KOMISIJAS ĪSTENOŠANAS LĒMUMS (ES) 2017/2000

(2017. gada 6. novembris),

ar ko groza pielikumu Īstenošanas lēmumam (ES) 2017/247 par aizsardzības pasākumiem saistībā ar augsti patogēnās putnu gripas uzliesmojumiem dažās dalībvalstīs

EIROPAS KOMISIJA,

ņemot vērā Līgumu par Eiropas Savienības darbību,

ņemot vērā Padomes 1989. gada 11. decembra Direktīvu 89/662/EEK par veterinārajām pārbaudēm Kopienas iekšējā tirdzniecībā, lai izveidotu iekšējo tirgu (1), un jo īpaši tās 9. panta 4. punktu,

ņemot vērā Padomes 1990. gada 26. jūnija Direktīvu 90/425/EEK par veterinārajām un zootehniskajām pārbaudēm, kas piemērojamas Kopienā iekšējā tirdzniecībā ar noteiktiem dzīviem dzīvniekiem un produktiem, lai izveidotu iekšējo tirgu (2), un jo īpaši tās 10. panta 4. punktu,

tā kā:

Komisijas Īstenošanas lēmums (ES) 2017/247 (3) tika pieņemts pēc augsti patogēnās H5 apakštipa putnu gripas uzliesmojumiem virknē dalībvalstu (“attiecīgās dalībvalstis”) un pēc tam, kad attiecīgo dalībvalstu kompetentās iestādes saskaņā ar Padomes Direktīvas 2005/94/EK (4) 16. panta 1. punktu bija noteikušas aizsardzības zonas un uzraudzības zonas.

Īstenošanas lēmumā (ES) 2017/247 paredzēts, ka aizsardzības zonās un uzraudzības zonās, ko saskaņā ar Direktīvu 2005/94/EK noteikušas attiecīgo dalībvalstu kompetentās iestādes, ir jāiekļauj vismaz tie apgabali, kuri kā aizsardzības zonas un uzraudzības zonas norādīti minētā īstenošanas lēmuma pielikumā. Īstenošanas lēmumā (ES) 2017/247 arī noteikts, ka aizsardzības zonās un uzraudzības zonās piemērojamie pasākumi, kas paredzēti Direktīvas 2005/94/EK 29. panta 1. punktā un 31. pantā, ir jāsaglabā vismaz līdz datumiem, kas attiecībā uz šīm zonām noteikti minētā īstenošanas lēmuma pielikumā.

Kopš Īstenošanas lēmuma (ES) 2017/247 pieņemšanas dienas tas ir vairākkārt grozīts nolūkā ņemt vērā putnu gripas epidemioloģiskās situācijas attīstību Savienībā. Īpaši Īstenošanas lēmums (ES) 2017/247 tika grozīts ar Komisijas Īstenošanas lēmumu (ES) 2017/696 (5), lai paredzētu noteikumus, kuri jāievēro, veicot diennakti vecu cāļu nosūtīšanu no apgabaliem, kas norādīti Īstenošanas lēmuma (ES) 2017/247 pielikumā. Minētajā grozījumā ņemts vērā tas, ka augsti patogēnās putnu gripas izplatībā diennakti veci cāļi rada ļoti mazu risku salīdzinājumā ar citām mājputnu izcelsmes precēm.

Pēc tam Īstenošanas lēmums (ES) 2017/247 tika grozīts ar Komisijas Īstenošanas lēmumu (ES) 2017/1841 (6), lai stiprinātu slimības kontroles pasākumus, kas piemērojami gadījumos, kad pastāv paaugstināts augsti patogēnās putnu gripas izplatības risks. Tādējādi tagad Īstenošanas lēmums (ES) 2017/247 paredz, ka pēc augsti patogēnās putnu gripas uzliesmojuma vai uzliesmojumiem Savienības līmenī jāizveido citas ierobežojumu zonas attiecīgajās dalībvalstīs, kā noteikts Direktīvas 2005/94/EK 16. panta 4. punktā, kā arī nosaka tajās piemērojamo pasākumu ilgumu. Tagad Īstenošanas lēmums (ES) 2017/247 arī paredz noteikumus, kas jāievēro, veicot dzīvu mājputnu, diennakti vecu cāļu un inkubējamu olu nosūtīšanu no citām ierobežojumu zonām uz citām dalībvalstīm, atbilstoši konkrētiem nosacījumiem.

Turklāt Īstenošanas lēmuma (ES) 2017/247 pielikums vairākkārt ir grozīts, lai ņemtu vērā to, kā mainījušās aizsardzības zonas un uzraudzības zonas, ko saskaņā ar Direktīvu 2005/94/EK noteikušas attiecīgās dalībvalstis. Īstenošanas lēmuma (ES) 2017/247 pielikums pēdējo reizi ir grozīts ar Komisijas Īstenošanas lēmumu (ES) 2017/1969 (7) pēc Itālijas paziņojuma par Lombardijas un Veneto reģionā konstatētiem jauniem augsti patogēnās putnu gripas uzliesmojumiem un pēc Bulgārijas paziņojuma par Haskovo reģionā konstatētu jaunu šīs slimības uzliesmojumu. Turklāt Itālija un Bulgārija paziņoja Komisijai par aizsardzības zonas un uzraudzības zonas izveidošanu ap inficētajām mājputnu saimniecībām saskaņā ar Direktīvu 2005/94/EK.

Kopš dienas, kad pēdējo reizi Īstenošanas lēmums (ES) 2017/247 tika grozīts ar Īstenošanas lēmumu (ES) 2017/1969, Itālija ir paziņojusi Komisijai par jauniem augsti patogēnās H5N8 apakštipa putnu gripas uzliesmojumiem mājputnu saimniecībās šīs dalībvalsts Lombardijas reģionā. Itālija arī ir paziņojusi Komisijai, ka pēc šiem nesen notikušajiem uzliesmojumiem tā ir veikusi vajadzīgos pasākumus atbilstoši Direktīvai 2005/94/EK, tostarp noteikusi aizsardzības zonas un uzraudzības zonas ap visām inficētajām mājputnu saimniecībām.

Komisija pārbaudīja pasākumus, kurus pēc pēdējiem augsti patogēnās putnu gripas uzliesmojumiem Itālija bija veikusi atbilstoši Direktīvai 2005/94/EK, un atzina, ka Itālijas kompetento iestāžu noteikto aizsardzības zonu un uzraudzības zonu robežas atrodas pietiekami tālu no visām mājputnu saimniecībām, kurās apstiprināts augsti patogēnās H5N8 apakštipa putnu gripas uzliesmojums.

Lai novērstu nevajadzīgus tirdzniecības traucējumus Savienībā un nepieļautu, ka trešās valstis liek nepamatotus tirdzniecības šķēršļus, sadarbībā ar Itāliju īsā laikā nepieciešams Savienības līmenī aprakstīt aizsardzības zonas un uzraudzības zonas, kuras pēc pēdējiem šajā dalībvalstī konstatētajiem augsti patogēnās putnu gripas uzliesmojumiem Itālija noteikusi saskaņā ar Direktīvu 2005/94/EK. Tāpēc ieraksti par Itāliju Īstenošanas lēmuma (ES) 2017/247 pielikumā būtu jāatjaunina, lai ņemtu vērā jaunāko ar šo slimību saistīto epidemioloģisko situāciju minētajā dalībvalstī. Īstenošanas lēmuma (ES) 2017/247 pielikumā ietvertajos sarakstos jo īpaši būtu jāiekļauj jauni ieraksti par aizsardzības un uzraudzības zonām Lombardijas reģionā Itālijā, uz ko tagad attiecas Direktīvā 2005/94/EK noteiktie ierobežojumi.

Tāpēc Īstenošanas lēmuma (ES) 2017/247 pielikums būtu jāgroza, lai saistībā ar nesenajiem augsti patogēnās putnu gripas uzliesmojumiem Itālijā atjauninātu reģionalizāciju Savienības līmenī un iekļautu saskaņā ar Direktīvu 2005/94/EK Itālijā noteiktās aizsardzības zonas un uzraudzības zonas, kā arī lai noteiktu tajās piemērojamo ierobežojumu termiņu.

(10)	Tāpēc Īstenošanas lēmums (ES) 2017/247 būtu attiecīgi jāgroza.

(11)	Šajā lēmumā paredzētie pasākumi ir saskaņā ar Augu, dzīvnieku, pārtikas aprites un dzīvnieku barības pastāvīgās komitejas atzinumu,

IR PIEŅĒMUSI ŠO LĒMUMU.

1. pants

Īstenošanas lēmuma (ES) 2017/247 pielikumu groza saskaņā ar šā lēmuma pielikumu.

Šis lēmums ir adresēts dalībvalstīm.
