturpina rīkoties, lai novērstu šādas atšķirības. Dalībvalstu ziņojumos sniegtie dati nekādā ziņā nemaina šajā ziņojumā iekļautos secinājumus. Saskaņā ar Padomes Regulas (EK) Nr. 2371/2002 16. pantu dalībvalstīm, kuras neievēro minētās regulas 11., 13. un 15. pantu, zvejas piepūle ir jāsamazina līdz līmenim, kāds būtu tad, ja tās izpildītu minētajos pantos noteikto. Turklāt tām var pakāpeniski samazināt Kopienas finanšu palīdzību, ko piešķir saskaņā ar Zivsaimniecības virzības finansēšanas instrumentu (ZVFI). Lai uzlabotu gada ziņojumu kvalitāti, Komisija, sadarbojoties ar Zivsaimniecības un akvakultūras komiteju, plāno sagatavot satura ziņā vēl sīkāk izstrādātas pamatnostādnes un ieviest kopēju, saskaņotu, metodisku pieeju, lielāku uzmanību pievēršot zvejas kapacitātes attīstībai saistībā ar pieejamajiem zivju krājumiem. Šie jautājumi tiks apspriesti Zivsaimniecības un akvakultūras komitejas turpmākajās sanāksmēs. Turpmākajos gada ziņojumos lielāka uzmanība jāvelta 2002. gadā pieņemtā jaunā režīma ieguldījumam Kopienas flotes pārvaldībā, lai nodrošinātu labāku līdzsvaru starp flotu lielumu un zivju krājumu apjomu. Ir precīzāk jānosaka un jāizvērtē nacionālo zvejas kuģu ekspluatācijas pārtraukšanas programmu ietekme, jo īpaši attiecībā uz zvejas piepūles samazināšanu zvejā, kuru veic saskaņā ar pārvaldības un atjaunošanas plāniem. TECHNICAL ANNEX 1 – SUMMARY TABLES AND GRAPHS Fleet Management in the reformed Common Fisheries Policy a) Entry/Exit regime From 1 January 2003 Member States have had to respect a strict entry-exit regime applying to the capacity of their fleets, measured in terms of both tonnage and power. Any entry of capacity into the fleet of a Member State has to be compensated by the previous exit of at least the same amount of capacity (ratio 1:1, “at any time”), unless the entry corresponds to works to improve safety, hygiene or living and working conditions on board (Article 11(5) of Council Regulation (EC) No 2371/2002). For entries of new vessels between 100 and 400 GT built with public aid (the administrative decisions granting aid were possible only until 31 December 2004) the Member State has to withdraw 35% more capacity than it introduces (ratio 1:1.35). Another important rule is that capacity leaving the fleet with public aid cannot be replaced. Such capacity is subtracted directly from the fleet and also from the reference level established in accordance with Article 12 of Council Regulation (EC) No 2371/2002, and it therefore counts against the entry/exit regime in the ratio 0:1. Capacity reductions supported with public aid are therefore definitive. All of this means that, as a general rule, the capacity of the national fleets cannot increase with respect to its levels on: - 1 January 2003 for EU-15 Member States in accordance with Article 6 and 7 of Commission Regulation (EC) No 1438/2003; - 1 May 2004 for new Member States in accordance with Article 1(2) and 1(3) of Commission Regulation (EC) No 916/2004. In practice this is likely to be the case. However, the implementing rules for the fleet policy allow for the introduction of vessels outside the framework of the entry/exit regime in the case where administrative decisions have been made by the national authorities: - between 1 January 2000 and 31 December 2002 for those vessels to enter the fleet after 1 January 2003 in EU-15 Member States and, - between 1 May 2001 and 30 April 2004 for vessels which enter the fleet after 1 May 2004 in new Member States. These entries have to take place at the most 3 years after the date of the administrative decision (i.e. for EU-15 Member States at the latest by the end of 2005 and for new Member States until 30 April 2007) and must comply with the rules that existed at that time, in particular Article 9 of the Council Regulation (EC) No 2792/1999 regarding Community structural assistance in the fisheries sector. b) Reference Levels (mainland fleet) The reference levels for the fleets of Member States are the sum of the global final objectives of Multiannual Guidance Programme (MAGP IV) as established by Article 12 of Council Regulation (EC) No 2371/2002. The general rule is that Member States may not exceed their reference levels at any time. When a Member State undertakes decommissioning with public aid, these reference levels are automatically reduced by the amount of capacity scrapped. In addition, Member States which gave aid to construction of vessels until the end of 2004 will see their initial 2003 reference level reduced at least by 3% by the end of 2004. Since the reference levels are a legacy of MAGP IV[7] (period 1997 – 2002), the Council decided that they would not apply to the new Member States (Council Regulation (EC) No 1242/2004[8]). c) Management of fleet reference levels in the outermost regions The fishing fleets registered in the Community outermost regions, namely the French Overseas Departments, the Spanish Canary Islands and the Portuguese Azores and Madera have to comply with specific reference levels for these regions in accordance with Council Regulation (EC) No 639/2004[9] and Commission Regulation (EC) No 2104/2004[10]. d) Measurement of tonnage The measurement of the Community fleet is based on Council Regulation (EC) No 3259/94[11] and Commission Decision No 95/84/EC[12]. These legislative acts establish that the tonnage of vessels of 15 m in length or more has to be measured in accordance with the London Convention, i.e. as a function of the vessel’s total enclosed volume, while for vessels of less than 15 m in length, the regulation defines a system of tonnage calculation based on an estimate of the hull’s volume. The fleet should have been entirely measured in accordance with Community law by 31 December 2003. Nevertheless, at the end of 2005, for some Member States there remained number of vessels that were not measured in GT. In cases where the measurement of the fleet has not been completed, the tonnage figures used in this report are a mixture of GT and GRT. That is, for vessels whose GT tonnage is not available the GRT value is used. e) Community Fishing Fleet Register In 2004, the new Community Fleet Register was set up in accordance with Commission Regulation (EC) No 26/2004. It became operational on 1st September 2004. This change was necessary in order to follow up the new rules for managing the fishing capacity of the EU fleet which entered into force on 1st January 2003. This system, following the 2002 CFP reform , gives more responsibility to the Member States in achieving a better balance between the fishing capacity of their fleets and the available resources. The main tool for monitoring the fishing fleet is the Community Fleet Register (CFR). According Commission Regulation (EC) No 26/2004, Member States are obliged on a quarterly basis ("snapshots" shall be sent on the first working day of March, June, September and December) to transmit electronically all relevant information on the characteristics of approximately 88,500 marine fishing vessels, together with information on entries to and exits from the fleet. Furthermore, the CFR is managed via web based application, called the Community Fleet Register On the Net (FRONT). The FRONT is also available for the general public on the following web page: http://ec.europa.eu/comm/fisheries/fleet/index.cfm It is important to note that all information contained in the Technical Annexes 1, 2 and 3 has been taken from the CFR, with the exception of: - data on entries corresponding to administrative decisions taken by national authorities before 1 January 2003 (or 1 May 2004 for the new Member States) and for which the special transitional provisions established in the regulation apply; - data on exits with public aid in some cases where this was not available. Only in these two cases has the information been taken directly from the Member States. The reference levels for the outermost regions were fixed for each segment of the fleet on the 1 January 2003. At any later date, the reference level for each segment is calculated by deducting from the initial reference levels the capacity withdrawn with public aid for that particular segment. It is in this way that the graphs presented below have been calculated.
